DECISION

ISSUING REGULATION ON ENSURING THE SECURITY AND SAFETY FOR CAM RANH MILITARY BASE

Pursuant to the Law on Organization of Government dated 25/12/2001;

Pursuant to the Law on issue of legal normative documents dated 03/06/2008;

Pursuant to the Law of the Sea of Vietnam dated 21/06/2012;

Pursuant to the Law on National Security dated 03/12/2004;

Pursuant to the Law on National Border dated 17/06/2003;

Pursuant to the Vietnam Maritime Code dated 14/6/2005;

Pursuant to the Ordinance on protection of national works and military zones dated 19/5/1994;

Pursuant to the Decree No. 04/CP dated 16/01/1995 of the Government concerning the regulation on protection of national works and military zones

Pursuant to the Decree No. 161/2003/ND-CP dated 18/12/2003 of the Government on regulation on maritime border areas;

Pursuant to the Decree No. 50/2008/ND-CP dated 21/4/2008 of the Government on management, security and order at seaport border gates;

Pursuant to the Decree No. 33/2002/ND-CP dated 28/03/2002 of the Government detailing the implementation of Ordinance on the Protection of State Secrets;

Pursuant to the Decree No. 21/2012/ND-CP dated 21/3/2012 of the Government on management of sea port and navigable channels;

Pursuant to the Decree No. 104/2012/ND-CP dated 05/12/2012 of the Government on foreign ships arriving in the Socialist Republic of Vietnam;

Pursuant to the Decree No. 94/2007/ND-CP dated 04/06/2007 of the Government on management of flight activities;

At the request of the Minister of Defense,

The Prime Minister decides to issue the Regulation on ensuring the security and safety for Cam Ranh military Base.

Article 1. Issued with this Decision the Regulation on ensuring the security and safety for Cam Ranh military Base.

Article 2. This Decision takes effect from 06/11/2015;

Article 3. The Ministers of Defense; Public Security; Transport; Foreign Affairs; Natural Resources and Environment; Agriculture and Rural Development; Chairman of the People's Committee of Khanh Hoa and Ninh Thuan provinces; the relevant ministries, branches, localities and bodies, organizations and individuals are liable to execute this Decision. /.

REGULATION

ON ENSURING THE SECURITY AND SAFETY FOR CAM RANH MILITARY BASE
 (Issued with Decision No. 44/2015/QD-TTg dated 22/9/2015 of the Prime Minister)

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation

This Regulation stipulates:

1. Range of restricted area, security area and safety belt of Cam Ranh military Base (hereafter referred to as Base).

2. Management of people and kinds of vehicle of Vietnam and foreign countries entering, leaving and operating within the Base to ensure the security and safety for Cam Ranh military Base.

Article 2. Subjects of application

1. This Regulation applied to all relevant bodies, organizations and individuals and kinds of vehicles entering, leaving and operating or staying within Cam Ranh military Base.

2. Where between the Socialist Republic of Vietnam and other countries that have people and vehicles entering, leaving or operating within the Base and have international Agreements whose provisions are different from those of this Regulation, the provisions of the international Agreements shall apply.

3. The areas for joint venture and association for economic services within the Base shall apply their separate regulations.

Article 3. Interpretation of terms

In this Regulation, the terms below are construed as follows:

1. Cam Ranh military Base: Is the military zone of grade 1 which is strictly managed with restricted area, security area and safety belt.

a) Restricted area is set up to strictly protect, manage and control activities of people and vehicles in order to maintain order and security and prevent and fight against the acts of infiltration, sabotage and collection of State secrets. The restricted area consists of land and air areas.

b) Security area is the waters set up to manage and control people and vehicles and other activities in order to ensure the security and safety for the Base.

c) Safety belt is set up to manage and control some activities to ensure the security and safety for the Base. The safety belt consists of land and air areas.

d) Waters of safety belt are the water bodies within the range of safety belt specified in Article 8 of this Regulation including the greatest tide.

2. Base airspace is the airspace over the restricted land areas and waters which are limited high from land and water surface upward.

3. Security and safety assurance of airspace of the Base is the overall measures of airspace management bodies and management and operation bodies of military flight and civil aviation in order to closely manage and ensure the safety for flight activities in the airspace of the Base.

4. Port authorities of the Base is the body directly manage the navigation, order and security within the restricted waters.

5. Abbreviated words are understood such as: NC: Restricted waters, BV: Security, VD: Safety belt, HL: Training.

Article 4. Principles of security and safety assurance

1. The people and vehicles entering, leaving and operating in the restricted areas must be permitted and be under control and monitoring of the competent authorities.

2. Compliance and strict implementation of regulations on garrison, watch of State secrets, plans for defense, operation and defense of the Base, plans for prevention and control of natural disaster, disaster incident, fire, rescue and salvage.

3. Proactive precluding, detection, prevention and timely and effective handling of circumstances and acts of threatening infiltration of security and safety of the Base.

4. Close coordination between forces according to the functions and duties of the ministries, sectors and localities.

Article 5. Violation handling

All bodies, organizations and individuals having acts of violation of provisions of this Regulation, depending on their nature and seriousness, shall be disciplined, administratively handled or prosecuted for criminal liability and must make compensation as stipulated by law.

Chapter II

PROVISIONS ON RANGE OF SECURITY AND SAFETY ASSURANCE FOR THE BASE

Article 6. Range of restricted area

1. Range of restricted land area: The boundary is limited by the protective fence system from point NC14 to point NC1.

From point NC1 along the road of Cam Ranh bay to the South of peninsula passing Hon Luong cape, along the road of Binh Ba bay to point NC9, along the coastal road to the North passing Lo Gio cape and connected to point NC14.

2. Arrange of restricted waters:

a) Boundary towards the peninsula: From point NC1 along the road of Cam Ranh bay to the South of peninsula passing Hon Luong cape, along the road of Binh Ba bay to point NC9, along the coastal road to the North passing Lo Gio cape and connected to point NC14.

b) Boundary towards Cam Ranh and Binh Ba bays and sea is limited by the lines connected with the points in order of NC1, NC2, NC3, NC4, NC5, NC6, NC7, NC8, NC9, NC10, NC11, NC12, NC13 and connected with Point NC14.

Article 7. Range of security area

1. Range of area 1 is from the boundary outside the restricted waters outwards 400 m. The outer boundary is restricted by the lines connected with the points in order of NC2, BV1, BV2, BV3, BV4, BV5, BV6, BV7, BV8 and connected with point NC9.

2. Range of area 2: The boundary is restricted by the lines connected to the points in order of NC10, BV9, BV10, BV11, BV12, NC13, NC12, NC11 and connected with point NC10.

Article 8. Range of safety belt

The boundary is limited by the lines connected with the points in order of NC14, VD1, VD2 and VD3.

- From point VD3 and starting along the national way 01 to the South to point VD4.

- From point VD4 limited by the lines connected with the points in order of VD4, VD5, VD6, VD7, VD8, VD9, BV9, NC10, NC9, BV8, BV7, BV6, BV5, BV4, BV3, BV2, BV1, NC2 and NC1.

- From point NC1 to point NC14, the boundary is limited by the protective fence system.

Article 9. Range of waters of Eastern Cam Ranh airport

It is determined for the military airway vehicle to carry out the training and be ready to fight. The boundary is limited by the lines connected to the points in order HL1, HL2, HL3, HL4 and connected to the point HL1.

Article 10. Coordinate of points

The boundary of restricted areas, security areas, safety belt and the waters of Eastern Cam Ranh airport is determined on the map with scale 1:140 000. The coordinate of points are specified in Appendix I issued with this Regulation.

Chapter III

ENSURING SECURITY AND SAFETY FOR WATERS, AIRSPACE AND LAND AREA OF THE BASE

Section 1: ENSURING SECURITY AND SAFETY OF WATERS OF THE BASE

Article 11. Body managing the restricted waters

1. The Military Zone 4's Naval Command (Port authorities of the Base) is the body in charge and coordinate with the Command of Border Guard of Khanh Hoa province in management and operation of people and kinds of vehicle within the restricted waters.

2. The Port Authorities of the Base shall be decided by the Minister of Defense.

3. Duties and power of the Port Authorities of the Base:

a) Arrange for ships to go in and out of ports and anchor and moor safely and at prescribed place.

b) Guide and ensure the compliance with regulations on maritime activities, maritime security, fire prevention and fighting, prevention of environmental pollution and management of all maritime activities of ships entering, leaving ports.

c) Ensure the safety and order in ports, check the port entry and exit permit of people and vehicle which the competent authorities have issued;

d) Meet the needs of electricity and water and guide the procedures for receiving fuel, food, materials, technical equipment and other procedures stipulated by law.

dd) Coordinate with the competent authorities of the State and the Border guard to perform the entry, exit, customs, tax, sanitation and quarantine procedures for ships leaving from port to foreign countries or vice versa based on the regulations of law.

e) Check certificates of ships and professional certificates of captain, officers and crew. If these certificates are deemed invalid, they shall be seized with record and transferred to the competent authorities for handling.

Inspect and monitor the compliance with regulations on maritime safety, traffic order, sanitation, environmental pollution protection and fire prevention and fighting of vehicle and equipment of works in the restricted waters; suspend the operation of vehicle and people on these vehicles if they are not safe; deal with cases of regulation violation and accidents in the restricted waters according to regulations of law.

g) Take necessary measures including the seizure of vehicle to ensure the maritime safety, traffic order, sanitation, environmental pollution protection and rescue in the restricted waters according to regulations of law.

h) Perform other relevant duties and functions according to regulations of law.

Article 12. Vietnamese military ships entering and leaving restricted waters

The Vietnamese military ships entering and leaving restricted waters shall comply with the regulations of the Ministry of Defense.

Article 13. Foreign military ships entering and leaving restricted waters

The foreign military ships entering and leaving restricted waters shall comply with the provisions in Decree No. 104/2012/ND-CP dated 5/12/2012 of the Government on foreign military ships entering the Socialist Republic of Vietnam (hereafter referred to as 104/2012/ND-CP) or comply with the international agreements in which Vietnam is a member.

Article 14. Issue permit to the Vietnamese civil ships entering and operating in the restricted area

1. The Commander of naval military Zone 4 has authority to issue permit to the Vietnamese civil ships entering and operating in the restricted area.

2. Dossier for issue of permit

a) Request for issue of permit to the ships for operating in the restricted waters under the Form 01 issued with this Regulation.

b) Ship arrival Declaration under Form 03 issued with this Regulation.

c) A copy of certificate of ship registration.

d) A copy of Certificate of maritime safety, maritime security and prevention of environmental pollution.

3. Order and procedures for permit issue

a) Within 20 (twenty) days prior to the expected date of arrival to operate in the restricted area, the person going through the procedures shall prepare dossier according to the provisions in Paragraph 2 of this Article and send it directly or by post to the Military Zone 4's Naval Command (Staff Division).

b) Within 10 (ten) working days after receiving the valid dossier, the Military Zone 4's Naval Command (Staff Division) shall verify and submit it to the Commander of naval military Zone 4 for signing under the Form 04 issued with this Regulation and sent directly to the person going through the procedures.

4. In addition to the provisions in Paragraphs 1, 2 and 3 of this Article, the Vietnamese civil ships entering the restricted waters to operate shall have to go through the procedures for entering and leaving sea ports according to the provisions in Decree No. 21/2012/ND-CP dated 21/3/2012 of the Government on management of sea ports and navigable channels (hereafter referred to as Decree No. 21/2012/ND-CP) and other relevant regulations of Vietnamese laws.

Article 15. Issue permit to the foreign civil ships entering and operating in the restricted area

1. The Chief of General Staff has authority to issue permit to the foreign civil ships entering and operating in the restricted area.

a) Request for issue of permit to the ships for operating in the restricted waters under the Form 02 issued with this Regulation.

b) Ship arrival declaration under the Form 03 issued with this Regulation.

c) A copy of certificate of ship registration.

d) A copy of Certificate of maritime safety, maritime security and prevention of environmental pollution.

3. Order and procedures for permit issue

a) Within 20 (twenty) days prior to the expected date of arrival to operate in the restricted area, the person going through the procedures shall prepare dossier according to the provisions in Paragraph 2 of this Article and send it directly or by post to the General Staff (Department of Operations).

b) Within 20 (ten) working days after receiving the valid dossier, the Department of Operations / General Staff shall verify and submit it to the Chief of General Staff for signing under the Form 04 issued with this Regulation and sent directly to the person going through the procedures.

4. In addition to the provisions in Paragraphs 1, 2 and 3 of this Article, the foreign civil ships entering the restricted waters to operate shall have to go through the procedures for entering and leaving sea ports according to the provisions in Decree No. 21/2012/ND-CP dated 21/3/2012 and Decree No. 50/2008/ND-CP dated 21/4//2008 of the Government on management of sea ports and navigable channels (hereafter referred to as Decree No. 50/2008/ND-CP) and other relevant regulations of Vietnamese laws.

Article 16. Provisions on maritime pilotage for the Base

1. Regulation on compulsory pilotage:

a) Foreign ships must use the maritime pilotage services when entering and leaving the restricted waters or moving in restricted waters and other relevant regulations of Vietnamese laws.

b) .The Vietnamese civil ships shall comply with the provisions in Article 64 of the Decree No. 21/2012/ND-CP.

2. Provision of maritime services

a) The provision of maritime pilotage services to the Base is assigned to the maritime pilotage organization.

b) The other regulations on provision of maritime pilotage services shall comply with the provisions in Article 65 of the Decree No. 21/2012/ND-CP and other relevant regulations of Vietnamese laws.

3. The responsibility of maritime pilot shall comply with the provisions in Article 66 of the Decree No. 21/2012/ND-CP and other relevant regulations of Vietnamese laws.

Article 17. Provisions on flag flying of ships in restricted waters

The flag flying of ships in restricted waters when operating in the restricted waters shall comply with the provisions in Article 75 of the Decree No. 21/2012/ND-CP and Paragraph 5, Article 4 of the Decree No. 104/2012/ND-CP.

Article 18. Management over people and ships in restricted waters

The management over people and ships in restricted waters shall comply with the provisions in Articles 67, 68, 69, 70, 71 and 72 of the Decree No. 21/2012/ND-CP; Articles 16, 17, 18, 19, 20 and 21 of the Decree No. 50/2008/ND-CP; Articles 16, 17, 19 and 20 of the Decree No. 161/2003/ND-CP dated 18/12/2003 of the Government concerning the regulation on sea border area (hereafter referred to as the Decree No. 161/2003/ND-CP) and other relevant regulations of Vietnamese laws.

Article 19. Search, rescue and handling of maritime accidents in restricted waters

The port authorities of the Base shall take charge and coordinate with the Nha Trang port authorities to deal with the search, rescue and handling of maritime accidents in restricted waters according to the provisions in Articles 73 and 74 of the Decree No. 21/2012/ND-CP and other relevant regulations of Vietnamese laws.

Article 20. Ensuring the maritime security and safety, order and sanitation in the restricted area

1. Ensuring the maritime security and safety, order and sanitation in the restricted area shall comply with the provisions in Articles 76, 77, 78 and 81 of the Decree No. 21/2012/ND-CP and other relevant regulations of Vietnamese laws.

2. When accident occurs on ships, the captain must notify the port authorities of the Base immediately for coordinated handling.

Article 21. Fire prevention and prevention and response to environmental incidents in restricted waters

1. The fire prevention and prevention and response to environmental incidents in restricted waters shall comply with the provisions in Articles 83, 84, 85, 86 and 87 of the Decree No. 21/2012/ND-CP and other relevant regulations of Vietnamese laws.

2. When incident or accident occurs related to the oil pumping or loading or unloading of other dangerous goods and when the risks or acts of causing environmental pollution are detected, the captain must notify the port authorities of the Base immediately for coordinated handling.

Article 22. Management over activities of people and ships in the waters of protection security area and safety belt of the Base

1. When operating in the waters of protection security area and safety belt, the people and ships of Vietnam and foreign countries must comply with the provisions of the Decree No. 161/2003/ND-CP and other relevant regulations of Vietnamese laws.

2. In the waters of security area, all ships must move continuously without stopping or mooring except for unforeseen incidents, accident or for the purpose of helping people and ships in distress.

Where the ships have accidents or incidents, the captain must take all appropriate measures to ensure the safety for their people and ships and other ships and must notify immediately the Nha Trang port authorities and port authorities of the Base via VHF on channel 16 or by other means of communication while taking all appropriate measures to move the ship out of the waters of security area as quickly as possible.

3. In case of necessary restriction of maritime activities in a certain area in the waters of security area and safety belt, the Military Zone 4's Naval Command must notify immediately the Command of Border Guard of provinces of Khanh Hoa and Ninh Thuan, Nha Trang port authorities and People’s Committee of provinces of Khanh Hoa and Ninh Thuan to direct the competent authorities for coordinated implementation.

Section 2: ENSURING THE SECURITY AND SAFETY OF AIRSPACE OF THE BASE

Article 23. Exploitation and use of airspace of the Base

1. The airspace of the Base lies in the airspace of management and operation of flight activities of Cam Ranh International Airport according to the “Regulation on flight in area of Cam Ranh airport”. Based on the flight permit notified, the body managing the military and civil flights must manage and operate the flight activities in the responsible area closely and safely and promptly detect the violation of flight principles and regulations and notify the airspace management bodies and headquarter of relevant units to deal with the situation of airspace infiltration by the laws of Vietnam.

2. The flight activities on the airspace of the Base are manned aircrafts, unmanned aircrafts and ultralight aerial vehicles whose flights must be monitored and managed by the bodies managing the civil and military flights in the area; must comply with the provisions of the Decree No. 94/2007/ND-CP dated 04/06/2007 of the Government on management of flight activities; Decree No. 36/2008/ND-CP dated 28/3/2008 of the Government on management of unmanned aircraft and ultralight aerial vehicles Decree No. 79/2011/ND-CP dated 05/09/2011 of the Government on amending and adding some articles of the Decree No. 36/2008/ND-CP  dated 28/3/2008 of the Government on management of unmanned aircraft and ultralight aerial vehicles and the Decree No. 58/2010/ND-CP dated 01/06/2010 of the Government detailing and guiding the implementation of some articles of the Law on Militia and Self-Defense Forces.

3. The flight activities in the areas of Cam Ranh airport include the flight activities on the airspace of the Base must be coordinated, commanded and operated at a uniform commanding station to ensure the bodies and units shall use the airspace effectively and safely for their relevant flight activities.

Article 24. Management of height of obstacles

When building works within the areas of the Base, the units must comply with the provisions of Decree No. 20/2009/ND-CP dated 23/2/2009 of the Government on management of height of aviation obstacles and battlefield to manage and protect the airspace in Vietnam.

Section 3: ENSURING SECURITY AND SAFETY OF RESTRICTED LAND AREA

Article 25. Body managing the restricted land area

The Military Zone 4's Naval Command is the body which takes charge and coordinate with the relevant sectors and local government in direction, management and operation to ensure the security and safety of the restricted land area.

Article 26. Activities of people and vehicle of Vietnam in the restricted land area

1. The servicemen and military vehicle of Vietnam shall comply with the regulations of the Naval Military Zone 4.

2. For people and civil vehicle of Vietnam entering the restricted land area to operate.

a) Dossier for issue of permit

- Request for issue of permit to people and civil vehicle of Vietnam entering the restricted land area to operate under the Form 05 and 06 issued with this Regulation;

- A copy of ID card and Certificate of vehicle registration;

- A list under the Form 07 and 08 issued with this Regulation.

b) Settlement order and procedures for people and vehicles of Vietnam to enter the restricted land area to operate

- Within 04 (four) days prior to the expected date of entry into the restricted land area for operation of people and vehicle, the person going through the procedures shall prepare a dossier as stipulated under Point a of this Paragraph and send it directly to the Military Zone 4's Naval Command (Staff Division).

- Within 03 (three) working days, from the date of receiving the valid dossier, the Military Zone 4's Naval Command (Staff Division) shall verify and submit it to the Chief of Staff for signing the entry and exit permit under the Form 09 issued with this Regulation and send it directly to the person going through the procedures.

3. For the seamen going ashore upon mooring in the restricted water

For the seamen going ashore upon mooring in the restricted water, they have to use their ID card and seaman’s Book in lieu of entry and exit Permit.

4. Provisions for people and vehicles operating in the Base

When permitted to enter the restricted land area, the people and vehicle must bring their entry and exit Permit, personal papers, certificate of vehicle registration; go through the checking procedures at the control station before entering the restricted land area and present papers upon required by the security forces of the Base; only carry out the contents of work approved and comply with the instructions of the security forces of the Base; register personal belongings to be brought in with the security forces, follow the prescribed line, area and speed upon entry and exit the restricted land area; comply with the provisions of this Regulation and other relevant regulations of Vietnamese laws.

Article 27.  Activities of foreigners and Vietnamese people settled in foreign countries and the Vietnamese people working for foreign organizations or individuals in the restricted land area

1. For foreigners and Vietnamese people settled in foreign countries entering the restricted land area to work

a) Dossier for issue of permit

- A written request for issue of permit to the foreigners and Vietnamese people settled in foreign countries (hereafter referred to as foreigners) entering the restricted land area to work under the Form 10 issued with this Regulation;

- A photo of Passport;

- A list under the Form 11 issued with this Regulation;

b) Settlement order and procedures for foreigners entering the restricted land area to work

- Within 07 (seven) days prior to the expected date the foreigners enter the restricted land area to work, the bodies or units in charge of bringing people into the restricted land area to work shall prepare 01 dosser as stipulated in Paragraph 1 of this Article and send it directly to the Department of Operations and Department of Army Protection and Security.

- Within 04 (four) working day after receiving the valid dosser, the Department of Operations and the Department of Army Protection and Security shall verify and answer in writing under the Form 12 and 13 issued with this Regulation and it directly to the body and unit or organization which bring people into the restricted land area to work.

2. For Vietnamese people working for foreign organizations or individuals and entering the restricted land area to work.

a) Dossier for issue of permit

- A written request for issue of permit to the Vietnamese working foreign organizations or individuals and entering the restricted land area to work is prepare under the Form 14 issued with this Regulation;

- A photo of ID card;

- A list under Form 15 issued with this Regulation;

b) Settlement order and procedures for Vietnamese working foreign organizations or individuals and entering the restricted land area to work.

- Within 07 (seven) days prior to the expected date the Vietnamese working foreign organizations or individuals and entering the restricted land area to work, the bodies and units in charge of bringing people into the restricted land area to work shall prepare a dossier as stipulated under Point a of this Paragraph and send it directly to the Department of Army Protection and Security.

- Within 04 (four) working days after receiving the valid dossier, the Department of Army Protection and Security shall verify and reply in writing under the Form 13 issued with this Regulation and send it directly to the bodies or units which bring people into the restricted land area to work.

3. For the seamen going ashore upon mooring in the restricted water

For the seamen going ashore upon mooring in the restricted water, they have to use their Passport or landing card issue by the Guard of Port Border Gate according to Vietnamese regulations of law in lieu of the entry and exit Permit.

4. Regulations towards people operating in the Base.

Comply with the provisions in Paragraph 4, Article 26 of this Regulation.

Article 28. Secret protection

1. The foreign and domestic bodies, units, organizations and individuals going on business or working in the Base must strictly comply with the laws of Vietnam on protection of state secrets or military secrets.

2. Not intentionally collect information and propagate on the mass media the organization, staff, functions and duties of units; features, techniques and tactics of types of weapon, technical equipment and facilities; reality of duty performance of soldiers; projects related to the improvement of capacity of management and protection of sovereignty over sea and islands and the development and security projects for the Base. In case of necessary provision of information, there must be the approval from the Ministry of Defense.

Article 29. Organization of security forces

Establish the units in charge of management and protection of works of national defense and military area in the Base; organize staff and equipment in line with the requirements for duties. The establishment of responsible units shall be decided by the Ministry of Defense.

Chapter IV

RESPONSIBILITY OF MINISTRIES, SECTORS AND LOCALITIES

Article 30. Ministry of Defense

1. Takes charge and coordinate with the Ministries, sectors and People’s Committee of provinces of Khanh Hoa and Ninh Thuan to ensure the security and safety for the Base; take responsibility before the Government and the Prime Minister for the effective security and safety for the Base.

2. Directs the competent authorities to provide information and coordinate with the specialized units of the Ministry of Public Security to develop and implement the plans for prevention and stop of intelligence gathering and sabotage of hostile forces to ensure the security and safety for the Base.

3. Directs the bodies and units to take charge and coordinate with the police and local authorities to develop the security units associated with the security areas in all aspects of security, politics, secret protection and propagation to local people to raise their sense of vigilance and sense of responsibility in protecting the Base.

4. Takes charge and coordinate with the Ministry of Transport, Ministry of Agriculture and Rural Development, the People's Committee of Khanh Hoa province to effectively exploit and use the airspace of Cam Ranh airport and waters in Cam Ranh bay on the basis of social – economic development and national defense and security assurance.

5. Directs the naval forces to take charge and coordinate with the Vietnam Maritime Administration / Ministry of Transport to develop the coordination regulation in management, permit issue and procedure performance for ships entering and leaving the Base; carry out the search, rescue and handling of maritime accidents; ensure the maritime security and safety and prevention of maritime environmental pollution.

6. Direct the naval forces and border guard to take charge and coordinate with the police bodies of provinces of Khanh Hoa and Ninh Thuan to patrol, control and monitor the activities of people and vehicles operating within the safety belt of the Base.

7. Coordinate with the People’s Committee of provinces of Khanh Hoa and Ninh Thuan to review the projects with prioritized investment and development of social – economic infrastructure for localities within the area of safety belt of the Base.

8. On the annual basis, takes charge and coordinate with the relevant ministries, sectors and localities to hold meetings to assess the reality of implementation of Regulation on ensuring the security and safety for the Base and provide advice to the Prime Minister to issue the solutions in a timely manner to ensure the security and safety for the Base.

Article 31. Ministry of Public Security

1. Directs the specializes Departments and police bodies of provinces of Khanh Hoa and Ninh Thuan to closely coordinate with the naval forces and border guard to regularly grasp the situation of politic security, social safety and order of the areas of safety belt and promptly exchange information related to the security and safety for the Base while promptly handling complex situations related to the security which can occur in the areas in line with the laws.

2. Directs to strengthen the staff activities and guide the bodies, organizations and enterprises to enhance the propagation and raise the sense of responsibility for people in fulfilling their obligations to protect the security, order; actively participate in developing the mass movement of national security contributing to the security and safety assurance for the Base.

3. 4. Bộ Công an phối hợp với Bộ Quốc phòng thẩm tra, xác minh làm rõ những dấu hiệu nghi vấn của các cá nhân, tổ chức Việt Nam và nước ngoài cư trú, làm việc bên trong và bên ngoài Căn cứ, có quan hệ, giao dịch liên quan đến an ninh, an toàn Căn cứ để có biện pháp xử lý kịp thời.

Article 32. Ministry of Transport

1. Takes charge and coordinate with the Ministry of Defense to issue the flight permit to the civil aviation flights in the airspace of the Base areas; takes responsibility for management and operation of civil flight activities within the responsible airspace of Cam Ranh airport; announces the flights according to regulations.

2. Directs the Vietnam Maritime Administration to coordinate with the naval forces to develop the coordination regulation in management, permit issue and carry out the procedures for ships to enter and leave the Base; carry out the search, rescue and handling of maritime accidents; ensure the maritime safety and security and prevention of maritime environmental pollution.

3. Directs the subordinate bodies and departments to closely coordinate with the bodies and units of the Ministry of Defense and localities in ensuring the security and safety for the Base; carry out the propagation to all organizations, individuals, enterprises and vehicle owner to seriously comply with the provisions of this Regulation.

Article 33. Ministry of Foreign Affairs

Coordinate with the Ministry of Defense and other relevant ministries and sectors to deal with the foreign issues when there are foreign forces and vehicles visiting the Base; carries out the propagation and dissemination to the vehicle owners to strictly comply with the regulations on security and safety at the Base.

Article 34. The Ministry of Agriculture and Rural Development

Takes charge and coordinate with the Ministry of Defense and the People’s Committees of provinces of Khanh Hoa and Ninh Thuan to study, review and modify the fishery planning associated with the overall planning of national defense arrangement in combination with social – economic development; closely manages the ships whose permit is issued by the Ministry of Agriculture and Rural Development to enter the secure waters and safety belt of the Base.

Article 35 Ministry of Natural Resources and Environment

Directs and guides the activities of subordinate specializes state management bodies to properly coordinate the management of natural resources and environment of the Base areas; closely manages the ships whose permit is issued by the Ministry of Natural Resources and Environment to enter the secure waters and safety belt of the Base.

Article 36. Relevant ministries and sectors

Coordinate with the Ministry of Defense in closely managing people and vehicles entering and leaving the Base related to the fields under the management of their ministries and sectors.

Article 37. The People's Committee of provinces of Khanh Hoa and Ninh Thuan

1. Coordinate with the naval forces in ensuring the security and safety for the Base.

2. Directs the competent authorities of these provinces to closely manage the foreigners, people from elsewhere and Vietnamese people settled abroad who enter and leave the security areas and safety belt and do not permit people to illegally reside in the above areas.

3. Direct the local authorities at the grassroots level to coordinate with the bodies and units located in their areas to develop the secure areas, clusters and inter-clusters of area.

4. Ensure the economic activities in the security areas and safety belt do not affect the security, politics, management and protection of defense works and military zones. The investment projects in the areas of provinces of Khanh Hoa and Ninh Thuan related to the areas of the Base must have the opinions of the Ministry of Defense before submission to the Government or the Prime Minister for approval. Particularly for the areas of Hoi cape, Binh Ba island and Hon Chut, no type of tourism is permitted.

5. Provide the propagation and education for people on their defense – security duties and strict compliance with the provisions of this Regulation.

Chapter V

IMPLEMENTATION PROVISION

Article 38. Implementation organization

The Minister of Defense shall, based on this Regulation, develop the guiding documents and their implementation.

Article 39. Responsibility for implementation

The Ministers, Heads of ministerial-level bodies, Heads of governmental bodies, the Chairman of People’s Committee of provinces of Khanh Hoa and Ninh Thuan and bodies, organizations and individuals are liable to execute this Regulation. /.
