JOINT CIRCULAR

PROVIDING DETAILED GUIDANCE ON PRICE STABILIZATION AND DECLARATION FOR PRODUCTS IN THE AGRICULTURE AND RURAL DEVELOPMENT SECTOR

Pursuant to the Price Law No. 11/2012/QH13 dated June 20, 2012;

Pursuant to the Government's Decree No. 177/2013/NĐ-CP dated November 14, 2013 on specifying and providing detailed guidance on implementation of several articles of the Price Law;

Pursuant to the Government’s Decree No. 199/2013/NĐ-CP dated November 26, 2013 on stipulating the functions, duties, powers and organization structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government’s Decree No. 215/2013/NĐ-CP dated December 23, 2013 on stipulating the functions, duties, powers and organization structure of the Ministry of Finance;

The Minister of Agriculture and Rural Development and the Minister of Finance hereby promulgates the Joint Circular on price stabilization and declaration for products in the agriculture and rural development sector.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of application

This Joint Circular shall provide specific regulations on price stabilization and declaration for products in the agriculture and rural development sector.

1. Price of the following products must be stabilized: urea fertilizer, NPK fertilizer; pesticide, disease treatment product, herbicide; disease prevention vaccine for livestock and poultry; salt; ordinary grain, rice.

2. Price of the following products must be declared: Livestock, poultry feed and aqua feed; detoxicant, sterilizer, disinfectant, disease treatment product for livestock, poultry and aquatic products as well as the products defined in Clause 1 of this Article that fall within a period of time when the State does not apply the price registration measure.

Article 2. Applicable entities

Manufacturing, trading organization, individual; regulatory agencies; other organization or individual engaged in price stabilization and declaration for products in the agricultural and rural development sector throughout Vietnam.

Chapter II

SPECIFIC PROVISIONS

Section 1. Products for which price stabilization is required

Article 3. Fertilizer products for which price stabilization is required

1. Urea fertilizer products with the total content of Nitrogen (N) ≥ 46%;

2. NPK fertilizer products with the total content of nutritional components such as Nitrogen (Nts), phosphorous ((P2O5hh), potassium (K2Ohh) ≥ 18%.

Article 4. Plant protection products containing different active ingredients for which price stabilization is required

1. Pesticide: Fenobucarb (min 96%); Pymethrozin (min 95%); Dinotefuran (min 89%); Ethofenprox (min 96%); Buprofezin (min 98%); Imidacloprid (min 96%); Fipronil (min 96%).

2. Disease treatment product: Isoprothiolane (min 96%); Tricyclazole (min 95%); Kasugamycin (min 70%); Fenoxanil (min 95%); Fosetyl-aluminium (min 95 %); Metalaxy (min 95%); Mancozeb (min 95%); Zined (min 80%).

3. Herbicide: Glyphosate (min 95%); Pretilachlor; Quinclorac (min 99%); Ametryn (min 96 %).

Article 5. Disease prevention vaccine for livestock, poultry for which price stabilization is required

1. Disease prevention vaccine for livestock: Mouth and foot disease vaccine; PRRS vaccine; Pasteurellosis vaccine; swine fever.

2. Disease prevention vaccine for poultry: Avian influenza vaccine; pestis anatum vaccine, Newcastle disease vaccine.

Article 6. Salt products for which price stabilization is required

Raw salt, refined salt and iodine salt manufactured by manufacturing, trading organizations or individuals.

Article 7. Ordinary grain, rice products for which price stabilization is required

Ordinary grain, rice manufactured by manufacturing, trading organizations or individuals.

Section 2. Products for which price declaration is required

Article 8. Products for which price declaration is required

1. Products stipulated in Article 3, 4, 5, 6 and 7 hereof that fall within a period of time when the State does not apply the price registration measure.

2. Livestock, poultry feed and aqua feed

a) Maize, soybean meal;

b) Total mixed ration, condensed feed used for raising pigs, chickens for meat and ducks for eggs;

c) Mixed feed used for raising catfish, basa fish, tilapia;

d) Mixed feed used for raising giant tiger prawns, whiteleg shrimps and giant river prawns.

3. Detoxicant, sterilizer, disinfectant, and disease treatment product used for livestock, poultry and aquatic product, which contains active ingredients.

a) Detoxicant, sterilizer and disinfectant: Chloramin; Iodine; Benzalkonium; Glutaraldehyde; Chlorine; Potassium permanganate (KMnO4); Formol; Copper sulphate (CuSO4).

b) Disease treatment product: Ampicillin, Amoxicillin; Colistin; Florfenicol; Tylosin; Doxycyclin; Gentamycine; Spiramycin; Oxytetracyline; Kanammycin; Streptomycin; Lincomycin; Celphalexin; Flumequin.

Chapter III

IMPLEMENTARY PROVISIONS

Article 9. Implementary responsibility

1. The Ministry of Agriculture and Rural Development shall preside over, collaborate with the Ministry of Finance, the Ministry of Industry and Trade and relevant agencies in inspection and assessment to serve the purpose of amending detailed guidance on products for which the price stabilization is required as stipulated in Article 3, 4, 5, 6 and 7 Section 1, and Article 8 Section 2 hereof to be properly applied in each period.

2. The Ministry of Finance shall manage prices under the provisions of the law on price for products for which price stabilization or declaration is required in accordance with regulations laid down in Article 3, 4, 5, 6, 7 and 8 hereof.

3. The People’s Committee of centrally-affiliated cities and provinces (hereinafter referred to as provincial People’s Committee) shall manage product prices at their localities under the provisions of the law on price for products for which price stabilization, declaration is required under the provisions of Article 3, 4, 5, 6, 7 and 8 hereof.

4. Relevant organizations or individuals

a) Stabilize price of products stipulated by Article 3, 4, 5, 6, 7 and 8 hereof in accordance with the law on price.

b) Declare price of products stipulated by Article 8 hereof in accordance with the law on price.

Article 10. Effect

This Joint Circular shall take effect from April 20, 2015.

In the course of implementation, if there is any difficulty, the Ministry of Agriculture and Rural Development should be advised to provide their timely guidance or solutions./.
