CIRCULAR
STIPULATING THE IMPORT OF GOODS OF THE LIST OF MANAGEMENT OF EXPORT AND IMPORT UPON TARIFF QUOTA IN 2011
Pursuant to the Decree No.189/2007/ND-CP dated December 27, 2007 of the Government stipulating functions, tasks, power and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Decree No.12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Commerce on activities of buying and selling international commodities and agent activities including purchasing, selling, sourcing, outsourcing, border-gate transfer, and transiting of commodities with foreign countries;
Pursuant to the circular No.04/2006/TT-BTM dated April 6, 2006 of the Ministry of Trade (Ministry of Industry and Trade for now) guiding some contents specified in Decree No.12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Commerce on activities of buying and selling international commodities and agent activities including purchasing, selling, sourcing, outsourcing, border-gate transfer, and transiting of commodities with foreign countries;
To implement the Prime Minister’s directive opinion at the Official Dispatch No.9523/VPCP-KTTH dated December 30, 2010 on administration of goods import upon tariff quota;
After consulting with the Ministry of Agriculture and Rural Development and Ministry of Finance;
Ministry of Industry and Trade stipulates the import of goods of the list of management of export and import upon quota in 2011 as follows,

Article 2. Principle to grant permit of importing goods upon tariff quota
1. Traders are allocated import tariff quotas of salt, sugar, raw material tobacco and poultry eggs as prescribed in the Circular No.04/2006/TT-BTM dated April 6, 2006 of Ministry of Commerce (Ministry of Industry and Trade for now), guiding a number of contents provided in Decree No.12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of the Commercial Law on activities of buying and selling international commodities and agent activities including purchasing, selling, sourcing, outsourcing, border-gate transfer, and transiting of commodities with foreign countries.
2. The Ministry of Industry and Trade allocates import tariff quotas of 100,000 tons of industrial salt to traders directly using as raw materials for chemicals production and 2,000 tons of pure salt to the traders directly using as raw materials for production of drugs, medical products.
3. The Ministry of Industry and Trade allocates import tariff quotas of 150,000 tons of refined sugar and raw sugar to traders directly using sugar as raw materials for production, 50,000 tons of raw sugar to a number of sugar plants to refine and 50,000 tons of refined sugar to a number of traders to supplement the supply to the market.
Article 3. Effect
This Circular takes effect on January 01, 2011 and shall be invalid after December 31, 2011.
