DECISION
ON THE AMENDMENT OF SOME PROVISIONS RELATING TO GUARANTEE FEE COLLECTION OF CREDIT INSTITUTIONS
THE GOVERNOR OF THE STATE BANK
Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated 12 December, 1997 and Law on the Credit Institutions No. 02/1997/QH10 dated 12 December, 1997;
Pursuant to the Decree No. 15 CP dated 02 March, 1993 of the Government on the assignment, authority and responsibility for the State management of the ministries and ministry-level agencies;
Upon the proposal of the Director of the Credit Department,
DECIDES
Article 1. To amend Article 22 of the Regulation on the bank guarantee issued in conjunction with the Decision No. 283/2000/QD-NHNN14 dated 25 August, 2000 of the Governor of the State Bank as follows:
"Article 22. Guarantee fee
1. Credit institutions shall be entitled to determine types of fee and the specific level of guarantee fee (including the guarantee fee for deferred payment) for their customers in line with their costs and the risk level of this operation. Credit institutions shall announce publicly the guarantee tariff at their transaction places for customers information.
2. In the event of a counter guarantee, the confirmation of a guarantee, co-guarantee, credit institutions shall agree among themselves on the level of guarantee fee that each credit institution is entitled to enjoy on the basis of the level of guarantee fee to be collected from customers."
Article 2. This Decision shall be effective after 15 days from the date of signing. All provisions provided for in paragraph 7 Article 1 of the Decision No. 386/2001/QD-NHNN dated 11 April, 2001 of the Governor of the State Bank on the amendment, supplement of several Articles in the Regulation on the bank guarantee issued in conjunction with the Decision No. 283/2000/QD/NHNN14 dated 25 August, 2000 of the Governor of the State Bank shall cease the effectiveness.
Article 3. The Director of the Administration Department, the Director of the Credit Department Heads of relevant units of the State Bank, General Managers of State Bank branches in provinces, cities under the central governments management, Chairpersons of the Board of Directors and General Directors (Directors) of credit institutions shall be responsible for the implementation of this Decision.
