JOINT CIRCULAR

PROVIDING FOR CODE AND CRITERIA FOR TITLE OF DOCTOR, DOCTOR OF PREVENTIVE MEDICINE AND PHYSICIAN

Pursuant to the Law on Officials dated 15 November 2010;

Pursuant to Decree No. 29/2012/ND-CP dated 12 April 2012 of the Government providing for recruitment, employment and management of officials;

Pursuant to Decree No. 204/2004/ND-CP dated 14 December 2004 of the Government on salary regulation for cadres, public servants, officials and armed forces; Decree No. 17/2013/ND-CP dated 19 December 2013 of the Government amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated 14 December 2004 of the Government on salary regulation for cadres, public servants, officials and armed forces;

Pursuant to Decree No. 63/2012/ND-CP dated 31 August 2012 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Health;

Pursuant to Decree No. 58/2014/ND-CP dated 16 June 2014 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Home Affairs;

The Minister of Health and the Minister of Home Affairs issue this Joint Circular providing for the code and criteria for title of doctor, doctor of preventive medicine and physician.

Chapter I

GENERAL PROVISION

Article 1. Scope of regulation and subjects of application

1. This Joint Circular Providing thes for the code and criteria for title of occupation and appointment and salarying according to title of doctor, doctor of preventive medicine and physician.

2. This Joint Circular applies to the officials who are doctors, doctors of preventive medicine and physicians.

Article 2. Code classification of title of doctors, doctors of preventive medicine and physicians

1. Group of title of doctor, including:

a) Senior doctor (grade I) Code: V.08.01.01

b) Primary doctor (grade II) Code: V.08.01.02

c) Doctor (grade III) Code: V.08.01.03

2. Group of title of doctor of preventive medicine, including:

a) Senior doctor of preventive medicine (grade I) Code: V.08.02.04

b) Primary doctor of preventive medicine (grade II) Code: V.08.02.05

c) Doctor of preventive medicine (grade III) Code: V.08.02.06

3. Title of physician:

a) Physician of grade IV Code: V.08.03.07

Article 3. Criteria for professional ethics

1. Being dedicated to serving the career of care, protection and improvement of people’s health.

2. Understanding and complying well with the code of conduct of officials of health sector.

3. Practicing profession in accordance with regulation and procedures for technical profession and other regulations of law.

4. Constantly studying to improve level and professional qualification.

5. Respecting patient’s right.

6. Being honest, objective, fair, responsible, solidarity, respectful, and collaborative with colleagues in professional practice.

Chương II

CRITERIA FOR PROFESSIONAL TITLE

Section 1. TITLE OF DOCTOR

Article 4. Senior doctors (grade I) - Code: V.08.01.01

Duties:

a) Health examination and treatment:

Taking charge of organization, health examination and treatment;

Taking charge of management and emergency within specialty and in case of transfer from lower level of hospital;

Taking charge of professional consultation in the assigned field;

Taking charge of monitoring, inspection, assessment and improvement of quality of health examination and treatment within the assigned professional scope.

Developing the system of detection and report on technical and professional errors within the assigned professional scope.

b) Information, communication and education of health:

Taking charge of planning, implementing, assessing and adjusting the plan for consultation, communication and education of health based on the objectives and practical needs.

Developing and taking charge of developing the contents of information, communication and education of health.

c) Taking charge of providing consultation for patients or patient’s family in selecting appropriate medical services;

dd) Taking charge of medical examination, forensic examination or psychiatric forensic examination within relevant specialty or area under regulations of law;

e) Taking charge of professional and technical medical guidelines and implementation of disease and social disease prevention upon assignment;

d) Taking responsibility for management and instructions on use of medical equipment for diagnosis, intervention of treatment and emergency within assigned professional scope;

g) Providing the training and doing medical scientific research:

Taking charge of developing professional materials, formulate technical regulations and procedures within assigned scope;

Organizing or directly providing the training or re-training and taking professional and technical responsibility for professional officials within assigned scope and learners and students;

Taking part in postgraduate instructions and training or improvement of professional and technical level upon requirement;

Taking charge or participating in implementation of scientific research subjects;

Studying and recommending or taking part in formulating strategies, policies and plan for development of carem protection and improvement of people’s health of sectors and localities.

2. Criteria for training and re-training level:

a) Being a doctor of specialist II or doctor of medicine (except for preventive medicine specialty);

b) Having foreign language proficiency Level 4 (B2) or higher as regulated in Circular No. 01/2014/TT-BGDDT dated 24 January 2014 of the Ministry of Education and Training issuing the framework of foreign language competence of 6 levels applied in Vietnam;

c) Having computer level to meet the skills of using basic information technology as regulated in Circular No. 03/2014/TT-BTTTT dated 11 March 2014 of the Ministry of Information and Communications regulating the criteria for skill of using information technology;

d) Having certificate of senior doctor re-training (grade I).

3. Criteria for qualifications:

a) Understanding the viewpoint and policies and laws of Party and State on protection, care and improvement of people’s health; grasping the orientation of specialized technical professional development in the country and the world.

b) Having knowledge and competence in applying the advanced and highly technical methods in diagnosis, treatment and care of patients within specialized area;

c) Having competence of assessing procedures and techniques within specialized area and recommend solutions; assess the result of eveidence-based intervention measures.

d) Having competence of doing research and summarizing reality and recommending solutions or taking part in development of development strategies, policies and plan of sector and area;

dd) Being the chairman or secretary or main participant (50% of time or more) of scientific research subject at ministerial level or equivament or chairman of 02 scientific research subject at basic level or specialized scientific invention with satisfactory acceptance.

e) The official receiving an in-grade promotion from the title of primary doctor (grade II) to the title of senior doctor (grade I) must have the time to hold the title of primary doctor (grade II) or equivalent of at least 06 years, in which the most recent period of holding the title of primary doctor (grade II) is 02 years.

Article 5. Primary doctors (grade II) - Code: V.08.01.02

1. Duties:

a) Health examination and treatment:

Taking charge of or participating in professional consultation within assigned areas;

Organizing or performing health examination and treatment;

Taking charge of management and emergency within specialty and in case of transfer from lower level of hospital;

Detecting and making report on technical and professional errors within assigned professional scope;

Supervising, inspecting, assessing and improving the quality of health examination and treatment within assigned professional scope;

b) Information, communication and education of health:

Defining needs and setting out the contents of instructions and education of health;

Organizing the planning, implementation, assessment and adjustment of consultation, communication and health education plan based on the objectives and practical needs;

Recommending measures of health management within assigned scope.

c) Organizing and performing consultation to patients and patient’s family in choosing appropriate medical services;

d) Operating and using medical equipment for diagnosis, treatment intervention and emergency within the assigned scope;

dd) Organizing medical examination, forensic examination and psychiatric forensic examination within relevant specialty or area under regulations of law;

e) Directly performing or coordinating the participation in professional and technical medical guidelines, implement the prevention and control of diseases and social diseases upon assignment;

g) Providing the training and scientific research:

Developing professional materials, formulating the professional and technical regulations and procedures within the assigned areas;

Directly providing the training and re-training and taking the professional and technical responsibility for professional officials, learners and student upon assignment;

Taking charge of or participating in scientific research

2. Criteria for level of training and re-training:

a) Being a doctor of specialist I or master of medicine or higher level (except for preventive medicine specialty);

b) Having foreign language proficiency Level 3 (B1) or higher as regulated in Circular No. 01/2014/TT-BGDDT dated 24 January 2014 of the Ministry of Education and Training issuing the framework of foreign language competence of 6 levels applied in Vietnam or Having certificate of ethnic language for the working position with required use of ethnic language.

c) Having computer level to meet the skills of using basic information technology as regulated in Circular No. 03/2014/TT-BTTTT dated 11 March 2014 of the Ministry of Information and Communications regulating the criteria for skill of using information technology;

d) Having certificate of primary doctor re-training (grade II).

3. Criteria for professional qualifications:

a) Understanding the viewpoint and policies and laws of Party and State on protection, care and improvement of people’s health; grasping the orientation of specialized technical professional development.

b) Having skills of diagnosis, management, monitoring and prevention of common diseases and specialty emergency;

c) Applying traditional medicine in health examination and treatment;

d) Implementing consultation, education of health, care, protection and improvement of people’s health;

dd) Having ability to gather resources to perform tasks;

e) Being the chairman or secretary or main participant (50% of time or more) of scientific research subject at ministerial level or equivament or chairman of 02 scientific research subject at basic level or specialized scientific invention with satisfactory acceptance.

g) The official receiving an in-grade promotion from the title of doctor (grade III) to the title of primary doctor (grade II) must have the time to hold the title of doctor (grade III) or equivalent of at least 09 years for persons having doctor degree of specialist I or master of medicine; 06 years for persons having doctor degree of specialist II or doctor of medicine or resident degree in which the most recent period of holding the title of doctor (grade III) is 02 years.

Article 6. Doctors (grade III) - Code: V.08.01.03

1. Duties:

a) Health examination and treatment:

Performing examination and treatment of common diseases to patients;

Performing common emergency, timely detection of disease beyond treatment capacity and make report to superior doctors for management or transfer to hospital at higher level or in accordance with specialty areas;

Participating in professional consultation;

Managing and improving the quality of health examination and treatment: detecting and reporting on professional and technical errors, taking part in monitoring, inspection and assessment of quality of health examination and treatment within the assigned professional scope;

b) Information, communication and education of health:

Defining the needs and contents of instructions and education of health;

Performing consultation, communication, education of health; assessment of such acitivities;

Recommending measures of health management within the assigned scope.

c) Providing consultation for patients or patients’ families in choosing appropriate medical services;

d) Operating and using medical equipment for diagnosis, treatment intervention and emergency within the assigned scope;

dd) Taking part in medical examination, forensic examination and psychiatric forensic examination within relevant specialty or area under regulations of law;

e) Participating in professional and technical medical guidelines, implementing the prevention and control of diseases and social diseases upon assignment; taking part in initial health care at lowest medical level;

g) Providing the training and do medical scientific reseach:

Taking part in developing professional materials, formulating technical regulations and procedures within assigned scope;

Providing the instructions for officials and students of medicine specialty;

Taking part in or performing the scientific research subjects.

2. Criteria for training and re-training level:

a) Being a doctor or higher title (except for doctor of preventive medicine);

b) Having foreign language proficiency Level 2 (A2) or higher as regulated in Circular No. 01/2014/TT-BGDDT dated 24 January 2014 of the Ministry of Education and Training issuing the framework of foreign language competence of 6 levels applied in Vietnam or Having certificate of ethnic language for the working position with required use of ethnic language.

c) Having computer level to meet the skills of using basic information technology as regulated in Circular No. 03/2014/TT-BTTTT dated 11 March 2014 of the Ministry of Information and Communications regulating the criteria for skill of using information technology;

3. Criteria for professional qualifications:

a) Understanding the viewpoint and policies and laws of Party and State on protection, care and improvement of people’s health; grasping the orientation of specialized technical professional development.

b) Having skills of diagnosis, management, monitoring and prevention of common diseases and general emergency;

c) Applying traditional medicine in health examination and treatment;

d) Implementing consultation, education of health, care, protection and improvement of people’s health;

dd) Having skills of communication and collaboration with patients and colleagues.

Section 2. TITLE OF DOCTOR OF PREVENTIVE MEDICINE

Article 7. Senior doctor of preventive medicine (grade I) - Code: V.08.02.04

1. Duties:

a) Taking part in and develop contents and make plan for instructions on information, education, communication on protection, care and improvement of health; recommend measures of health management in community;

b) Taking part in implementing the contents of initial health care;

c) Taking part in and implement the regulations on professional responsibility as prescribed by the Ministry of Health, particularly:

Formulating the professional plan for preventive medicine: prevention and control of diseases and social diseases, management of programs of health, communication and education of health, labor health, occupational diseases and accident injuries.

Performing the monitoring, detection, assessment, control: risk factors of disease, pathogens, occupational diseases, environment-related diseases, accident injuries, food safety, occupational health and other risk factors for community health;

Implementing the measures to control diseases, infectious agents causing diseases especially the emerging outbreak;

Preventing and controlling noncommunicable diseases, traffic accidents, occupational accidents and occupational diseases;

Taking part in management and care in community: chronic diseases, occupational diseases, social diseases and rehabilitation.

Performing examination and treatment of common diseases and initial emergency;

Performing examination, consultation and preventive treatment under regulations;

d) Taking part in analysis, assessment and conclusion of dificult and complex medical professional issues related to community health within the assigned work and health sector and area upon requirement;

dd) Taking charge of developing materials and technical and professional procedures for disease prevention and control and care of community health;

e) Providing the direction or directly Providing the technical instructions and training and re-training for officials and students of medical specialty; Taking part in teaching students in universities or colleges upon required;

g) Taking charge of or participating in scientific research subjects.

2. Criteria for training and re-training level:

a) Being a doctor of specialist II or doctor of medicine of preventive medicine specialty;

b) Having foreign language proficiency Level 4 (B2) or higher as regulated in Circular No. 01/2014/TT-BGDDT dated 24 January 2014 of the Ministry of Education and Training issuing the framework of foreign language competence of 6 levels applied in Vietnam;

c) Having computer level to meet the skills of using basic information technology as regulated in Circular No. 03/2014/TT-BTTTT dated 11 March 2014 of the Ministry of Information and Communications regulating the criteria for skill of using information technology;

d) Having certificate of training for senior doctor of preventive medicine (grade I).

3Criteria for professional qualifications:

a) Understanding the viewpoint and policies and laws of Party and State on protection, care and improvement of people’s health; grasping the orientation of specialty development in the country and the world.

b) Being capable of determining the impact factors of the natural, social and occupational environment affecting human health, recommend measures of intervention and prevention of risks for community health;

c) Being capable of formulating strategic plans, assessing policies, systems and operating structures in the field of preventive medicine;

d) Being capable of integration, mobilization and interdisciplinary coordination for duty performance;

dd) Being capable of scientific research and doing scientific research;

e) Being the chairman or secretary or main participant (50% of time or more) of scientific research subject at ministerial level or equivament or chairman of 02 scientific research subject at basic level or specialized scientific invention with satisfactory acceptance.

g) The official receiving an in-grade promotion from the title of primary doctor of preventive medicine (grade II) to the title of senior doctor of preventive medicine (grade I) must have the time to hold the title of primary doctor of preventive medicine (grade II) or equivalent of at least 06years in which the most recent period of holding the title of primary doctor of preventive medicine (grade II) is 02 years.

Article 8. Primary doctors of preventive medicine (grade II) - Code: V.08.02.05

1. Duties:

a) Making plans, implementing, inspecting and monitoring the activities of information, education and communication on protection, care and improvement of health; managing the community health and recommending measures of health management in community;

b) Implementing the medical guidelines and the contents of initial healthcare;

c) Implementing the regulations on professional responsibility as prescribed by the Ministry of Health, particularly:

Formulating plans for professional operation on preventive medicine: disease and social disease prevention, management of health program, communication and education of health, occupational health and occupational disease and accident injuries;

Monitoring, supervising, detecting, assessing and controlling: risk factors of disease, pathogens, occupational diseases, environment-related diseases, accident injuries, food safety, occupational health and other risk factors for community health;

Recommending and implementing the measures to control diseases, infectious agents causing diseases especially the emerging outbreak;

Preventing and controlling noncommunicable diseases, traffic accidents, occupational accidents and occupational diseases;

Taking part in management and care in community: chronic diseases, occupational diseases, social diseases and rehabilitation.

Performing examination and treatment of common diseases and initial emergency;

Performing examination, consultation and preventive treatment under regulations;

d) Taking part in analysis, assessment and conclusion of preventive medical professional issues upon requirement;

dd) Providing the technical instructions, training and re-training for medical officials and students;

e) Taking charge of or implement the scientific research subjects.

2. Criteria for training and re-training level:

a) Being a doctor of specialist I or master of medicine or higher of preventive medicine specialty;

b) Having foreign language proficiency Level 3 (B1) or higher as regulated in Circular No. 01/2014/TT-BGDDT dated 24 January 2014 of the Ministry of Education and Training issuing the framework of foreign language competence of 6 levels applied in Vietnam or Having certificate of ethnic language for the working position with required use of ethnic language.

c) Having computer level to meet the skills of using basic information technology as regulated in Circular No. 03/2014/TT-BTTTT dated 11 March 2014 of the Ministry of Information and Communications regulating the criteria for skill of using information technology;

d) Having certificate of training for doctor of preventive medicine (grade II).

3. Criteria for professional qualifications:

a) Understanding the viewpoint and policies and laws of Party and State on protection, care and improvement of people’s health; grasping the orientation of specialty development in the country and the world.

b) Being capable of determining the impact factors of the natural, social and occupational environment affecting human health;

c) Being capable of recommending measures of intervention, make plans for care, protection and improvement of comprehensive and continuous health for individuals, families, community and environmental protection;

d) Being capable of implementation and assessment of contents of initial healthcare, national target program on health and health management, occupational diseases, prevention and control of accident injuries and building of safe community;

dd) Being capable of supervision and assessment of environmental impact and recommendation of measures to prevent and control environmental pollution;

e) Being capable of timely detection of outbreak and participation in disease prevention and control and detection of issues on nutrition, food safety in community and recommendation of suitable solutions;

g) Being capable of integration, mobilization and interdisciplinary coordination for duty performance;

h) Being the chairman or secretary or main participant (50% of time or more) of scientific research subject at basic level or higher or scientific invention or technical improvement initiative of specialized area with satisfactory acceptance.

i) The official receiving an in-grade promotion from the title of doctor of preventive medicine (grade III) to the title of primary doctor of preventive medicine (grade II) must have the time to hold the title of doctor of preventive medicine (grade III) or equivalent of at least 09 years for persons having doctor degree of specialist I or master of medicine; 06 years for persons having doctor degree of specialist II or doctor of medicine or resident degree in which the most recent period of holding the title of doctor (grade III) is 02 years.

Article 9. Doctors of preventive medicine (grade III) - Code: V.08.02.06

1. Duties:

a) Providing the information, education, communication on protection, care and improvement and management of health and recommend measures of health management in community;

b) Implementing the medical guidelines and the contents of initial healthcare;

c) Taking part in and implement the regulations on professional responsibility as prescribed by the Ministry of Health, particularly:

Formulating the professional plan for preventive medicine: prevention and control of diseases and social diseases, management of programs of health, communication and education of health, labor health, occupational diseases and accident injuries.

Performing the monitoring, detection, assessment, control: risk factors of disease, pathogens, occupational diseases, environment-related diseases, accident injuries, food safety, occupational health and other risk factors for community health;

Implementing the measures to control diseases, infectious agents causing diseases especially the emerging outbreak;

Preventing and controlling noncommunicable diseases, traffic accidents, occupational accidents and occupational diseases;

Taking part in management and care in community: chronic diseases, occupational diseases, social diseases and rehabilitation.

Performing examination and treatment of common diseases and initial emergency;

Performing examination, consultation and preventive treatment under regulations;

d) Providing the technical instructions, training and re-training for medical officials and students within specialty;

dd) Taking part in scientific research.

2. Criteria for training and re-training level:

a) Being a general practitioner or doctor of preventive medicine specialty or higher;

b) Having foreign language proficiency Level 2 (A2) or higher as regulated in Circular No. 01/2014/TT-BGDDT dated 24 January 2014 of the Ministry of Education and Training issuing the framework of foreign language competence of 6 levels applied in Vietnam or Having certificate of ethnic language for the working position with required use of ethnic language.

c) Having computer level to meet the skills of using basic information technology as regulated in Circular No. 03/2014/TT-BTTTT dated 11 March 2014 of the Ministry of Information and Communications regulating the criteria for skill of using information technology;

3. Criteria for professional qualifications:

a) Understanding the viewpoint and policies and laws of Party and State on protection, care and improvement of people’s health;

b) Being capable of determining the impact factors of the natural, social and occupational environment affecting human health;

c) Being capable of recommending measures of proper management, make plans for care, protection and improvement of comprehensive and continuous health for individuals, families, community and environmental protection;

d) Being capable of implementation and assessment of contents of initial healthcare, national target program on health and health management, occupational diseases, prevention and control of accident injuries and building of safe community;

dd) Being capable of timely detection of outbreak and participation in disease prevention and control and detection of issues on nutrition, food safety in community and participation in disease prevention and control;

e) Being capable of participating in scientific research;

g) Having skills in effective cooperation and coordination with sectors, organizations and international organizations for duty performance.

Section 3. TITLE OF PHYSICIAN

Article 10. Physicians (grade IV) - Code: V.08.03.07

1. Duties:

a) Disseminating, mobilizing and implementing protessional measures on protection of mother and child health and family planning ;

b) Taking part in first aid, common health examination and treatment to people at health stations and manage community health in the assigned areas ;

c) Formulating action plans and choose prioritized medical professional program within the assigned area.

d) Preparing medication box, providing the instructions on safe and proper use of medication, planing the management of medication sources; developing the Vietnamese traditional medicine, combining the application of traditional medicine in disease prevention and treatment ;

dd) Detecting and promptly reporting on disease, outbreak, pathogens, risk factors of disease for community health;

e) Participating in prevention and control of disease and taking measures of risk prevention for community health;

g) Managing health indicators, pregnancy management and patients with chronical disease as indicated by doctor in community and agrregate reports and supplying information promptly and correctly as prescribed by law.

h) Providing the the technical and professional knowledge for healthcare workers at hamlets, villages and health/population collaborators in community ;

i) Giving advice to the communal, ward or town authorities and the competent authorities in managing and implementing the contents of initial healthcare and professional contents of key medical program at localities ;

2. Criteria for training and re-training level:

a) Be a physician of intermediate level;

b) Having foreign language proficiency Level 1 (A1) or higher as regulated in Circular No. 01/2014/TT-BGDDT dated 24 January 2014 of the Ministry of Education and Training issuing the framework of foreign language competence of 6 levels applied in Vietnam or Having certificate of ethnic language for the working position with required use of ethnic language.

c) Having computer level to meet the skills of using basic information technology as regulated in Circular No. 03/2014/TT-BTTTT dated 11 March 2014 of the Ministry of Information and Communications regulating the criteria for skill of using information technology;

3. Criteria for professional qualifications:

a) Understanding the viewpoint and policies and laws of Party and State on protection, care and improvement of people’s health;

b) Defining the symptoms of common diseases and factors affecting the community health;

c) Detecting, intervening and preventing the factors affecting the community health;

d) Having skills of organization, implementation and monitoring of contents of initial healthcare and management of health and occupational diseases ;

dd) Having skills of organization, implementation and assessment of activities of medical national target project and program ;

e) Having skills of cooperation and team work and coordination with organizations and associations in duty performance.

Chapter III

INSTRUCTIONS ON APPOINTMENT AND SALARYING AS PER PROFESSIONAL TITLE SPECIFIED IN THIS JOINT CIRCULAR

Article 11. Principles of appointment and salarying as per professional title for officials

1. The appointment to professional title for officials specified in this Joint Circular must be based on job position and assigned duties of such officials and under the provisions in Article 12 of this Joint Circular.

2. When being appointed from the current scale of official to the title of doctor, doctor of preventive medicine, the respective physician shall not receive the increase of salary scale or promotion of title of official.

Article 12. Cases of appointment to professional title

The officials who have been appointed to the scale of doctor and physician under the provisions in Decision No. 415/TCCP-VC dated 29 May 1993 of the Minister – Head of Organization-Personnel Department (now the Ministry of Home Affairs) on issuing the professional criteria for scale of official of health sector; Decision No. 78/2004/QD-BNV dated 03 November 2004 of the Minister of Home Affairs on issuing the list of scale of public servants and officials now are appointed to the title of doctor, doctor of preventive medicine and physician specified ini this Joint Circular as follows:

1. Title of doctor :

a) Appointing the title of senior doctor (grade I), Code V.08.01.01 for officials currently holding the scale of senior doctor (Code 16.116);

b) Appointing the title of primary doctor (grade II), Code V.08.01.02 for officials currently holding the scale of primary doctor (Code 16.117);

c) Appointing the title of doctor (grade III), Code V.08.01.03 for officials currently holding the scale of doctor (Code 16.118);

2. Title of doctor of preventive medicine :

a) Appointing the title of senior doctor of preventive medicine (grade I), Code V.08.02.04 for officials currently working in the field of preventive medicine and holding the scale of senior doctor (Code 16.116);

b) Appointing the title of primary doctor of preventive medicine (grade II), Code V.08.02.05 for officials currently working in the field of preventive medicine and holding the scale of primary doctor (Code 16.117);

c) Appointing the title of doctor of preventive medicine (grade III), Code V.08.02.06 for officials currently working in the field of preventive medicine and holding the scale of doctor (Code 16.118);

3. Appointing the title of physician (grade IV), Code V. 08.03.07 for officials currently holding the scale of physician (Code 16.119);

Article 13. Salarying

1. The titles of doctor, doctor of preventive medicine and physician specified in this Joint Circular are entitled to application of professional payroll for cadres and officials in the State non-business units (Table 3) issued with Decree No. 204/2004/ND-CP dated 14 December 2004 of the Government on regulations on salary for cadres, public servants, officials and armed forces, particularly as follows :

a) The title of senior doctor (grade I), the title of senior doctor of preventive medicine (grade I) are entitled to the application of salary scale of official of type A3 (group A3.1), from salary ratio between 6.20 and 8.00;

b) The title of primary doctor (grade II), the title of primary doctor of preventive medicine (grade II) are entitled to the application of salaray scale of official of type A2 (group A2.1), from salary ratio between 4.40 and 6.78;

c) The title of doctor (grade III), the title of doctor of preventive medicine (grade III) are entitled to the application of salaray scale of official of type A1, from salary ratio between 2.34 and 4.98;

d) The title of physician is entitled to application of salaray scale of official of type B, from salary ratio between 1.86 and 4.06;

2. The salarying of titles of official specified in Clause 1 of this Article for officials who have been salaried in the scales of doctor and physician as prescribed in Decision No. 78/2004/QD-BNV dated 03 November 2004 of the Minister of Home Affairs on issuing the list of scales of public servant and official and Decree No. 204/2004/ND-CP dated 14 December 2004 of the Government on salary regulation for cadres, public servants, officials and armed forces is done as follows :

The officials qualified for appointment to the title of doctor, doctor of preventive medicine and physician with ratio of salary scale equal to that of previous scale shall be salaried with the same salary scale and % of extra-seniority allowance (if any) received in the previous scale (including the calculation of time to consider the increase in salary scale for the next time or extra-seniority allowance if any in the previous scale) in the appointed professional title.

Ex : Mrs Nguyen Thi A has scale of doctor (Code 16.118), 4th grade, salary ratio 3.33 from 01 February 2013. Now she is qualified and is appointed to the title of doctor of preventive medicine (grade III), Code V.08.02.06, then, her salary ratio 3.33, 4th grade of the title of doctor of preventive medicine (grade III) is effective from the date of decision signing. The time to consider the increase in salary scale for the next time is from 01 February 2013.

3. The in-grade promotion of title for officials who are doctors, doctors of preventive medicine is done after they are appointed by the competent authorities to the title of doctor and doctor of preventive medicine specified in this Joint Circular and are salaried as guided in Clause 1, Section II of Circular No. 02/2007/TT-BNV dated 25 May 2007 of the Ministry of Home Affairs providing instructions on salarying upon scale increase, scale shift and switching of types of public servant and official.

Chapter IV

IMPLEMENTATION PROVISION

Article 14. Effect

1. This Joint Circular Takings effect from 16 July 2015.

2. Annulling the professional criteria for doctor and physician scale specified in Decision No. 415/TCCP-VC dated 29 May 1993 of the Minister - Head of Organization-Personnel Department on issuing the professional criteria for scale of public servant of health sector.

3. Annulling the provisions on list of doctor and physician scale issued with Decision No. 78/2004/QD-BNV dated 03 November 2004 of the Minister of Home Affairs on issuing the list of public servant and official scales.

Article 15. Transitional provision

The officials who have been appointed to the doctor and physician scales under the provisions in Decision No. 415/TCCP-VC dated 29 May 1993 of the Minister - Head of Organization-Personnel Department on issuing the professional criteria for public servant scale of the health sector; Decision No. 78/2004/QD-BNV dated 03 November 2004 of the Minister of Home Affairs on issuing the list of scales of public servant and official now are appointed to the title of doctor, doctor of preventive medicine and physician specified in this Joint Circular, the organ having the authority to manage and employ such officials are responsible for create conditions for them to supplement the missing criteria of appointed title of doctor, doctor of preventive medicine and physician.

Article 16. Implementation organization

1. This Joint Circular is the ground to carry out the recruitment, employment and management of contingent of doctors, doctors of preventive medicine and physicians in the public medical facilities.

2. The non-public medical facilities may apply the provisions in this Joint Circular for recruitment, employment and management of contingent of doctors, doctors of preventive medicine and physicians at their medical facilities;

3. The Heads of public medical facilities directly managing and employing officials are responsible for:

a) Reviewing the working positions at their units, formulating plans for appointment of title of doctors, doctors of preventive medicine and physicians under their management to be submitted to the competent authorities for consideration, decision or issuing decisions under decentralized authority.

b) Deciding the appointment of title of doctors, doctors of preventive medicine and physicians under their management to the respective title of doctors, doctors of preventive medicine and physicians under their authority or decentralization or authorization after the plan for appointment of professional title is approved by the competent authorities.

4. The Ministries, ministerial-level organs, governmental organs, People’s Committee of provinces and centrally-run cities are responsible for:

a) Directing the units under their management to carry out the appointment of professional titles, salarying for doctors, doctors of preventive medicine and physicians in the public medical facilities;

b) Approving the plans for appointment of title of doctors, doctors of preventive medicine and physicians in the public medical facilities under their management from the current scale of official to the respective titles of doctor, doctor of preventive medicine and physician specified in this Joint Circular ; settling under their authority all problems during appointment of professional titles and salarying;

c) Deciding the appointment of professional titles and salarying for doctors, doctors of preventive medicine and physicians under their management to the respective titles of doctors, doctors of preventive medicine and physicians in the public medical facilities under their authority.

d) Making report on result of appointment of professional titles and salarying for doctors, doctors of preventive medicine and physicians in the public medical facilities under their management to be submitted to the Ministry of Health and the Ministry of Home Affairs.

Article 17. Responsibility for implementation

1. Ministers, Heads of ministerial-level agencies, heads of governmental organs; Chairman of the People's Committees of provinces and centrally-run cities and organs, organizations and individuals concerned are liable to execute this Joint Circular.

2. Any problem or difficulty arising during the implementation should be promptly reported to the Ministry of Health for aggregation and in collaboration with the Ministry of Home Affairs for review and settlement./.
