DECISION
PROMULGATING THE LIST OF SCRAPS PERMITTED TO BE IMPORTED FOR USE AS RAW MATERIALS FOR PRODUCTION
THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Pursuant to the November 29, 2005 Law on Environmental Protection;
Pursuant to the Government's Decree No. 91/2002/ND-CP of November 11, 2002, defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to the Government's Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding international goods sale and purchase and goods sale and purchase agency, processing and transit with foreign countries;
Pursuant to the Government's Decree No. 80/2006/ND-CP of August 9, 2006, detailing and guiding the implementation of a number of articles of the Law on Environmental Protection;
At the proposal of the directors of the Environmental Protection Department and the Legal Department,
DECIDES:
Article 1.- To promulgate together with this Decision the List of scraps permitted to be imported for use as raw materials for production.
Article 2.- The importation of scraps shall comply with the provisions of Articles 42 and 43 of the Law on Environmental Protection and relevant legal provisions.
Article 3.- This Decision shall take effect 15 days after its publication in "CONG BAO" and replace the Natural Resources and Environment Minister's Decision No. 03/2004/QD-BTNMT of April 2, 2004, promulgating the Regulation on environmental protection applicable to scraps imported for use as raw materials for production.
Article 4.- Ministers, heads of ministerial-level agencies and government-attached agencies, presidents of provincial/municipal People's Committees, and concerned organizations and individuals shall have to implement this Decision.
