DECISION
ON CORRECTION OF CIRCULAR NO.30/2011/TT-BCT DATED AUGUST 10, 2011 OF MINISTRY OF INDUSTRY AND TRADE STIPULATING TEMPORARILY THE PERMISSIBLE CONTENT LIMITATION OF SOME TOXIC CHEMICALS IN THE ELECTRONIC, ELECTRICAL PRODUCTS

Pursuant to the Decree No.189/2007/ND-CP dated December 27, 2007 of the Government on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade; Decree No.44/2011/ND-CP dated June 14, 2011 of the Government amending, supplementing Article 3 of Decree No.189/2007/ND-CP;
Pursuant to the Law on Promulgation of Legal Documents No.17/2008/QH12 dated June 03, 2008;
Pursuant to the Decree No.104/2004/ND-CP dated March 23, 2004 of the Government on Official Gazette of the Socialist Republic of Vietnam;
At the proposal of Director of Department of Chemicals,
DECIDES:
Article 1. To correct some contents and Annex 2, Annex 3 issued together with Circular No.30/2011/TT-BCT dated August 10, 2011 of Ministry of Industry and Trade defining temporarily the permissible content limitation of some toxic chemicals in the electronic, electrical products as follows:
1. Clause 4 of Article 5 was printed as: "When having no respective Vietnam Regulation, to assess the content of hazardous substances in the electrical, electronic products, temporarily apply the existing standard of IEC 62321: Electric technical Products - Determination of the threshold of six types of chemicals regulated (the English name is Electrotechnical products - Determination of levels of six regulated substances)".
Now modified into: " When having no respective Vietnam Regulation, to assess the content of hazardous substances in the electrical, electronic products, temporarily apply the existing standard of IEC 62321: Electrical technical Products - Determination of the threshold of six types of chemicals regulated (the English name is Electrotechnical products - Determination of levels of six regulated Substances) or equivalent standards.
2. Clause 4 of Article 6 was printed as: "Developing and maintaining management records of hazardous chemicals content in electrical, electronic products before they are circulated on the Vietnam market and presenting to the competent authority upon request. The management records include: list of inputs; quality control votes of inputs raw materials; process of management of toxic chemicals content".
Now modified into: "Developing and maintaining management records of hazardous chemicals content in electrical, electronic products before they are circulated on the Vietnam market. Records of management include one of the following documents:
a) Testing card demonstrating the products containing content of hazardous chemicals not exceeding the permissible limitation specified in Annex 1 of this Circular;
b) The management process or other documents demonstrating the products containing content of hazardous chemicals not exceeding the permissible limitation specified in Annex 1 of this Circular."
3. Clause 2 of Article 9 was printed as: "From December 01, 2012, the electrical, electronic products manufactured, imported must implement the information announcement on the permissible content limitation of some hazardous chemicals as prescribed in Clause 2, Article 6 of this Circular."
Now modified into: "From December 01, 2012, organizations and individuals manufacturing, importing the electrical, electronic products must implement:
a) Publication of information on the permissible content limitation of some hazardous chemicals as prescribed in Clause 2, Article 6 of this Circular;
b) Assurance of the permissible content limitation of some hazardous chemicals in the electrical, electronic products as prescribed in Annex 1 of this Circular;
c) Developing or maintaining documents on the permissible content limitation of some hazardous chemicals in the electrical, electronic products as prescribed in Clause 4 of Article 6 of this Circular. "
3. Part 1. Big size appliances of Annex 2 were printed as: "Washing Machine", "HS Code 8451".
Now modified into: Washing Machine, HS code 8450.
4. The ordinal number 1.5, the cases of exemption listed in Annex 3 were printed as: "With the fluorescent lamps with square or circular design and with a tube diameter of smaller than 17mm for lighting purposes in general."
Now modified into: "With the fluorescent lamps with square or circular design and with a tube diameter of smaller than or equal to 17mm for lighting purposes in general."
5. The ordinal number 2.1, the cases of exemption listed in Annex 3 were printed as: " Fluorescent lamps of spectral 3 lines with an average lifespan and tube diameter of more than or equal to 17mm and less than or equal to 28mm: 5mg "; "Fluorescent lamps of spectral 3 lines with an average lifespan and tube diameter of more than or equal to 28 mm: 5mg".
Now modified into: "Fluorescent lamps of spectral 3 lines with an average lifespan and tube diameter of more than 17mm and less than or equal to 28mm: 5mg"; "Fluorescent lamps of spectral 3 lines with an average lifespan and tube diameter of more than 28 mm: 5 mg ".
6. The ordinal number 3.1, the cases of exemption listed in Annex 3 were printed as: " Short type (more than or equal to 500mm)".
Now modified into: "Short type (less than or equal to 500 mm)".
7. The ordinal number 3.2, the cases of exemption listed in Annex 3 were printed as: "Medium type (more than 500 mm and less than 1,500 mm)".
Now modified into: "Medium type (more than 500 mm and less than or equal to 1,500 mm)".
8. The ordinal number 4.2, the cases of exemption listed in Annex 3 were printed as: "P <155 W", "155 W
450 W".
Now modified into: "P ≤ 155W", "155 W
405 W".
9. The ordinal number 4.3, the cases of exemption listed in Annex 3 were printed as: "P <155 W", "155 W
Now modified into: "P ≤ 155W", "155 W
405 W".
Article 2. This correct decision is a component of Circular No.30/2011/TT-BCT dated August 10, 2011 of Ministry of Industry and Trade defining temporarily the permissible content limitation of some toxic chemicals in the electronic, electrical products./.
