PLAN
THE PEAK YEAR FOR INSPECTION OF AGRICULTURAL MATERIALS
I. OBJECTIVES AND REQUIREMENTS
1. Objectives:
- Effectively prevent and facilitate the definite handling of violations against regulations on production, trading and use of antibiotics in breeding and aquaculture; pesticides, organic fertilizer and other fertilizers which are fake, smuggled or have poor quality or unclear origin.
- Prevent violations against regulations on banned substances used in breeding.
- Improve awareness of organizations and individuals of production, trading and use of cattle-feed, the harm of antibiotics used in breeding and aquaculture, pesticides, organic fertilizer and other fertilizers to human health, and impact of those on agricultural production.
2. Requirements:
- Clearly assign responsibilities of relevant agencies and units (Ministry’s inspectorate; general departments and departments; police authorities; departments of agriculture and rural development, sectorial sub-departments affiliated to those departments) for developing and implementing the Plan in effective manner.
- Establish a systematic and consistent cooperation mechanism between central and local sectorial agencies in organizing the implementation of the Plan.
- Expedite, instruct and resolve difficulties that arise during the implementation of this Plan.
- Partially and wholly sum up the implementation results of this Plan to get experience thereof in effective and timely manner.
II. SCOPE, INSPECTED ENTITEIS AND INSPECTION PERIOD
1. Scope:
- Carry out the inspection of agricultural materials, in which the inspection of the production, trading and use of banned substances in breeding; improper production of antibiotics used in breeding and aquaculture; fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin shall be focused on.
- This Plan shall be implemented nationwide (63 provinces or central-affiliated cities), in which, central-affiliated agencies shall focus on implementation of the Plan in key regions to learn experience from thereof for implementing in a large scale.
2. Entities:
- Producers and sellers of cattle-feed; antibiotics used in breeding and aquaculture; pesticides, organic fertilizer and other fertilizers under the competence of agriculture and rural development authority (hereinafter referred to as agricultural materials);
- Cattle and poultry farms and aquaculture establishments.
- Producers, processers and sellers of animals and animal by-products (including aquatic products).
- Importers, transporters and sellers of banned substances in breeding and antibiotics used in breeding and aquaculture inconsistently with prevailing laws.
3. Inspection period:
Uninterruptedly: From March 01, 2016 to December 31, 2016
III. INSPECTION CONTENTS AND MEASURES
1. Propagate and disseminate laws to sectorial authorities, producers, traders, users, transporters and consumers with respect to harms, rights and responsibilities as referred to in Articles 190, 191, 195, 317 of the Criminal Code in 2015.
2. Strengthen state management of production, trading and use of kinds of agricultural materials; make amendments and supplements to legislative documents according to actual situation.
3. Mainly conduct unscheduled inspection to discover and handle violations committed by entities in a timely manner in order to improve efficiency of state management task.
IV. IMPLEMENTATION ORGANIZATION
1. Resources:
- Ministry of Agriculture and Rural Development shall provide funding to implement operational measures and inspection activities led by Ministry Inspectorate, general departments and departments. Accordingly, Financial Department shall check and grant additional funding to central-affiliated agencies and units to implement the Plan.
+ Assigned agencies and units shall be responsible for mobilizing internal resources to implement assigned contents of the Plan.
+ Sectorial general departments/departments shall cover expenditures for sampling and analysis.
- People’s committees of central-affiliated cities or provinces shall instruct sectorial agencies to provide funding to departments of agriculture and rural development and relevant units to implement operational measures and inspection activities, and other activities included in this Plan.
- Other resources mobilized from projects (if any).
2. Implementation (detailed plan enclosed hereto):
a) Affiliates of Ministry of Agriculture and Rural Development
- Agencies in charge of formulating the Plan must develop it in detailed for implementation.
- Ministry’s inspectorate, Directorate of Fisheries, the Department of Livestock production, Department of Animal Health and Department of Crop Production shall cooperate with the Police Department for environment-related crime prevention and control (C49) to make reconnaissance, investigation and collection of information to discover rings, production, trading and use of banned substances in breeding, and antibiotics in breeding and aquaculture inconsistently with the laws; fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin. Inspections shall be conducted to discover and strictly handle acts of violation.
- Coordinate with relevant departments/regulatory bodies/unions to strengthen propaganda activities to people to avoid using banned substances; discover, denounce and combat against entities that deliberately produce, trade and use banned substances, fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin.
- Use portal, articles and hotlines of the Ministry Inspectorate in an effective manner; provide accurate information to news and press agencies in a timely and effective way.
- Check and propose in-charge authorities to make amendments to legislative documents to meet and fulfill requirements and duties.
b) Departments of Agriculture and Rural Development of provinces or cities
- Departments of Agriculture and Rural Development shall instruct relevant units to set up detailed plans in implementation of this Plan.
- Coordinate with relevant departments/regulatory bodies/unions to strengthen propaganda activities to people to avoid using banned substances; discover, denounce and combat against entities that deliberately produce, trade and use banned substances, fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin.
- Coordinate with police departments, especially the Police Department for environment-related crime prevention and control (PC49), to make reconnaissance, investigation and collection of information to discover rings, production, trading and use of banned substances in breeding, and antibiotics in breeding and aquaculture inconsistently with the laws; fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin. Inspection shall be conducted to discover and strictly handle acts of violation.
- Arrange resources and provide funding to implement assigned duties.
3. Information provision and reporting:
- Departments of agriculture and rural development shall, on a regular basis, report to the Ministry Inspectorate of the Plan implementation results, and coordinate with the same to handle cases ultra vires.
- The Ministry Inspectorate shall send aggregated reports to the Minister on a monthly basis.
- Difficulties that arise during the implementation of this Plan should be reported to the Ministry (via the Ministry Inspectorate) for consideration.
