DECISION

ISSUE THE PLAN FOR IMPLEMENTATION OF NATIONAL ENVIRONMENTAL PROTECTION STRATEGY BY 2020, WITH A VISION TO 2030

PRIME MINISTER

Pursuant to the Law on organization of Government dated 25 December 2001;

Pursuant to the Law on environmental protection dated 29 November 2005;

Pursuant to Decision No. 1216/QD-TTg dated 05 September 2012 of the Prime Minister approving the national environmental protection Strategy by 2020 with a vision to 2030;

Considering the recommendation of the Minister of Natural Resources and Environment,

DECIDES:

Article 1. Issued with this Decision is the Plan for implementation of national environmental protection Strategy by 2020 with a vision to 2030.

Article 2. This decision takes effect from its signing date.

Article 3. Ministers, Heads of ministerial-level organs, Heads of governmental organs, Chairmen of People’s Committee of provinces and centrally-run cities are liable to execute this Decision./.

PLAN

IMPLEMENTATION OF NATIONAL ENVIRONMENTAL PROTECTION STRATEGY BY 2020, WITH A VISION TO 2030
(Issued with Decision No. 166/QD-TTg dated 21 January 2014 of the Prime Minister)

I. OBJECTIVES

The Plan for implementation of national environmental protection Strategy by 2020 with a vision to 2030 (hereafter referred to as Plan) defines the group of duties for implementation of contents, measures and solutions of the Strategy as a basis for the Ministries, sectors and localities to develop and implement the annual environmental protection plan as per the assigned functions and duties to obtain the target of strategy.

II. CONTENT

1. Prevention and control the potential pollution sources and environmental pollution areas

- Developing and implementing a roadmap for economic restructuring towards restriction, gradually eliminating the types of production potentially causing serious environmental pollution, limiting and stopping the issue of new investment or expanded investment license for types of industry potentially causing serious environmental pollution, especially in residential areas, river basins, sensitive areas and areas with protection priority; focusing on development of green and environmentally-friendly economic sectors.

- Developing criteria and organizing the annual evaluation and classification of sectors, provinces and centrally-run cities on the environmentally friendly degree and making public announcement for adjustment of development policies and planning in accordance with the reality of sectors and localities towards prioritizing the development of green and environmentally friendly economic industries.

- Issuing the environmental criteria in social-economic development, land use planning; sector and area development planning to integrate the environmental protection requirements towards sustainable development.

- Studying, testing and implementing the functional zoning as per ecosystems for social-economic development for areas with required priority and protection and areas with restriction or prohibited industrial development, mineral mining in order to ensure the harmonization between the environmental protection target with the social-economic development target.

- Strictly implementing the post audit; not approving the environmental impact assessment impact report for investment projects using backward production technologies causing environmental pollution; strictly following the preventive measures and preventing the introduction of old and backward machinery, equipment and technologies causing environmental pollution into use;

- Implementing the environmental pollution control Scheme due to the use of persistent plastic bag in daily life under the Decision No. 582/QD-TTg dated 11 April 2013 of the Prime Minister; gradually forming the environmentally friendly consumption habit; expanding and continuing the eco-labeling for certain types of products and services.

- Effectively implementing the national target program on effective and thrifty use of energy for the period 2-12-2015 issued with Decision No. 1427/QD-TTg dated 02 October 2012 of the Prime Minister, the cleaner production Strategy in industry by 2020 under the Decision No. 1419/QD-TTg dated 7 September 2009 of the Prime Minister.

- Developing and implementing the national action Plan on air pollution control by 2020.

- Developing and implementing the Scheme for strengthened control over the importation of scrap used as production materials and transportation of waste across border by 2020; developing the coordination mechanism between the state management organ on environmental protection, import export management and police force for environmental crime prevention and fighting in inspection and monitoring the import of scrap used as production materials; stopping the import of scrap as production materials or transportation of waste across border improperly.

- Developing and implementing the Scheme of strengthened capacity of active prevention of natural disaster, response to environmental incident, especially the spill of oil, chemical, radioactive and nuclear substances, flood, storm, earthquake, seawater rise for the period until 2020; strictly following regulations on activity registration of chemicals, especially toxic chemicals, strictly controlling transportation and use of machinery and equipment related to chemicals and radioactive substances; accelerating the progress of supplementation and completion and putting into application the technical regulations and standards, requirements for safety of chemicals, radioactive and nuclear substances in combination with inspection, examination and strict handling for cases of violation.

- Issuing preferential policies on environmental-friendly model of industrial parks, industrial clusters, economic areas, export processing zones, production establishments, farms, warehouses, open storages and markets.

- Implementing Decision No. 50/2013/QD-TTg dated 09 August 2013 of the Prime Minister stipulating the recovery and processing of disposed products; building legal framework of waste recycling and reuse, collection and classification of waste at source towards specialization and development of environmentally friendly recycling industry, focusing on the formation of recycled and reused waste market.

2. Control, treatment and reduction in potential pollution sources

- Gradually increasing the annual budget to boost the environmental inspection and examination for operating establishments and mineral mining projects with risk of causing environmental pollution.

- Implementing the Plan thoroughly handling the establishments causing serious environmental pollution by 2020 under the Decision No. 1788/QD-TTg dated 01 October 2013 of the Prime Minister.

- Issuing policies on encouragement of business and production establishments and constructional services and application of environmental management system based on ISO 14000standard; issuing regulations on guiding the use of emission quota and formation of emission quota transfer market and regulations on waste audit and product life cycle assessment.

- Implementing the overall Scheme for environmental pollution of handicraft village by 2020, with a vision to 2030 under the Decision No. 577/QD-TTg dated 11 April 2013 of the Prime Minister; studying and introducing new and environmentally friendly technologies into handicraft villages; developing production models using biogas from livestock waste.

- Developing and implementing the overall Scheme for environmental pollution of rural areas by 2020, focusing on strictly management of waste sources from livestock, poultry, aquaculture raising, properly destruction of diseased livestock, poultry to ensure environmental sanitation; promoting the application of technical measures of farming, gradually reducing the use of pesticide and chemical fertilizers; following technical requirements upon use of pesticide and chemical fertilizers in agricultural production.

- Implementing the national target Program of clean water and rural environmental sanitation for the period 2012 – 2015 under the Decision No. 366/QD-TTg dated 31 March 2012 of the Prime Minister.

- Continuing the implementation of national Strategy on general management of solid waste by 2025 with a vision to 2050 under the Decision No. 2149/QD-TTg dated 17 December 2009 of the Prime Minister.

- Implementing the overall Scheme for treatment of medical waste for the period 2011 – 2015 with a vision to 2020 under the Decision No. 2038/QD-TTg dated 15 November 2011 of the Prime Minister.

- Implementing the Scheme for control of environmental pollution in transportation activity under the Decision No. 855/QD-TTg dated 06 June 2011 of the Prime Minister; the Scheme for control of emission of motorcycles and mopeds in traffic in provinces and cities under Decision No. 909 / QD-TTg dated 17 June, 2010 of the Prime Minister.

- Implementing the roadmap for application of emission standard of road motored vehicles under the Decision No. 249/2005/QD-TTg dated 10 October 2005 of the Prime Minister for motorcycles and mopeds newly manufactured, assembled and imported under the Decision No. 49/2011/QD-TTg dated 01 September 2011 of the Prime Minister; encouraging the development of means of transportation using clean and recycled energy, strengthening the management of oil waste sources and oil spill in waterway traffic.

- Finishing the technical and economic norm system and unit price for operation of waste treatment system, immediately focusing on certain models of activity as follows: treatment system of hazardous medical waste water and solid waste, waste water, solid waste and emission from handicraft villages; processing system of central urban living waste water; processing system of leachate at the central waste processing works.

3. Improvement and restoration of polluted areas

- Completing and issuing criteria for defining and classifying areas of environmental pollution.

- Effectively implementing the national target Program on improvement of pollution and environment which the Prime Minister has approved in Decision No. 1206/QD-TTg dated 02 September 2012.

- Developing and implementing the Scheme for improvement and restoration of environment of ponds, lakes, canals, ditches, river sections in urban areas and residential area severely polluted; defining the boundary of area of lakes, canals, ditches, river sections in urban areas and residential area in order to embank them and stop the illegal encroachment and leveling; limiting and stopping the implementation of leveling projects or projects with leveling items to narrow water surface.

- Developing and implementing investment projects on improvement and restoration of environment of lakes, ponds, ditches and river sections in urban areas and residential area for investment support from ODA or state budget, focusing on combination of urban refurbishment with the upgrading and completion of waste water and rainwater drainage and building of central waste water processing system.

- Developing and implementing the overall Scheme for environmental protection of Mekong river basin; implementing the Scheme for environmental protection of river basins (Cau river, Nhue – Day river and Dong Nai river) approved by the Prime Minister.

- Implementing the Plan for treatment and prevention of environmental pollution due to residue of pesticide nationwide under the Decision No. 1946/QD-TTg dated 21 October 2010 of the Prime Minister; the national action Plan basically overcoming the consequences of toxic chemicals used by the US during Vietnam war by 2015 with a vision to 2015 under the Decision No. 651/QD-TTg dated 01 June 2012 of the Prime Minister.

- Studying, testing and replicating model of residual pollution treatment technology, restoration of environment of ponds, lakes, ditches, canals and river section in urban areas and areas with residual of pesticide and dioxin poisoning.

- Effectively implementing regulations on environmental deposit, improvement and restoration for mineral mining to ensure the deposit must be sufficient for environmental restoration and improvement after the mining; issuing regulations on responsibilities of investor of mineral mining projects in infrastructure development investment, support in hunger elimination and poverty reduction, employment and health care for people at localities where the minerals are mined.

- Developing and issuing regulations of law on land environment protection; mechanism of integrity of cost of environmental processing, improvement and restoration in areas polluted with residues into the land price to maximally mobilize the social resources for improvement and restoration of environmental pollution, preferential and supporting policies for organizations and individuals carrying out the environmental treatment, improvement and restoration in polluted areas without use of state budget.

- Implementing Decision No. 1929/QD-TTg dated 20 November 2009 of the Prime Minister of approving the orientation of water supply development in urban area and industrial parks in Vietnam by 2025 with a vision to 2050.

- Surveying, assessing and making map of underground water pollution nationwide and developing plan for improvement and restoration of underground water quality.

4. Investment in environmental technical infrastructure building

- Developing and implementing investment projects on upgrading, renovation and new building of clean water supply works in rural areas, especially the remote areas.

- Developing and implementing investment projects on waste collection and processing, water drainage systems, cemeteries, ecological lakes and ponds in rural areas.

- Planning, preparing and implementing constructional projects for construction of works of central living waste water collection and processing in urban areas of grade IV or higher; projects for improving and upgrading the existing water drainage system in urban areas;

- Developing and implementing investment projects for improvement of national environmental monitoring station and automatic environmental and air environment monitoring station in large cities and surface water in main river basins.

- Developing and implementing investment projects for waste water treatment in industrial parks, industrial clusters and export processing zones.

- Developing and implementing investment projects for upgrading, renovation and new investment of treatment works of hazardous medical waste at district and provincial medical facilities, inter-regional and provincial treatment facilities under the Decision No. 170/QD-TTg dated 08 February 2012 of the Prime Minister approving the overall Planning of hazardous medical solid waste treatment system by 2025.

- Developing and implementing investment projects for construction of hazardous waste treatment center in 04 major economic zones, immediately prioritizing the implementation in the Southeast and the Mekong Delta key economic zones and continuing to build, finish and put into operation the investment projects for construction of hazardous waste treatment center in 02 key economic zones in the North and Central.

- Developing and implementing investment projects under the investment Program for solid waste treatment during the period 2011 – 2020 approved by the Prime Minister in the Decision No. 798/QD-TTg dated 25 May 2011.

- Investing and building the warning works of oil spill, chemical and natural disaster, storm, flood, earthquake with high precision with modern technology.

5. Effective and sustainable exploitation and use of natural resources

- Implementing the forest development and protection Plan during the period 2011 – 2020 under the Decision No. 57/QD-TTg dated 09 January 2012 of the Prime Minister; organizing the regeneration and protection of natural forests, especially mangrove, special-use forest, protection forest, watershed forest in combination with prevention of illegal cutting and exploitation of forest.

- Developing and implementing the projects of survey, assessment and implementation of measures to prevent the illegal exploitation, infringement and reduction and impoverishment of quality of primary forest; taking measures to improve the resilience of natural forests to the impact of climate change.

- Issuing and strictly follow the regulations on maximally restricting cases of permissible conversion of special-use forest, protection forest, watershed forest and rice land to other purposes of use; mechanism and policies to encourage and support the development of ecological economic village models in the degraded, impoverished and desertified land areas in order to improve the land quality and narrow the scale and degree of degradation and impoverishment.

- Reviewing and adjusting development planning of golf course, hydropower and mineral mining project for efficient and sustainable exploitation and use of land, water and forest resources.

- Issuing regulations on integrity of use of water resources in development planning of sectors, areas especially the ones using a lot of water to ensure the consistency with the planning of search and exploitation of water resources; strengthening the control of water source pollution, focusing on control of river basin and border-crossing water source pollution.

- Regularly inspecting and strictly sanctioning the facilities exploiting surface water and underground water with acts of law violation, especially in the dry season; studying and applying on trial the issue of quota in exploitation of surface water and underground water for each area; reviewing and adjusting the social-economic development planning; issuing, guiding and implementing the industrial crop development planning in accordance with supply capacity of surface water and underground water of each area.

- Effectively implementing Decision No. 1690/QD-TTg dated 16 September 2010 of the Prime Minister approving the fishery development Strategy of Vietnam by 2020; studying and applying on trial and gradually replicating mechanism of co-management of fishery resources, applying the ecological certificate and accessing other market mechanisms in exploitation of fishery resources.

- Reviewing and completing the law system on resources tax in order to effectively and sustainably use natural resources.

- Issuing and guiding the integrity of environmental protection with the planning of mineral exploration, exploitation and processing.

6. Natural conservation and biological diversity

- Continuing the completion and issuing documents guiding the implementation of Biodiversity Law and other relevant laws;

- Implementing the national Strategy on biodiversity by 2020, with a vision to 2030 approved by the Prime Minister under the Decision No. 1250/QD-TTg dated 31 July 2013.

- Developing and guiding the implementation of overall biodiversity conservation Planning of the country by 2020 with a vision to 2030.

- Assessing the actual state of biodiversity according to the criteria for establishing natural reserves stipulated in the Biodiversity Law and other relevant laws.

- Issuing and implementing the specific regulations on inspection and handling of illegal transportation and consumption of species which are protected with priority; prohibiting and limiting exploitation in the nature towards the strengthened participation of community; increasing the sanctions for violations.

- Implementing Decision No. 1869/QD-TTg dated 17 December 2012 of the Prime Minister approving the Scheme for prevention and control of invasive alien species by 2020 focusing on strengthening capacity for specialized organs on biodiversity and quarantine, especially at the provincial level.

7. Capacity strengthening in response to climate change and reduction in greenhouse gas emission

- Accelerating the national Strategy on climate change approved by the Prime Minister under the Decision No. 2139/QD-TTg dated 05 December 2011 and the national action Plan on climate change for the period 2012-2020 approved by the Prime Minister under the Decision No. 1474/QD-TTg dated 05 October 2012.

- Surveying and aggregating good models and experiences in response to climate change in Vietnam and some countries in the world; developing and organizing the training to raise the awareness and responsibility of managing staff, planning staff and specialized staff and other social components on climate change and its impacts.

- Studying and issuing guidelines and implementing the integrity of contents of response to climate change in strategy, planning, plan, program, development investment projects; reviewing and adjusting social-economic development programs and plans, industries and areas to suit the climate change scenarios.

- Studying and calculating the impacts of climate change, sea level rise and implementing response measures in coastal areas and natural ecosystems with national and international importance.

- Developing and organizing programs to raise capacity and participation of community in response activities to climate change, especially the residential communities directly affected and vulnerable to the effects of climate change.

- Reviewing and supplementing regulations and guidelines on inspecting and monitoring projects on clean development mechanism

8. Propagation and enhancement of sense of responsibility for environmental protection

- Continuing to promote the propagation activities to raise the awareness of environmental protection for community towards innovation of content, diversity of propagation form; aggregating and replicating self-management models and strengthening the role of community in monitoring activities of environmental protection.

- Developing and implementing the Scheme for propagation, education of law and knowledge about environmental protection and climate change by 2020, with a vision to 2030 in accordance with actual conditions in Vietnam towards increase in amount of time and introducing the climate change issue into the environmental education content at all educational levels in the national educational and training system; expanding environmental training disciplines, focusing on disciplines with high demand in society; developing sets of material and textbook on environmental communication in accordance with each specific subject.

- Developing and issuing the environmental criteria integrated in emulation and commendation and award of Ministries, sectors and localities.

- Promoting the commendation and award to organizations and individuals in good performance of environmental protection.

9. Completion of law and institution of management, enhancement of law enforcement on environmental protection

- Regularly codifying the legal normative system on environmental protection, focusing on the correction of shortcomings, limitations, especially the overlapping and inadequacies of the legal system for environmental protection with other relevant specialized legal systems; completing regulations of law on clean air, effective use of natural resources, waste recycling and low carbon economic development; completing mechanisms of dispute settlement and environmental damage compensation; developing and submitting the Law on environmental protection (revised) to the National Assembly for adoption; developing and implementing documents guiding the implementation of Law on environmental protection (revised) after it is promulgated.

- Implementing Resolution No. 35/NQ-CP dated 18 March 2013 of the Government on a number of urgent issues in the field of environmental protection; Decree No. 179/2013/ND-CP dated 14 November 2013 of the Government stipulating the sanction of administrative violation in the field of environmental protection; coordinating in issue of guidelines on implementing regulations on environmental crimes in the Criminal Code for bringing the environmental crimes to trial or prosecution.

- Completing the system of national technical regulation and standard on environment.

- Supplementing and completing mechanisms and policies on tax, progressive environmental protection fees for waste materials, carrying out the proper and full collection in order to ensure sufficient fund for waste treatment and generate capital for investment back to the environmental protection activities, contributing the reduction in investment burden for environmental protection from the state budget and generate the sustainable financial sources for environmental protection.

- Developing and implementing the Scheme for strengthening the organizational apparatus and development of human resources of natural resources and environmental sectors in order to definitely deal with the overlapping, difficulty and dispersion in assignment and decentralization of responsibility for state management and focus on state management on environmental protection, recommend new organizational models of state management organs on environmental protection from the central to local level, especially the provincial, district and communal level to be more suitable with the current situation.

- Developing and implementing the Scheme for strengthening capacity of inspection system on environmental protection from the central to local level.

- Studying and revising Decree No. 72/2010/ND-CP dated 08 July 2010 of the Government on prevention and fighting against crimes and other violations of environmental protection towards clearly defining duties and powers of inspection and examination of state organs on environmental protection with the responsibility for investigation and detection of environmental crimes of the police force for environmental crime prevention and fighting; developing mechanisms to closely coordinate between the inspection and examination of state management organs on environment at all levels with the struggle, prevention and fighting against environmental crimes of the police force for environmental crime prevention and fighting;

- Completing and enhancing the application of economic instruments in state management on environment; completing and accelerating the application of mechanism of payment of ecosystem services in order to generate the investment capital in maintaining the ecological functions and biological capacity of natural ecological system; strengthening the implementation of incentive policies, price assistance, financial and credit assistance for environmental protection activities.

- Building the national environmental database system and in sectors and levels; promptly, accurately and fully providing environmental information for social-economic development and inspection, examination and sanctioning of legal violation on environment.

10. Scientific research, development and application of technology for environmental protection

- Developing and implementing the national key technological and scientific Program on environmental protection for the period until 2020 with a vision to 2030.

- Developing and implementing the action plan to mitigate greenhouse gas emission in accordance with conditions in Vietnam, focusing on solution to policies and technological innovation in accordance with conditions in Vietnam to mitigate greenhouse gas emission, adaptation and mitigation of impact of climate change.

- Developing and implementing the roadmap to remove all technologies, facilities and equipment being used in the country causing environmental pollution; completing mechanisms and policies to encourage the environmentally-friendly production and pollution-treating technology.

- Issuing regulations and procedures for assessment and evaluation and dissemination of environmental treatment technology to meet the requirements for environmental protection and technical regulations and standards on environment.

- Promoting development and receipt of transfer of new and advanced technologies for prevention and control of pollution, effective and sustainable exploitation and use of natural resources, natural conservation and biodiversity.

- Developing mechanisms and policies to development orientation of high-tech science, advanced and environmentally-friendly technology market.

11. Development of environmental economic sector to support other economic sectors in solving the environmental problems.

- Developing and implementing the Scheme for development of some sectors making environmentally-friendly products and commodities, recycled products, production of energy from waste materials, gradually forming and developing the environmental economic sector in Vietnam, prioritizing the development of some industries and areas of supply of environmentally-friendly products and commodities, recycled products, production of energy from waste materials combined with implementation of demand stimulation packages and consumption promotion of such products.

- Reviewing and recommending amendment and supplementation or issuing new policies and regulations of law on development of environmental services in Vietnam, attaching special importance to development of capacity of environmental service supply, especially waste processing and recycling, solution to environmental processing to ensure the formation of environmental service supply sector which is sufficiently strong to meet the actual requirements.

- Promoting the implementation of Decision No. 249/QD-TTg dated 10 February 2010 of the Prime Minister on approving the “Scheme for development of environmental services by 2020” and Decision No. 1030/QD-TTg dated 20 July 2009 of the Prime Minister on approving the “Scheme for development of environmental industry of Vietnam by 2015 with a vision to 2025”.

12. Strengthening and diversification of investment for environmental protection

- Prioritizing the budget allocation from the capital of development investment for environmental protection; gradually increasing the proportion of allocation for non-business environmental activities at the speed of growth of economy to meet the practical requirements for activities of environmental protection and ensure the proper principles of prevention; studying the supplementation of separate expenditure items for constructional investment of environmental protection projects for the public area specified in the Law on state budget to be submitted to the Government for consideration.

- Developing and implementing the Scheme for resources mobilization for environmental protection activities and model of public - private partnership (PPP).

- Promoting the mobilization of international funding for environmental protection in order to attract and effectively use preferential loans and ODA from international organizations and Government of countries for environmental protection, especially pollution improvement and environmental restoration, natural conservation and biodiversity.

- Innovating mechanism of preferential loan, expanding operational scope and type of support of the Vietnam environmental protection Fund, local environmental protection Fund and sector environmental protection Fund towards creating favorable conditions for enterprise’s access; developing mechanisms to encourage the establishment of supporting fund for initiatives, community-based model, movements and activities of environmental protection for the benefit of society.

- Continuing the socialization of environmental protection activities to promote to a maximum of all social resources for environmental protection, contributing to the improvement of pollution, environment and sustainable development of the country; immediately formulating policies, law and implementing on trial the model of socialization of environmental protection activity for areas to be assessed; approving reports on assessment of environmental impact, making commitment to environmental protection; issuing environmental license

13. International cooperation on environmental pollution

- Making plan for implementing the commitments in the framework of the World Trade Organization (WTO) related to environmental services.

- Properly following the international agreements on environment in which Vietnam is a signing party; actively negotiating and signing new international agreements on environment in order to raise the position of Vietnam in solving global environmental problems; issuing guidelines on contents of environmental protection in negotiation and signing of bilateral and multilateral trade agreements.

- Continuing to promote the comprehensive cooperation with the developed countries in the world and the region in receipt and transfer of new and advanced technologies on pollution prevention and control, waste treatment; focusing on training of high-quality human resources, exchange of specialists in the field of environmental protection, natural conservation and biodiversity.

- Proactively and actively participating with international community in solving problems related to environment; coordinating in development of cooperation mechanism with neighboring countries in the region to deal with border-crossing environmental problems: reduction in greenhouse gas emission; pollution of water source and air; forest exploitation and hydroelectric dams;

III. RESOURCES FOR IMPLEMENTATION

1. The fund for implementing duties of the Plan is mobilized from the following capital sources:

a) Capital from state budget, including: Non-business environmental expenditure, investment development expenditure, non-business science and technology expenditure and ODA;

b) Loan from credit institutions, Vietnam environmental protection Fund and local environmental protection Fund;

c) Investment capital from enterprises;

d) Funding and investment from domestic and international organizations and individuals;

dd) Other legal capital sources.

2. The structure of fund for implementation of Plan is allocated as follows:

a) Non-business environmental expenditure is allocated for implementation of duties with regular nature of state management function; investigating, surveying and developing the prioritized programs, projects and schemes specified in the Annex attached to the Plan; implementing projects with model-building projects with pilot application before replication.

b) Development investment expenditure and ODA are allocated to carry out new constructional projects, upgrading and renovating works of environmental processing and restoration of environmental quality at public facilities under the state responsibility.

c) Non-business science and technology expenditure is allocated to implement the implementation of technological – scientific researches, applying on trial the environmental treatment technology and environmental restoration quality technology before announcement and encouraged application.

d) Enterprises, organizations and individuals are responsible for capital allocation or capital borrowing from credit institutions, Vietnam environmental protection Fund, local environmental protection Fund to carry out projects and duties of environmental protection are the responsibility of such enterprises, organizations and individuals.

dd) Funding is done under agreement with the donor;

e) The implementation of national target program, strategies, action plan and other schemes approved by the Prime Minister shall comply with the provisions of such programs, strategies, plans and schemes.

3. Based on the contents of the Plan and the list of prioritized programs, projects, schemes, the Ministries, sectors and localities shall prepare the estimate of expenditure as per the above fund structure and aggregate it in the annual budget estimate of the Ministries, sectors and localities to be submitted to the competent authorities under the provisions of the Law on state budget and other guiding documents.

IV. MONITORING AND ASSESSMENT

1. The monitoring and assessment of implementation result of Strategy are applied to the Ministries, ministeriorgans, governmental organs and provincial People’s Committee as per the assigned functions and duties.

2. The content of monitoring and assessment is based on the following grounds:

a) Implementation result of targets of Strategy. Based on the quotas of Strategy, the implementation targets shall be allocated to each province and centrally-run city as the ground for monitoring and assessment;

b) Progress of development and implementation of prioritized programs, projects, schemes and duties;

c) Implementation result of contents of Plan.

3. Mechanism of monitoring and assessment:

a) The monitoring and assessment are done annually and integrated with the process of aggregation and assessment of result of duty implementation of sectors and the implementation of social-economic development of localities;

b) The result of monitoring and assessment shall be publicized on mass media and used as criteria for consideration of emulation and commendation and award of sectors and localities.

V. IMPLEMENTATION ORGANIZATION

1. The Prime Minister shall approve in principle 20 programs, plans, schemes and projects at national level prioritized for implementation of basic contents of the Plan (details specified in attached Annex).

2. The Ministry of Natural Resources and Environment is responsible for:

a) Guiding, urging the implementation of Plan; monitoring and assessing the implementation result of strategy, reporting it to the Prime Minister and publicizing it on the mass media.

b) Developing and submitting the regulation on implementation allocation of targets of Strategy to the Prime Minister for promulgation; issuing guidelines on mechanisms of statistics, aggregation and report on monitoring and assessment result of Strategy implementation;

c) Giving direct guidelines on implementation of programs, schemes and projects under its responsibility;

d) Establishing office to monitor, inspect, urge and guide the Plan implementation;

3. The Ministry of Planning and Investment and Ministry of Finance are responsible for:

a) Coordinating with the Ministry of Natural Resources and Environment in guidance, balance and allocation of fund from state budget and other funds to implement the contents of the Plan;

b) Making annual report on the implementation result to the Ministry of Natural Resources and Environment for aggregation and report to the Prime Minister.

4. The Ministries, ministerial organs and governmental organs are responsible for:

a) Developing an annual environmental protection plan under their functions and duties and organizing its implementation based on the contents of the Plan, the list of prioritized programs, schemes and projects of the Plan.

b) Monitoring and assessing the implementation result of the Strategy for the assigned targets.

c) Making annual report to the Ministry of Natural Resources and Environment for aggregation and report to the Prime Minister.

5. The People’s Committee of provinces and centrally­-run cities are responsible for:

a) Developing an annual environmental protection plan of localities and organizing its implementation based on the contents of the Plan and the list of prioritized programs, schemes and projects of the Plan;

b) Implementing the allocated targets for monitoring and assessment of result of environmental protection for aggregation and report to the Ministries and sectors assigned for monitoring and aggregation;

c) Making annual result of implementation to the Ministry of Natural Resources and Environment and the relevant Ministries for aggregation and report to the Prime Minister./.
