The Circular No. 272/CLTY-CL dated January 31, 2008 guiding the implementation of the Decision No. 01/2008/QD-BNN and at the request of a number of enterprises producing and trading fish for further clarification of some guidelines, the Department for Quality Management of Agricultural, Forestry and Fishery Products hereby replies as follows:
1. Some contents of the Circular No. 272/CLTY-CL dated January 31, 2008 are amended as follows:
1.1. Table 1 in Point 3.1.1 is annulled and replaced with the Table 1 below:

When pangasius fish is exported to the markets that do not require the name of pangasius fish to be written, Vietnam’s regulations shall apply. |

2. The other problems related to the implementation of the Decision No 01/2008/QD-BNN dated January 04, 2008:
Regarding the proposal that FDA codes should be added on goods labels:
In addition to the required information as specified in Section 1.1 of this Dispatch, the enterprises may add other information (For example: FDA codes issued) under the provisions of the import market, or at the request of the clients, provided such additional information does not affect the nature of the product inside.
Regarding the proposal that labeling of small packages should not be obligatory:
According to the regulations in Clause 3, Article 5 of the Decree No 89/2006/ND-CP dated August 30, 2006: in case the importer of goods from Vietnam requests that goods be labeled in accordance with the sale contract and take responsibility for such request, the enterprise can comply with this contract as long as such request does not affect the nature of the goods, does not violate the laws of Vietnam and the laws of the importing country.
