DECISION
ON CARRYING CASH IN FOREIGN CURRENCY AND VIETNAMESE DONG UPON ENTRY INTO AND EXIT FROM THE COUNTRY
THE GOVERNOR OF THE STATE BANK
Pursuant to the Decree No.15/CP dated 2 March, 1993 of the Government providing for the assignment, authority and responsibility for State management of the Ministries and ministry-level agencies.
Pursuant to the Decree No. 63/1998/ND-CP dated 17 August, 1998 of the Government on the foreign exchange control.
Upon proposal of the Director of the foreign exchange control department.
DECIDES
Article 1.
Residents and Non-residents being individuals (hereinafter called individuals) when entering and exiting the Vietnam checking points carrying cash in foreign currency (including bank notes, coins and traveller checks) and Vietnamese Dong shall declare to the Custom office at the checking points if the amount is beyond the limits stipulated as follows:
a. US$ 3,000 (three thousands United States dollars) or other currencies of the same value;
b. VND 5,000,000 (five million Vietnamese Dong);
c. Individuals carrying cash up to the above-mentioned value are not subject to declaration to the custom office at the checking points.
The limits on carrying cash in foreign currency and Vietnamese Dong which are subject to custom declaration shall not be applied to individuals carrying payment instruments and other valuable papers denominated in foreign currency or in Vietnamese Dong such as credit cards, payment cards, savings books, securities certificates. . . .
The limit on the value in foreign currency and Vietnamese Dong of payment instruments and other valuable papers not being cash which can be carried through the checking points shall be provided for in the Circular guiding the implementation of the Decree No. 63/1998/ND-CP dated 17, August, 1998 of the Government on foreign exchange control.
If individuals who have carried cash in foreign currency into Vietnam are required to surrender this foreign currency to foreign currency accounts opened with authorised banks operating in Vietnam, they need to have a certification by the custom office at the checking point on the custom declaration for the amount of foreign currency in cash they have actually carried into the country. The custom declaration certified by the custom office at the checking point shall be the document for authorised banks to accept the foreign currency deposit.
Article 2.
Individuals who carry cash in foreign currency and Vietnamese Dong with value beyond the limit provided for in the Article 1 of this Decision or more than the value carried into the country which has been declared to the custom office shall have a permit issued by the State Bank or by authorised banks when they exit from the country.
Individuals carrying cash in foreign currency and Vietnamese Dong beyond the limit provided for in Article 1 but not more than the value declared upon immigration shall have to present the custom declaration and do not require a permit from banks when they exit from the country
The issuance of permits to individuals to carry cash in foreign currency and Vietnamese Dong when they exit from the country shall be implemented in accordance with provisions of the State Bank on the authorisation to issue permits for carrying cash in foreign currency and Vietnamese Dong.
Article 3.
This Decision shall be effective from the date of signing and replaces the Decision No 382/QD-NH7 dated 28 December, 1995 of the Governor of the State Bank.
The provisions of this document shall be applied to all individuals when entering and exiting the check points of Vietnam with passports issued by the competent authority of Vietnam or by foreign countries. The carrying of cash in foreign currency and Vietnamese Dong by individuals when entering and exiting the border check points with the border identifications or border transportation permits issued by competent authority of Vietnam and of bordering countries shall be implemented in accordance with separate provisions.
Article 4.
Head of Governor Office, Director of Foreign Exchange Control Department, Heads of relevant departments at the State Bank head office, General Managers of State Bank branches in the provinces and cities and Directors General (Directors) of authorised banks shall be responsible for the enforcement of this Decision.
