DECREE
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF DECREE No. 29/2011/ND-CP DATED APRIL 18, 2011 OF THE GOVERNMENT ON STRATEGIC ENVIRONMENT ASSESSMENT, ENVIRONMENT IMPACT ASSESSMENT AND COMMITMENT TO ENVIRONMENTAL PROTECTION
Pursuant to the Law on organization of Government dated December 25, 2001;
Pursuant to the Law on environmental protection dated November 29, 2005;
At the request of the Minister of Natural Resources and Environment,
The Government issues the Decree amending and supplementing a number of articles of Decree No. 29/2011/ND-CP dated April 18, 2011 of the Government on strategic environment assessment, environment impact assessment and commitment to environmental protection;
Article 1. Amending and supplementing Clause 3, Article 39 of Decree No. 29/2011/ND-CP dated April 14, 2011 of the Government on strategic environment assessment, environment impact assessment and commitment to environmental protection (hereafter referred to as Decree No. 29/2011/ND-CP) as follows:
“"3. The concentrated areas of production, business, services or the facilities of production, business and services (collectively referred to as the facility) by the time of June 5, 2011 have come into operation but have no decision on approving the report on environmental impact assessment, decision on approving the additional report on environmental impact assessment, the registration of environmental standards, commitment to environmental protection. In addition to the handling of violation as stipulated by the law, before December 31, 2014 one of two remedial measures of violations must be done as follows:
a) Formulating the detailed environmental protection scheme for the facilities with their scale and nature equivalent to the subjects that have to prepare the report on environmental impact assessment specified in Clause 1, Article 12 of Decree No. 29/2011/ND-CP for submission to the competent authorities specified in Clause 2, Article 18 of Decree No. 29/2011/ND-CP for appraisal and approval;
b) Formulating the simple environmental protection scheme for the facilities with their scale and nature equivalent to the subjects that have to register the commitment to environmental protection specified in Article 29 of Decree No. 29/2011/ND-CP for submission to the competent authorities specified in Article 32 of Decree No. 29/2011/ND-CP for registration;
Article 2. Responsibility for implementation organization
1. The Minister of Natural Resources and Environment is responsible for guiding and organizing the implementation of this Decree.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and Chairmen of People's Committees of provinces and centrally-run cities are liable to execute this Decree.
Article 3. Implementation provision
1. This Decree takes effect on June 15, 2014;
2. This Decree annuls the Clause 3, Article 39 of Decree No. 29/2011/ND-CP dated April 18, 2011 of the Government on the strategic environment assessment, the environment impact assessment and the commitment to environmental protection./.
