DECISION
SUBJECT: ESTABLISHMENT OF DAMS SAFETY UNIT (DSU) UNDER THE WATER RESOURCES DEPARTMENT.
MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 86/2003/ND-CP dated 18/7/2003 of the Government stipulating functions, duties, rights and organization structure of Ministry of Agriculture & Rural Development (MARD).
Pursuant to Development Credit Agreement for Project for Supporting Vietnam’s Water Resources Development signed on 19/8/2004 between The Socialist Republic of Vietnam and the International Development Association.
Pursuant to Decision No. 93/2003/QD dated 4/9/2003 issued by the Minister of MARD stipulating functions, duties, rights and structure of the Water Resources Department.
In consideration of request made by Central Water Resources Project Management Unit in the letter ref. 1484/DATL-VWRAP dated 7/11/2005 requesting approval on duties, guidelines and structure of DSU in Project for Supporting Vietnam’s Water Resources Development.
In accordance with request made by General Director of Water Resource Department (submission letter ref 91/TL dated 16/11/2005) and General Director of Personnel & Organization Dept.,
HEREBY DECIDES
Article 1: To establish the Dams Safety Unit under the Water Resources Department.
DSU is a professional agency under the Water Resources Department responsible for supervising investigation of dam safety, constructing and managing implementation of legal framework related to dam construction and management, supporting building of capacity for management agencies, operating and investigating dams, and popularizing information about dams in Vietnam.
Article 2: Duties of DSU
1. Organize implementation and supervise investigation on dams safety.
2. Compose legal documents and related papers about dams safety for submission to authorized levels for issuance.
3. Take part in training for enhancement of capacity of reservoir’s owners and staff in charge of superintending dams safety.
4. Collect, file data of reservoirs.
5. Instruct localities in deploying safety for small reservoirs.
6. Popularize information and raise awareness about safety of dams and reservoirs.
Article 3: DSU has a Head, Deputy Head, staff and experts to be allocated and recruited as per prevailing regulations of the State.
General Director of Water Resource Department is responsible for establishment and promulgation of Working Regulations for DSU and for organization of implementation after the Decision takes effective.
Article 4: This Decision takes effective 15 days from the date of signature.
Article 5: Chief of MARD Office, General Director of Personnel & Organization Department, General Director of Water Resources Department, leaders of related agencies in MARD are responsible for implementing this Decision.
