DECISION

ESTABLISHMENT OF NATIONAL STEERING COMMITTEE FOR FIGHTING AGAINST SMUGGLING, COMMERCIAL FRAUDS AND COUNTERFEIT GOODS

THE PRIME MINISTER

Pursuant to the Law on organization of Government dated December 25, 2001;

Pursuant to Decision No. 34/2007 / QD-TTg dated March 12, 2007 of the Prime Minister promulgating the Regulation on the establishment, organization and operation of the inter-sector coordination bodies;

At the request of the Minister of Industry and Trade, the Minister of Finance and the opinions of the relevant agencies,,

DECIDES:

Article 1. Establishment of National Steering Committee for fighting against smuggling, commercial frauds and counterfeit goods (hereafter referred to as National Steering Committee). The Committee composition consists of:

1. Head: Deputy Prime Minister Nguyen Xuan Phuc.

2. Standing Deputy Head: Minister of Finance

3. Deputy Heads:

- Minister of Industry and Trade;

- Deputy Minister of Defense;

- Deputy Minister of Public Security.

4. Members:

- Deputy Minister of the Ministries, ministerial agencies: Finance, Agriculture and Rural Development, Health; Transport, Science and Technology, Culture, Sports and Tourism, Information and Communications; Government Office;

- Vice Chairman of Central Committee of Vietnam Fatherland Front;

- Deputy General Director of Vietnam Television;

- Heads of relevant agencies: Commander of the Border Guard; Commander of the Coast Guard; Director of General Police Department for Crime Prevention and Suppression; Director of General Department of Customs; Director of General Department of Taxation; Director of Market Surveillance Agency.

5. Assisting the Head of Committee and the National Steering Committee is the Standing Office located in the Ministry of Finance. The organization and operation of the Standing Office will be decided by the Head of Committee at the request of the Standing Deputy Head of Committee.

Article 2. The National Steering Committee has the following duties and powers:

1.Developing strategies and plans for fighting against smuggling, commercial frauds and counterfeit goods in each period. Directing, inspecting, urging and guiding the Ministries, sectors and localities to implement the combat against smuggling, commercial fraud and counterfeit goods.

2. Directing the coordination between agencies and functional forces to detect, fight, prevent and deal with acts of organized smuggling, commercial frauds and counterfeit goods.

3. Directing the Ministries, sectors and localities to amend, supplement or request the competent level to amend or supplement the relevant legal normative documents in order to raise the effective fight against smuggling, commercial frauds and counterfeit goods.

4. Establishing inter-sector teams to inspect the handling of significant cases of smuggling, commercial frauds and counterfeit goods in some key areas.

5. Implementation of international cooperation in the field of smuggling, commercial frauds and counterfeit goods.

6. Recommending commendation to the collectives and individuals obtaining excellent achievement in the fight against smuggling, commercial frauds and counterfeit goods. Directing the handling of collectives and individuals with signs of shielding, abetting and joining hands with the smuggling, commercial frauds and counterfeit goods.

7. Periodically conducting the review and evaluation of work and according to special theme for report to the Prime Minister.

8. Coordinating with Vietnam Television and press and news agencies to develop programs and plans for propagation against the smuggling, commercial frauds and counterfeit goods.

9. Carrying out other duties assigned by the Prime Minister.

Article 3. Working regulations of the National Steering Committee:

1. The operation regulations of the National Steering Committee and the Standing Office of National Steering Committee will be decided at the request of the Standing Deputy Head of Committee.

2. The members of the National Steering Committee will work on a part-time basis.

3. The Head of Committee will use the seal of the Prime Minister and the Deputy Heads will use the seal of the Ministry where they work.

Article 4. People’s Committee of provinces and centrally-affiliated cities will establish the local Steering Committee to fight against the smuggling, commercial frauds and counterfeit goods with the Deputy Chairman as the Head of Committee with appropriate composition to ensure the effective operation.

Article 5. The operating fund of the National Steering Committee will be paid by the state budget and allocated in the permanent operating fund of the Ministry of Finance, the supporting capital sources and other funds under regulation of law. The People’s Committee of provinces and centrally-affiliated cities will ensure the operating fund of the local Steering Committee to fight against the smuggling, commercial frauds and counterfeit goods.

Article 6. This Decision will take effect from the date of its signing and replaces Decisions: Decision No. 127/2001 / QD-TTg dated August 27, 2001 and Decision No. 28/2008 / QD-TTg dated February 14, 2008 of the Prime Minister; the previous provisions contrary to this Decision are hereby repealed.

Article 7. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, Chairman of People's Committee of provinces and centrally-affiliated cities and members of the National Steering Committee for fighting against smuggling, commercial frauds and counterfeit goods, heads of agencies and organizations concerned are liable to execute this Decision. /.
