DECISION

ON APPROVAL FOR PLANNING FOR REST AREAS ALONG MAIN ROUTES OF HO CHI MINH STREET

THE MINISTER OF TRANSPORT

Pursuant to the Government’s Decree No.107/2012/ND-CP defining functions, rights, responsibilities and organizational structure of the Ministry of Transport;

Pursuant to the Resolution No.66/2013/QH13 dated November 29, 2013 by the National Assembly on adjustments to a number of aspects and measures for effectively implementing the investment policy on construction of Ho Chi Minh Street stipulated in the Resolution No.38/2004/QH11;

Pursuant to the Decision No.356/2013/QD-TTg on approval for adjustments to road traffic development planning to the year 2020 and orientation towards 2030 dated February 25, 2013 by the Prime Minister;

Pursuant to the Decision No.242/QD-TTg on Ho Chi Minh Street master plan dated February 15, 2007 by the prime Minister;

Pursuant to the Decision No.194/QD-TTg on approval for Ho Chi Minh Street detailed planning dated December 15, 2010 by the Prime Minister;

Pursuant to the Decision No.371/QD-TTg on approval for detailed planning for level crossings connecting to Ho Chi Minh Street dated April 03, 2012 by the Prime Minister;

Pursuant to the Circular No.48/2012/TT-BGTVT dated November 15, 2012 by the Minister of Transport on introduction of national technical regulation on roadside stations (QCVN43:2012/BGTVT);

Pursuant to the Decision No.2753/QD-BGTVT dated September 10, 2013 by the Minister of Transport on approval for planning for rest area construction along national highways to the year 2020 and orientations towards 2030;

Pursuant to the Decision No. 3029/QD-BGTVT on assignment of preparation for planning for rest area construction along main routes of Ho Chi Minh project.

In consideration of the written request No.1459/DHCM-TTr dated August 12, 2013; Document No.2746/DHCM-KTDA dated December 20, 2013 and Document No.600/DHCM-KTDA dated March 17, 2014 by the Project management Board of Ho Chi Minh Street Project;

At request of the Director of the Department of Planning and Investment and the appraisal report No.502/KHDT dated April 26, 2014.

HREBY DECIDES:

Article 1. To approve the planning for rest areas along main routes of the Ho Chi Minh Street Project (hereinafter referred to as "rest area planning") as follows:

1. Standpoints

The standpoint of the rest area planning shall be conformable to those of the master plan for rest areas along national highways Government Inspectorate 2020 and orientations towards 2030 approved by the Ministry of Transport via the Decision No.2753/QD-BGTVT dated September 10, 2013.

2. Purposes

To construct modern and convenient rest areas under the appropriate technical regulation and according to the investment stage with the aim of meeting the need of passengers, means of transport and drivers, effectively utilizing the Ho Chi Minh Street, promoting the socio-economic development and improving traffic safety.

3. Planning contents

3.1. Scope of planning

Rest areas shall be constructed in provinces where Ho Chi Minh City crossing, namely Cao Bang, Bac Kan, Tuyen Quang, Phu Tho, Ha Noi, Hoa Binh, Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Danang, Quang Nam, KonTum, Gia Lai, Daklak, Dak Nong, Binh Phuoc, Tay Ninh, Long An, Dong Thap, Kien Giang and Ca Mau.

3.2. Requirements for location of rest areas:

Rest areas shall be located in accordance with the Decision No.2753/QD-BGTVT dated September 10, 2013 by the Minister of Transport on approval for master plan for rest areas along national highways to the year 2020 and orientations towards 2030;

3.3. List of rest areas along Ho Chi Minh Street and planning scale

There shall be 57 rest areas along the Ho Chi Minh Street with the total area of 326 ha. (Refer to the Annex for detailed scale and location)

3.4. Investment stages

- 2014-2020: Invest in construction of 10 to 20 rest areas in places with high traffic density and or those far from cities.

- 2021-2030: Invest in construction of all expected rest areas along the whole Ho Chi Minh Street under the approved planning to meet the need of transportation and road users.

4. Investment attraction policies

The investment shall be mobilized in accordance with the Decision No.2753/QD-BGTVT dated September 10, 2013 by the Minister of Transport on approval for master plan for rest area construction along national highways to the year 2020 and orientations towards 2030;

5. Implementation organizations

The Project Management Board of Ho Chi Minh Street Project shall actively provide necessary information and cooperate with designated agencies stipulated in the Decision No.2753/QD-BGTVT in implementation this Decision.

6. Sources of finance

This planning is funded by private sectors (under forms of PPP, BOT, and BTO...), or financed with funding from local or central government budget (if any) and other legal sources of finance.

Article 2. This Decision enters into force from the date on which it is signed.

Article 3. The Chief of Office, Chief Inspector Directors of relevant Departments, Director –Chief of the PPP Management Board; Director General of the Directorate for Roads of Vietnam, Director General of the Ho Chi Minh Street Project Management Board; Directors of Centers for Information and Technology, Heads of Departments of Transports of provinces and centrally-affiliated cities, and heads of relevant agencies shall be responsible for the implementation of this Decision. /.
