CIRCULAR

PROMULGATING LIST OF VETERINARY DRUGS PERMITTED TO BE MARKETED AND BANNED FROM USE IN VIETNAM, AND ANNOUNCEMENT OF HS CODES OF IMPORTED VETERINARY DRUGS PERMITTED TO BE MARKETED IN VIETNAM

Pursuant to the Government's Decree No. 199/2013/ND-CP dated November 26, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Agriculture and Rural development;

Pursuant to the Law on veterinary medicine 2015;

Pursuant to the Government's Decree No. 187/2013/ND-CP dated November 20, 2013 on guidelines for the Law on Commerce on international trade and operations of agents, purchase, sale, processes and good transit with foreign countries;

At the request of the Director of the Department Of Animal Health;

The Minister of Agriculture and Rural development promulgates a list of veterinary drugs permitted to be marketed and banned from use in Vietnam and announcement of HS codes of imported veterinary drugs permitted to be marketed in Vietnam.

Article 1. Issued together with this Circular:

1. A list of veterinary drugs permitted to be marketed in Vietnam in Appendix I.

2. A list of veterinary drugs banned from use in Vietnam in Appendix II.

3. A list of HS codes of imported veterinary drugs permitted to be marketed in Vietnam, Appendix IB and Part B of Appendix IC

Article 2. Transitional provisions:

1. Any of the products prescribed in Part C of Appendix IC whose marketing authorization is expired in the period from the effective date of this Circular to January 31, 2017 is permitted to be marketed until January 31, 2017.

After January 31, 2017, each facility, wishing to continue marketing the aforesaid products, shall apply for re-registration as prescribed by law on management of environmental remediation and treatment products used in aquaculture within 3 months from the effective date of this Circular. Directorate of Fisheries shall process such application.

2. Any of the products prescribed in Part C Appendix IC which does not fall to the case prescribed in Clause 1 of this Article is permitted to be marketed within the period specified in its marketing authorization. Each facility wishing to apply for re-registration shall follow the procedures as prescribed by law on management of environmental remediation and treatment products used in aquaculture.

Article 3. Effect

1. This Circular takes effect from July 16, 2016.

2. This Circular replaces the following Circulars: Circular No. 15/2009/TT-BNN of March 17, 2009 promulgating the list of drugs, chemicals, antibiotics banned from uses, limited to use; Circular No. 29/2009/TT-BNN dated June 4, 2009 on amendments to Circular No. 15/2009/TT-BNN of March 17, 2009 promulgating the list of drugs, chemicals, antibiotics banned from uses, limited to use; Circular No. 20/2010/TT-BNNPTNT dated April 2, 2010 on amendments to Circular No. 15/2009/TT-BNN of March 17, 2009 promulgating the list of drugs, chemicals, antibiotics banned from uses, limited to use; Circular No. 03/2012/TT-BNNPTNT dated January 16, 2012 on amendments to Circular No. 15/2009/TT-BNN of March 17, 2009 promulgating the list of drugs, chemicals, antibiotics banned from uses, limited to use; Circular No. 25/2012/TT-BNNPTNT dated June 22, 2012 promulgating the list of veterinary drugs, bioproducts, microorganisms, and chemicals used in aquaculture veterinary medicine permitted to be marketed in Vietnam; Circular No. 28/2013/TT-BNNPTNT dated May 31, 2013 promulgating the list of veterinary drugs permitted to be marketed in Vietnam.

Article 4. The Chief of the Ministry Office, the Director of the Department Of Animal Health, Heads of units affiliated to Ministries, Directors of Services of Agriculture and Rural development of provinces and central-affiliated cities, and relevant organizations and individuals shall implement this Circular./.
