DECISION

ANNULLING LEGAL DOCUMENTS

THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to the Government's Decree No. 22/CP of May 22, 1993 on the tasks, powers and organizational apparatus of the Ministry of Science, Technology and Environment (now the Ministry of Science and Technology);
At the proposals of the director of the Legal Department, the director of the Department for Management of Industrial Sciences and Technologies, the director of the Office for Technological and Environmental Evaluation of Investment Projects, and the director of the Ministry's Office,

DECIDES:

Article 1.- To annul the following documents:

- Decision No. 2019/1997/QD-BKHCNMT of December 1, 1997 of the Minister of Science, Technology and Environment promulgating the Regulation on general technical requirements on the import of used equipment.

- Decision No. 491/1998/QD-BKHCNMT of April 29, 1998 of the Minister of Science, Technology and Environment amending a number of contents of the Regulation on general technical requirements on the import of used equipment, issued together with his Decision No. 2019/1997/QD-BKHCNMT of December 1, 1997.

- The regulations in Chapter IV of the Science, Technology and Environment Ministry's Circular No. 02/2001/TT-BKHCNMT of February 15, 2001 on the import of used machinery for foreign-invested enterprises.

Article 2.- The import of used equipment shall comply with the Prime Minister's Decision No. 46/2001/QD-TTg of April 4, 2001 on the management of goods import and export in the 2001-2005 period and must ensure the regulations on labor safety and sanitation, environmental protection as well as product and service quality according to the provisions of Vietnamese law.

Article 3.- This Decision takes effect 15 days after its publication on the Official Gazette.

Article 4.- The director of the Legal Department, the director of the Department for Management of Industrial Sciences and Technologies, the director of the Office for Technological and Environmental Evaluation of Investment Projects, the director of the Ministry's Office as well as the concerned organizations and individuals shall have to implement this Decision.
