DECISION

ON THE ESTABLISHMENT OF THE INVESTMENT STEERING COMMITTEE IN THE FORM OF PUBLIC - PRIVATE PARTNERSHIP (PPP)

PRIME MINISTER

Pursuant to the Law on organization of Government dated December 25, 2001;

Pursuant to Decision No. 71/2010/QD-TTg dated November 09, 2011 of the Prime Minister on issuing Regulation on pilot investment in the form of public-private partnership;

Pursuant to Decision No. 34/2007/QD-TTg dated March 12, 2007 of the Prime Minister issuing Regulation on establishment, organization and operation of inter-sectoral coordination organization;

At the proposal of the Minister of Planning and Investment,

DECIDES:

Article 1. Establishing the investment steering committee in the form of public - private partnership (hereafter referred to as Steering Committee) to assist the Government, the Prime Minister to study, direct and implement the investment model in the form of public - private partnership

Article 2. Duties and power of Steering Committee

1. Studying and putting forwards the orientation, plans and strategic solutions for efficient implementation of PPP model.

2. Assisting the Prime Minister to direct, urge and coordinate activities between Ministries, sectors and localities in implementation of PPP model under Decision No. 71/2010/QD-TTg dated November 09, 2010 of the Prime Minister.

3. Directing the relevant Ministries and sector to build and complete the legal documents system guiding the implementation of PPP model while reviewing and completing regulations of law in order to unify the management of the investment model with the coordination between the State and private sector (PPP, BOT, BTO, BT ...).

4. Directing the summary, assessment and proposal to build legal policies on PPP (Decree, Law) after completion of pilot stage.

Article 3. Participants of Steering Committee

1. Head of Committee: Deputy Minister Hoang Trung Hai.

2. Deputy Heads of Committee:

- Minister of Planning and Investment - Standing Deputy Head;

- Deputy Minister of Finance.

3. Other members are Deputy Ministers (or equivalent) of the Ministries or ministerial-level agencies:

- Ministry of Planning and Investment;

- Governmental Office;

- State Bank of Vietnam;

- Ministry of Justice;

- Ministry of Transport;

- Ministry of Construction;

- Ministry of Industry and Trade;

- Ministry of Health;

- Ministry of Information and Communications;

- Ministry of Education and Training;

- Ministry of Natural Resources and Environment.

After this Decision comes into effect, the Ministries and agencies mentioned above should send the list of Leaders participating the in the Steering Committee to the Ministry of Planning and Investment for summary and report to the Head of Committee;

4. Secretary of Committee: Director of Bidding Management Department, Ministry of Planning and Investment.

Article 4. Operation of Steering Committee

1. The Steering Committee operates under the enhanced responsibilities of the Head of Committee.

2. The Head shall issue Regulations on operation of Steering Committee.

3. The Ministry of Planning and Investment is the standing agency of the Steering Committee and is responsible for ensuring the conditions for operation of the Committee.

4. The operational funds of the Steering Committee shall be included in the annual budget estimates of the Ministry of Planning and Investment; the payment and settlement of funds shall comply with the current regulations.

5. The Head of Committee shall use the seal of Prime Minister; the Deputy Heads and members shall sign documents under assigned duties or authorization and use the seal of their Ministries or agencies;

6. The member of the Steering Committee shall work on a part-time basis.

Article 5. This Decision takes effect from the date of its signing.

The Head of Committee, the Ministers, Heads of ministerial-level agencies and Heads of Government-attached agencies, Chairman of People’s Committee of provinces and centrally-affiliated cities, members and secretary of Committee are liable to execute this Decision./.
