DECISION

PROVIDING FOR PRODUCTION, SUPPLY AND CONSUMPTION OF CLEAN WATER AND PROTECTION OF WATER SUPPLY CONSTRUCTIONS IN HANOI

THE PEOPLE’S COMMITTEE OF HANOI CITY

Pursuant to the Law on organization of the People’s Council and the People’s Committee dated November 26, 2013;

Pursuant to the Law on water resources dated May 20, 1998;

Pursuant to the Decree No. 117/2007/NĐ-CP dated 11/7/2007 by the Government on production, supply and consumption of clean water; the Decree No. 124/2011/NĐ-CP dated 28/12/2011 by the Government providing amendments to a number of articles of the Decree No. 117/2007/NĐ-CP dated 11/7/2007 by the Government;

Pursuant to the Circular No. 01/2008/TT-BXD dated 02/01/2008 by the Ministry of Construction providing guidance on the implementation of a number of articles of the Decree No. 117/2007/NĐ-CP dated 11/7/2007 by the Government;

Pursuant to the Circular No. 08/2012/TT-BXD dated 21/11/2012 by the Ministry of Construction providing guidance on ensuring the safety in water supply;

Pursuant to the Circular No. 75/2012/TTLT-BTC-BXD-BNNPTNT dated 15/5/2012 by the Ministries: the Ministry of Finance, the Ministry of Construction and the Ministry of Agriculture and Rural Development providing guidance on principles, methods for determination and authority to decide clean water sale price in urban areas, industrial zones and rural areas;

At the request of the Director of Services of Construction in the Statement No. 9914/TTr-SXD dated 20/12/2011, the Official Dispatch No. 1424/SXD-HT dated 08/3/2013 and the appraising opinion of Services of Justice in the Document No. 715/STP-VBPQ dated 26/4/2011,

DECIDES:

Article 1. Enclosed with this Decision the Regulation on production, supply and consumption of clean water and protection of water supply constructions in Hanoi.

Article 2. This Decision comes into effect after 10 days from the day on which it is signed.

Article 3. The Chief officer of the People’s Committee of Hanoi; Director of Services: The Service of Construction, the Service of Planning and Investment, the Service of Finance, the Service of Natural Resources and Environment, the Service of Planning and Architecture, the Service of Transport, the Service of Health, the Fire department; Director of Police Department of Hanoi; Director of Institute of Construction planning of Hanoi, Director of Provincial Department of Taxation; President of the People’s Committees of districts; CEO, Director of water supply units and relevant organizations, households and individuals are responsible for implementing this Decision./.

REGULATION

ON PRODUCTION, SUPPLY AND CONSUMPTION OF CLEAN WATER AND PROTECTION OF WATER SUPPLY CONSTRUCTIONS IN HA NOI
(Enclosed with the Decision No. 63/2013/QĐ-UBND dated December 30, 2013 by the People’s Committee of Hanoi City)

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of regulation and regulated entities

1. Scope of regulation: This Regulation provides for the operation of organizations and individuals relating to the production, supply and consumption of clean water and protection of water supply constructions in the concentrated clean water areas under the management of the City's local government.

2. Scope of regulation: Any organizations, individuals and households relating to the production, supply and consumption of clean water and protection of water supply works in the concentrated clean water areas under the management of the City's local government.

Entities that use water from the independent water supply network in rural areas and small towns are encouraged to apply this regulation.

Article 2. Interpretation of terms

1. ”Clean water production” means the collection and treatment of underground water or the surface water of rivers and lakes to produce clean water, ensuring to satisfy the National technical regulations on quality of drinking water: QCVN 01:2009/BYT, enclosed with the Circular No. 04/2009/TT-BYT dated 17/6/2009 by the Ministry of Health.

2.  “Clean water supply” means the process in which water is brought to the location where the consumer requests through plumbing system.

3. “Connection point” means the place where the domestic plumbing is connected to the water supply network.

4. “Concentrated clean water area under the management of the City’s local government” means the area including the districts and the communes of the districts near the central urban where clean water supplied from the concentrated water supply system of the City under the management of City’s local government is used.

5. “Water pipe safety corridor” means the safe distance from the center of the pipe to the two sides, depending on the diameter of the pipe.

Article 3. Policies and plans on development of water supply

1. Economic sectors are encouraged to invest in the development and management of water supply activity. Water suppliers enjoy preferential policies and investment support from the state according to the legislations.

2. Plans on development of water supply shall be in conformity with the general planning for the development of Hanoi Capital, planning for water supply and the actual demand.

Chapter 2.

SPECIFIC PROVISIONS

Article 4. Clean water production

During the collection and production of water, the water supplier shall comply with the process for collection of underground water or the surface water of rivers/lakes; be responsible for water quality after treatment, ensuring to satisfy the National technical regulation on quality of drinking water QCVN 01:2009/BYT enclosed with the Circular No. 04/2009/TT-BYT dated 17/6/2009 by the Ministry of Health; comply with other legislative documents promulgated by Ministries or central agencies and the People’s Committee of Hanoi City that is related to water supply.

Article 5. Connection point

Water supplier shall determine the connection points to the water supply network to supply water to consumers. The connection point shall be placed next to the land use boundary or foot of the fence of the works under acceptable conditions. If the plumbing system is unavailable in the area where the consumer lives or if such area is too far to ensure the pressure, the water supplier shall provide them with explanation.

Article 6. Costs for development of plumbing system and water meters

Water supplier shall be responsible for providing a comprehensive system up to the connection points at the consuming households including water meters; other costs shall be paid by the consumer.

Article 7. Replacement of plumbing system

The replacement of plumbing system under the management of water supplier shall be carried out by such supplier in the following cases:

1. Replacement according to the demand for construction and the urban construction planning like apartment, road, wharf, sewage system, electricity, post and telecommunications, urban innovation construction…according to the construction project/planning approved by a competent agency; cost for replacement is included in the total expenditure of the project.

2. Replacement shall be in accordance with the request of water consumer and conformable with the water supply system management of water supplier. In this case, water consumer shall pay the water supplier for the cost of replacement according to the norm and unit price at the requested time.

Article 8. Plumbing system behind water meters

1. The plumbing system behind water meter that is designed and installed shall be in conformity with the devices and plumbing of water supplier, ensuring not to cause breakdown or emergency to the supplier. If water consumer requests the supplier to design and install the plumbing system behind water meter, then water supplier and the consumer may negotiate an agreement and comply with it.

2. The suction pump of water directly from plumbing system is forbidden.

3. The joining of water from dug wells or drilled wells with water provided by water supplier is forbidden.

4. Water supplier shall inspect regularly the water meter of the consumer and plumbing system behind such water meter. During the inspection, the inspector shall wear uniform with badge and present the inspection card to the consumer. The consumer shall enable the inspection staff of the water supplier to complete the task.

Article 9. Water supply to urban housing areas, resettlement areas, worker’s housing areas, industrial/commercial/service zones and complexes

1. When setting up investment project in construction of urban housing areas, resettlement areas, worker’s housing areas and industrial/commercial/service zones and complexes, if the agreement about infrastructural joint of the regulatory body is available, the investor demanding water supply shall sign a written agreement with the water supplier in local area about the connection of water supply, the design and construction supervision. The water supplier shall provide written response after 07 working days from the day on which the application for water supply from the investor is received.

2. With regard to the urban housing areas and resettlement areas, when the request from the competent State management agency is received, the water supplier shall accept the water supply network transferred from the investor and inform the consumers so that they can sign the water supply contract according to the regulations. Procedures for transference of water supply system to the apartment buildings included in the resettlement program according to the Decision No. 20/2011/QĐ-UBND dated 05/7/2011 by the People’s Committee of Hanoi City.

3. With regard to worker’s housing areas, industrial/commercial/service complexes and zones, water supplier shall install water master meter and supply water to the fence.

Article 10. Water supply for fire safety

1. Water supplier shall ensure to supply sufficiently pressure and flow to fireplugs system in the city’s area.

2. Any person who commits violations causing damage to the water system serving fire safety or obstructs/delays the use of water for fire fighting will be handled according to the Decree No. 52/2012/NĐ-CP dated 14/6/2012 by the Government.

Article 11. Cut-off water supply

Water may be cut off in the following cases:

1. Water supply system suddenly breaks down or is replaced or repaired according to the annual plan of the water supplier. Water supplier shall provide announcement for the cut-off water for the consumer through means of mass media and prepare a plan for water supply with xitec for the location of cut-off water.

2. Water is cut off according to the decision of written request of regulatory agencies in accordance with the legislations.

3. Other cases specified in clause 1 Article 45 of the Decree No. 117/2007/NĐ-CP dated 11/7/2007 by the Government on production, supply and consumption of clean water and clause 2 Article 19 of this Regulation.

Chapter 3.

WATER METER

Article 12. Installation of water meter

Location of water meter shall be in accordance with the regulation of water supplier, ensuring the convenience for the installation, management, inspection, meter readings recording and maintenance of water meter. Water supplier is in charge of installing water meters. Any water consumer shall get only 1 water meter.

a) Water supplier shall post the regulation on procedures for water supply and installation of water meter on a noticeable location.

b) Application for water meter installation shall include:

- An application form for new installation of water meter (according to the form in the appendix) certified by local government and any of the following documents:

+ The permanent residence or the certificate of temporary residence issued by the police department;

+ Certificates of homeownership and land use right;

+ The contract on transference of homeownership that is notarized or certified by a competent People’s Committee;

+ The residential lease contract between individuals/organizations and the state;

+ The license for construction;

+ The decision of a competent agency or the applicable judgment of the court recognizing the homeownership and the land use right.

c) The process of the application for installation of water meter shall be carried out within 20 working days from the day on which the satisfactory application is received (regardless of the duration of road digging or duration of handling objective obstacle during the construction).

Article 13. Maintenance of water meter

1. Water consumer shall protect and maintain the water meter and the lead seals if the water meter is placed in the boundary of housing or land lines of the consumer. The acts of damaging, replacing, lifting or lowering, modifying, displacing or adjusting of water meter without permission is forbidden.

2. Replacement of water meter.

a) If the water meter is lost or broken due to the fault of the consumer, the water supplier shall replace it with another one. Cost for such replacement of water meter shall be paid by the consumer according to the price specified by the supplier.

b) In case the water meter or the lead seal is broken due to objective reason, the consumer shall report to the supplier for examining, affixing the new lead seal or replacing. Cost for such replacement of water meter shall be paid by water supplier.

c) Water supplier shall replace the water meter free of charge if the meter reading is unreadable or the meter is broken due to technical defects or expiration.

Article 14. Inspection of water meter

1. If the consumer suspects that the meter reading is inaccurate, he/she may request the supplier to conduct an inspection of such meter. A water meter is considered applicable if according to the inspection result, the tolerance does not exceed ± 5% the actual amount of water flowing through it.

2. Within 07 working days from the day on which the request of the consumer is received, water supplier shall conduct an inspection of water meter.

The inspection of water meter shall be with the attendance of the consumer and shall be carefully recorded. The records shall be established in 02 copies, one is kept by the supplier and the other is kept by the consumer.

3. The result of the inspection of water meter is handled as follows:

a) If the tolerance is at an acceptable value (indicating the value), the consumer requesting the inspection shall pay the cost of inspection;

b) If the tolerance exceeds the acceptable value, the water supplier shall replace the water meter and the consumer is not requested to pay the cost for inspection. In case the value of meter reading is higher than the actual usage and the tolerance exceeds the acceptable value, the water supplier shall return the payment in proportion to the tolerance (according to the inspection result) for the billing period in which consumer requests the inspection of water meter;

 

4. Recording meter readings

a) If the meter reading is recorded inaccurately and, as the result, the water usage is determined incorrectly, the supplier shall notify the consumer of the tolerance and shall adjust the value in the next billing period;

b) If the supplier fails to record the meter reading because the water meter is broken or because of other reasons, the usage shall be determined according to the arithmetic mean of the actual usage of the 2 previous months; such method shall not be used in more than 2 consecutive months. The supplier shall take a measure for recording the actual water meter reading or cut off the water.

5. Water supplier shall set up plan on periodic inspection of water meter and shall be responsible for the accuracy of the meter readings.

6. If the consumer does not agree with the inspection result, he/she may request a local regulatory body relating to water supply to conduct an independent inspection according to the provisions of clause 3, 4 and 5 Article 50 of the Decree No. 117/NĐ-CP dated 11/7/2007 by the Government.

Chapter 4.

CLEAN WATER’S PRICE

Article 15. Clean water’s price

1. The People’s Committee of Hanoi City is in charge of approving the plan of tap water’s price and promulgating the price list of tap water in local area. Water supplier is entitled to decide the price of clean water other than tap water, provided that it is in conformity with the price of clean water approved by the People's Committee of Ha Noi City.

2. Price of wholesale water is agreed by the wholesale water supplier and the retail water supplier. If the offered price is not agreed, one or both sides may request the Service of Finance to establish a negotiation according to the legislation.

3. If the price of clean water approved by the People’s Committee of Hanoi City is lower than the accurately and fully calculated prices of clean water established by water supplier and approved by the Service of Finance according to the regulations, then the People’s Committee of Hanoi shall annually consider and provide subsidies from the city’s budget or through the supporting mechanisms and policies to ensure lawful rights and interests of water supplier.

4. Price of clean water is adjusted if there is modification in water treatment or service quality standards. In case the modification of relevant policy of the state causes the increase (or decrease) in clean water’s price, the People’s Committee of Hanoi shall consider and adjust the price of clean water.

Chapter 5.

USE AND PAYMENT FOR WATER

Article 16. Responsibilities and rights of consumers

1. Consumer shall use water economically and conformably with the purpose agreed in the Water supply contract signed with the supplier according to the provisions of this regulation.

2. The consumer shall protect the water supply works, safety corridor/area of water supply works so as not to cause obstacle in the management and development of plumbing.

3. The consumer shall pay promptly and fully the cost for water use according to the regulations of water supplier.

4. The consumer shall promptly report to water supplier the issues relating to the supply and use of water for handling within competence.

5. Any water consumer has the rights specified in Points a, b, c, d, dd, e, g clause 1 Article 56 of the Decree No. 117/2007/NĐ-CP dated 11/7/2007 by the Government on production, supply and use of clean water.

Article 17. Determination of water usage

1. Water usage is determined by the difference between the meter readings of 2 reading recording periods. The measurement unit of water usage is cubic meter (m3). The meter reading is recorded according to management cycle of water supplier.

2. Water consumer shall enable the staff of water supplier to record the water reading and conduct examination of water meter and the use of water according to the management activity.

Article 18. Modification of water using purpose

1. Any consumer wishing to modify the registered purpose of water supply shall re-register with the water supplier to apply a new water price in accordance with the actual water using purpose.

2. If the consumer uses water both for domestic use and manufacture/business or other purposes, the usage will be determined like water for business.

3. If the consumer changes the using purpose without re-registration with the supplier, the supplier may apply the water price according to the actual purpose from the day on which the change is identified

4. If the consumer transfers the right to use water meter to another consumer, the new one shall sign a new water supply contract with the water supplier.

5. If a household/unit/organization includes different water users, each user may use the installed meter together until the individual meter is installed.

Article 19. Payment for water supply

1. Consumer shall pay the water charge specified on water invoice or water bill. The staff of the water supplier will collect water payment at the house of the consumer and the water invoice will be provided immediately after that. Clean water invoice shall be issued by water supplier and shall be conformable with the sample regulated by the tax agency. Water supply payment may be in cash or by transference.

2. If the consumer fails to pay the water charge as soon as the water bill is received, the consumer shall make the payment at the location regulated by the supplier within 07 days from the day on which the bill is received. If after such period, the water charge is still not paid, the supplier will send the second bill. Within 07 days from the day on which the second bill is received, consumer shall make the payment. If after such period, the water charge is still not paid, the supplier will cut off the water until all the bills are fully paid. Water will be supplied again when the reason for cut-off is remedied. The consumer shall pay the supplier the cost of suspension and supply of water.

Chapter 6.

PROTECTION OF WATER SUPPLY WORKS

Article 20. Protection of safety corridor of plumbing and water supply works

1. The safety corridor for plumbing shall be conformable to the provisions in section 8 of the Viet Nam Construction Standards TCXDVN 33:2006 enclosed with the Decision No. 06/2006/QĐ-BXD dated 17/3/2006 by the Ministry of Construction.

The safety corridor for water boreholes, treatment station, pumping station, water container and water supply works shall be conformable to the Viet Nam Construction Standards TCXDVN 33:2006 promulgated by the Ministry of Construction.

2. These following acts are forbidden inside the safety corridor of water supply works:

a) Construction of houses, huts, fences, architectural objects, treasures, yards, billboards or any other works (regardless of temporary or permanent works);

b) Parking road motor vehicles and specialized motor vehicles with vehicular weight exceeding the capacity of plumbing. If a vehicle that has vehicular weight exceeding the capacity of the plumbing needs to pass the plumbing, a solid bridge approved by a competent agency shall me built crossing the pine line;

c) Littering or discharging waste, chemicals, soil, stone or building materials;

d) Digging to take soil.

3. Agencies, organizations, units and individuals carrying out inspection, design, construction of works relating to water supply works, secure corridor and area of water supply works shall enter into an agreement with water suppliers and shall comply with such agreement.

4. Any agencies, organizations, units and individuals that carries out construction of a building that affect the secure corridor or area of water supply works shall comply with the following regulations:

a) Such entity shall have a license issued by a competent agency;

b) Such entity shall directly discuss with the relevant water supplier on the construction;

c) The construction shall be carried out only when the safety measures for works relating to water supply are adopted conformably;

d) The conditions of the secure corridor/area shall be restored when the construction is completed.

Article 21. Protection of water treatment areas, pumping stations and water boreholes

1. Water supplier shall construct a protective fence for the precincts of waterworks, water treatment areas, pumping stations, water boreholes.

2. Water supplier shall strictly comply with the regulations on environmental protection in the precincts of waterworks, water treatment areas, pumping stations, water boreholes and water containers used for water collection and treatment.

3. Any violation against the security and sanitariness of waterworks, water treatment areas, pumping stations, water boreholes and water containers used for water collection and treatment is forbidden.

Article 22. Protection of water supply network and the auxiliary works

1. Consumer shall cooperate with water supplier in protecting the plumbing and the connection point before meter; any breakdown and water leak of the plumbing shall be promptly reported to the supplier.

2. Any boring into water pipes to use water illegally or stealing of spare parts or devices in the plumbing or any acts causing damage to the network without permission is forbidden.

3. Any relocation, lifting or lowering, changing of size of the pipes before the water meter and connection of plumbing before water meter without permission is forbidden.

4. Any boring into water pipes, modification, disassembly, stealing without permission and any damage to auxiliary water supply works, devices enclosed with water supply works under the management of water supplier are forbidden.

5. Any agency, unit, organization or individual commits violations that cause damage to water supply works/systems shall bear any cost for handling the consequences and shall be administratively sanctioned according to the Decree No. 23/2009/NĐ-CP dated 27/02/2009 by the Government.

Chapter 7.

ORGANIZATION OF IMPLEMENTATION

Article 23. Responsibilities of relevant agencies

1. Service of Construction

a) Fulfill the State management function in urban water supply in the City;

b) Establish the general planning for urban water supply in the City;

c) Establish annual/5-year/periodic investment plan on water supply infrastructure in urban area and in the vicinity;

d) Cooperate with the Service of Finance in appraising the price of clean water, adjustment of clean water’s price, project for provision of subsidy (if any) and request the People’s Committee of Hanoi City to approve;

dd) Preside over and guide the organizations/individuals and the supplier in implementing this Regulation;

e) Cooperate with the Service of Health in inspecting and supervising the water supplier fulfilling the obligations according to the regulations on water supply safety and assessing the standards of water quality;

g) Steer the Inspector to conduct the inspection to promptly identify and handle the violations of the water supply works, secure corridor and area of water supply works/system according to the Decree No. 23/2009/NĐ-CP dated 27/02/2009 by the Government.

2. Service of Planning and Investment:

a) Preside over the collection of investment projects pertaining to water supply in different period and request the People’s Committee of Hanoi City to approve;

b) Preside over and cooperate with relevant regulatory bodies in proposing incentive mechanisms and policies on investment in water supply in Hanoi; allocate and balance the budget for support or investment in the projects on development of water supply system and submit them to the People's Committee of Hanoi.

3. Service of Finance:

a) Preside over and cooperate with the Service of Construction in appraising the project on clean water price and the price list of domestic clean water established by water supplier and the project on subsidies from the city’s budget (applicable to the cases specified in clause 3 Article 15 of this Regulation) then submit them to the People’s Committee of Hanoi City for approval;

b) Preside over and inspect the application of clean water price at the request of the People’s Committee of Hanoi City; provide water supplier with guidance on the collection of sanitary sewer service in the City’s area;

c) Cooperate with the Service of Planning and Investment in proposing the policy on incentive for development of water supply service.

4. Service of Natural Resources and Environment:

a) Intensify the management, inspection and handling of violations in the development of water resources according to the legislation;

b) Provide the investors with guidance on procedures for licensing the activities of survey, development and appraisal, approval for environmental impact assessment dossiers or request the People’s Committee of Hanoi City to approve within competence;

c) Allocate the land-use planning to establish water supply works.

5. Taxation Department of the City:

a) Preside over, cooperate with the Service of Finance, the Service of Natural Resources and Environment, the Service of Construction in establishing the rate of charge for sanitary sewage service and request the People's Committee of the City to approve;

b) Provide water supplier with guidance on production of clean water supply invoice according to the form, register for payment of tax on water resources use, implement the policies on tax exemption and reduction in accordance with regulations of law on taxation and other relevant law provisions.

6. Service of Transport:

a) Cooperate with the Service of Construction in establishing the traffic infrastructures comprehensively with urban infrastructures to ensure the effectiveness;

b) License and supervise within competence the road digging.

7. Service of Planning –and Architecture:

Carry out appraisal and approval for planning of the site for the project on development of water resources, waterworks, booster pumping stations; design the direction of primary pine line within competence.

8. Service of Health:

Conduct periodically or irregularly inspection of water quality of water supplier in Hanoi.

9. People’s Committees of districts:

a) Propagate the economical use of water and the protection of water supply works;

b) Establish a plan on demand for water supply in local area;

c) Steer the site clearance activity, the plans on water supply infrastructure in local area, promptly handle within competence or request the People’s Committee of the City to steer and handle the difficulties during the site clearance progress;

10. Police Department of Hanoi City:

Steer the Police forces of districts to cooperate with the inspectorate of the Service of Construction, the Service of Transport and the People’s Committees of districts to promptly handle the violations pertaining to the production, supply and use of clean water and protection of water supply works in the City’s area.

11. Fire Department of the City:

a) Take responsibilities for appraising the design of water supply system for fire safety of the concentrated water supply system in the City’s area and the devices used in it;

b) Cooperate with the Service of Construction, water supplier and the People’s Committees of districts in establishing the plans on effective management and use of water supply system for fire safety; determine the amount of water that has been used for fire safety activity;

c) Cooperate with the Service of Construction, construction units and water suppliers in receiving dossiers, checking and operating fire safety system in the finished water supply projects.

12. Water suppliers:

a) Manage the safe and effective operation of water supply equipment and works; carry out the allocated project, ensuring the punctuality and the effectiveness;

b) Strengthen the protection of water resources, preventing the loss of clean water;

c) Cooperate with local construction inspectorate and police officers in handling the violations;

d) Set up plans on water production and supply and plans on investment in water infrastructure development, then report them to the Service of Construction and the Service of Planning and Investment; the Service of Construction and the Service of Planning and Investment will collect the plans from water suppliers and report them to the People’s Committee of the City;

e) Strengthen the managerial structure and the operation toward the compactness and effectiveness;

f) Take responsibilities for the management, maintenance, and protection of water containers for fire safety in administrative division.

Article 24. Implementation

Difficulties that arise during the implementation of this Regulation should be reported to the People’s Committee of Hanoi City (via the Service of Construction) for consideration and decision./.

* Water supplier and consumer shall commit to fulfill the following provisions (according to the Decree No. 117/2007/NĐ-CP and No. 124/2011/NĐ-CP)

- If the consumer submits a written application containing legitimate reasons for suspension of water in a certain period of time without termination of the water supply contract, the water supplier shall suspend the water supply services at the request of the consumer. Any consumer wishing to resume using water shall submit a written application to the water supplier for the resumption of water supply. The consumer shall pay the cost of suspension and resumption of water supply according to the estimate.

- The consumer shall sufficiently comply with the applicable regulations on installation and management of water usage of the City's government and the water supplier.

Instructions:

1. The householder (housing owner) shall be the undersigned, declaring sufficiently the information in the application form

2. Regarding additional households in a residential cluster that have been connected with water supply system in which such residential cluster is the investor in the service plumbing, there shall be an agreement on the connection with the representative of the initial investment with the content: "I/We approve the connection to water supply system with backbone funding obtained sufficiently"

3. Consumer applying for water supply shall enclose the documents relating to the location that need water supply:

- For initial installation: a notarized copy of: the family record book or the Certificates of home and/or land ownership and the temporary residence registration. A family with multiple inhabitants living together shall be granted only 1 meter and have the water charge determined according to the regulation. If only the Certificates of home and/or land ownership is available, water charge shall be determined according to the highest charge for domestic-use water.

- For household separation: there shall be separate houses. A notarized copy of: the family record book or the Certificates of home and/or land ownership. The latest water invoice and a writing containing the agreement of sharing policyholder with the separation. The separation of water meter of household using water from the pump station outside the management of the water supplier.

- For reinstallation: Water supplier will take different measures for particular cases.  

4. Water supply shall not be provided in blank land; uninhabited houses; locations without agreement on connection with the initial investor; location of meter unsatisfactory, area not included in water supply planning.

- Consumer wishing to use water that needs secondary pipeline and meter >D15 or outside the service of water supplier shall make an agreement with the supplier on the connection and payment so as to ensure the interests in business of the water supplier.

- If the consumer submits written application containing legitimate reasons for suspension of water in a certain period of time without termination of the water supply contract, the water supplier shall suspend the water supply services at the request of the consumer. Consumer wishing to resume using water shall submit a written application to the water supplier for water supply. The consumer shall pay the cost of suspension and resumption of water supply according to the estimate.

- The consumer shall sufficiently comply with the applicable regulations on installation and management of water usage of the City's government and the water supplier.

- For initial installation: Decision on the establishment of the enterprise, The License for construction or the Business registration certificate, residential lease contract. Enclosed therewith an Official Dispatch of the land owner authorizing the water connection.

- For reinstallation: Water supplier will take different measures for particular cases.

2. Water supply shall not be provided in blank land; uninhabited company; locations without agreement on connection with the initial investor; location of meter unsatisfactory, area not included in water supply planning.
