DECISION
PROMULGATION OF NATIONAL TECHNICAL REGULATION ON ENVIRONMENT
MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Pursuant to the Law on Technical regulations and standards dated June 29, 2006;
Pursuant to the Government's Decree No. 127/2007/NĐ-CP dated August 01, 2007 detailing the implementation of a number of articles of the Law on Technical regulations and standards;
Pursuant to the Government's Decree No. 25/2008/NĐ-CP on March 04, 2008 on defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;
At the request of the Prime Minister in Dispatch No. 2346/VPCP-TCCV dated April 11, 2008 of Office of the Government on permission for some units of the Ministry of Natural Resources and Environment to sustain their operations and keep using existing seals and accounts;
At the request of Environment Department and Legal Department,
HEREBY DECIDES:
Article 1. Promulgation of 03 National Technical Regulation on environment:
1. QCVN 01:2008/BTNMT – National technical regulation on the effluent of natural rubber processing industry;
2. QCVN 02:2008/BTNMT – National technical regulation on the emission of health care solid waste incinerators;
3. QCVN 03:2008/BTNMT – National technical regulation on allowable limits of heavy metal in soil.
Article 2. This Decision takes effect after 15 days from the day on which it is published on the Official Gazette.
Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People’s Committees of provinces, relevant organizations and individuals are responsible for the implementation of this Decision./.

NATIONAL TECHNICAL REGULATION ON THE ALLOWABLE LIMITS OF HEAVY METALS IN THE SOILS
Foreword
QCVN 03:2008/BNTMT is drafted, submitted by Environment Department and Legal Department, and promulgated together with Decision No. 04/2008/QĐ-BTNMT dated July 18, 2008 of the Minister of Natural Resources and Environment.
NATIONAL TECHNICAL REGULATION ALLOWABLE LIMITS OF HEAVY METALS IN THE SOILS
1. GENERAL PROVISIONS
1.1. Scope
This Regulation specifies the allowable limits of total content of some heavy metals: arsenic (As), cadmium (Cd), copper (Cu), lead (Pb), and zinc (Zn) in topsoil according to land use purposes.
This Regulation does not apply to soil of mining sites, industrial landfills, specialized forests; national parks; sanctuaries, landscape protection zone; forests serving scientific research.
1.2. Regulated entities
This Regulation applies to environment authorities and every organization or individual involved in the use of land within Vietnam’s territory.
1.3. Interpretation of terms
In this Regulation, the terms below are construed as follows:
1.3.1. Agricultural land includes the types of land used for planting padding, grass for breeding, annual plants, perennial plants; land serving aquaculture, salt production; and other types of agriculture land defined by the Government. Agricultural land also INCLUDES habitats of local, migratory animals and local vegetation.
1.3.2. Forestry land means land of production forests which is classified as agricultural land, land serving forestry, which is mostly used for planting forests and other forest products. Forest land mentioned in this Regulation does not include natural land and specialized forests.
1.3.3. Residential land means a type of non-agricultural land which is mainly used for residential areas, relaxation and entertainment, parks, and buffer zones of residential areas.
1.3.4. Commercial land means a type of non-agricultural land which is mainly used for commerce and service provision.
1.3.5. Industrial land means a type non-agricultural land which is mainly used for industry and handicrafts.
1.3.6. Topsoil means the topmost layer of soil, the thickness of which is up to 30 cm.
2. TECHNICAL PROVISIONS
Allowable limits of total contents of some heavy metals in topsoil of some types of land are provided in Table 1.

3. DETERMINATION METHOD
3.1. Sampling
Samples shall be taken to determine heavy metals in accordance with and TCVN 4046:1985 – Soil – Method of sampling and TCVN 5297:1995 – Soil quality – Sampling – General requirements.
3.2. Analysis method
Heavy metals mentioned in this Regulation shall be determined according to:
- TCVN 6649:2000 (ISO 11466:1995) Soil quality -- Extraction of trace elements soluble in aqua regia.
- TCVN 6496:1999 (ISO 11047:1995) - Soil quality – Determination of cadmium, chromium, cobalt, copper, lead, manganese, nickel and zinc in aqua regia extracts of soil - Flame and electrothermal atomic absorption spectrometric methods.
4. IMPLEMENTATION
Environment authorities and every organization or individual involved in the use of land for varied purposes shall comply with this Regulation.
