RESOLUTION

ON THE RATIFICATION OF THE UNITED NATIONS CONVENTION AGAINST TORTURE AND OTHER CRUEL, INHUMAN OR DEGRADING TREATMENT OR PUNISHMENT

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Law No. 41/2005/QH11 on Conclusion of Accession to, and Implementation of Treaties;

At the proposal of the President in Report No. 03/TTr-CTN of September 18, 2014, on the ratification of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment;

After considering the Government’s Report No. 344/BC-CP of September 25, 2014, the National Assembly External Affairs Committee’s Verification Report No. 4527/BC-UBDN13 of October 21, 2014, the Government’s Report No. 498/BC-CP of November 18, 2014, and opinions of National Assembly deputies;

RESOLVES:

Article 1.

To ratify the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which the Socialist Republic of Vietnam signed on November 7, 2013, at the United Nations Headquarters in New York.

Article 2.

To preserve provisions in Article 20 and Clause 1 of Article 30 of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

Clause 2 of Article 8 of the Convention shall not be regarded as a direct legal ground for extradition. Extradition must be carried out in accordance with Vietnam’s law on the basis of extradition agreements which Vietnam has signed or accessed to or in the principle of reciprocity.

Article 3.

The Socialist Republic of Vietnam shall build and improve its legal system in conformity with the provisions of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

Article 4.

The Government, the Supreme People’s Court, the Supreme People’s Procuracy and concerned agencies and organizations shall, within the ambit of their tasks and powers, organize the implementation of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

Article 5.

The National Assembly Standing Committee, the Ethnic Council, the Committees of the National Assembly and National Assembly deputies shall supervise the implementation of this Resolution.

This Resolution was adopted on November 28, 2014, by the XIII^th National Assembly of the Socialist Republic of Vietnam at its 8^th session.-
