DECISION

APPROVING THE PROJECT ON RE-STRUCTURING OF CONSTRUCTION SECTOR IN ASSOCIATION WITH CONVERSION OF GROWTH MODEL TOWARD ENHANCEMENT OF QUALITY, EFFICIENCY AND COMPETITIVENESS IN 2014 - 2020 PERIOD

THE PRIME MINISTER

Pursuant to the Law on Government organization dated December 25, 2001;

Pursuant to Resolution ratified in the third conference of Central Executive Committee (Term XI);

Pursuant to the Government’s Resolution No. 10/NQ-CP dated April 24, 2012 promulgating the Government’s action program for the implementation of socio-economic development strategy in 2011 – 2020 period and Vietnam’s five-year economic development plan in 2011 – 2015;

Pursuant to the Prime Minister’s Decision No. 339/QĐ-TTg dated February 19, 2013 approving general project for economic restructuring in association with conversion of growth model toward enhancement of quality, efficiency and competitiveness in 2013 - 2020 period;

At the request of the Minister of Construction,

HEREBY DECIDES:

Article 1. Approve the project on re-structuring of construction sector in association with conversion of growth model toward enhancement of quality, efficiency and competitiveness in 2014 - 2020 period (hereinafter referred to as the Project) as follows:

I. OBJECTIVES, VIEWPOINTS ON RE-STRUCTURING OF CONSTRUCTION SECTOR

1. General objectives

Restructuring of construction sector is aimed at meeting demands for socio-economic development, industrialization and modernization of the country; enhancing labor productivity, quality, efficiency and competitiveness of key construction products; Striving to achieve average growth from 9% - 14% per year in production value of the whole sector; a number of key construction products shall make breakthrough advances, basically dominate domestic market and gradually turn to regional and global markets;

2. Particular objectives to the year 2020;

a) Improvement of regulations and policies:

Improve regulations and policies on state administration of the areas pertaining to construction sector in accordance with socialist-oriented market economy and international integration orientation, build a complete legal framework for stable development, fair competition and transparency of construction markets; step up distribution and effective use of social resources for constructional areas and products of highly competitive advantages.

b) Area of investment and construction:

- Capable of developing most of key construction works with quality, aesthetics and competitive cost price guaranteed; Basically overcome ineffective investment, losses, dissipation and corruption in the investment and construction, especially projects using state capital; minimize adjustments to total investments, project schedule to enhance effective use of investment capital;

- The area of construction consultancy, construction and installation is on a par with regional countries with some products thereof comparable with the developed countries (construction of high-rise buildings, expressways, power plants of high capacity...). Annual average growth of construction consultancy is from 10% - 15% and of construction and installation from 8% - 12%.

- Enhance effective management and use of public investment capital and gradually increase non-state investment capital with special importance being attached to investment model Public - Private Partner (PPP).

c) Area of urban development:

- National urban system shall be appropriately distributed. Urban system is developed toward being sustainable, green, clean and scenic with integrated technical and social infrastructures; a number of central urban areas at national and regional levels take shape with level of modernization, growth rate and competitiveness on a par with regional countries; a number of urban areas with special functions such as heritage urban, tourism urban, scientific urban... are formed.

- Urbanization rate across the country reaches 40%; water supply covers 90% of urban areas from grade IV and over, 70% of urban areas of grade V; Collection and treatment of domestic wastewater reach 60% with respect to urban areas from grade III and over; collection and treatment of domestic solid waste reaches 90%.

- Carry out organization and adjustments to urban development objectives in a timely manner as prescribed in the Prime Minister’s Decision No. 1659/QĐ-TTg dated November 07, 2012;

d) Area of housing and real estate market:

- Develop diversity of housing types basically meeting demands for houses of the people, accomplish objectives of the national housing development strategy to the year 2020 and a vision to 2030; strive to achieve approximately 25 m2 per person on average in housing area across the country to the year 2020 with approximately 29 m2 per person in urban areas and 22 m2 per person in rural areas; carry out new development of approximately 12.5 million square meters of social housing in urban areas in 2016 - 2020 period;

- Proportion of solid houses across the country reaches 70% with 75% in urban areas and 65% in rural areas; remove rudimentary houses across the country and increase proportion of households that have hygienic auxiliary works to 90% with approximately 100% in urban areas and 80% in rural areas.

Proportion of apartment houses in housing development projects in urban areas of special grade reaches over 90%, urban areas of grade I and II over 60%, urban areas of grade III over 40% of total new home units; proportion of housing for lease reaches a minimum of 30% of total housing fund in urban areas from grade III and over.

- Develop real estate markets in a stable and firm manner with perfect structure and appropriate mechanism; overcome demand – supply difference, diversify products and services to basically meet demands for houses and other immovable properties; the markets work well and become key markets interconnecting with other markets in the economy; For real estate earnings, strive to achieve from 10% - 15% of total budget earnings;

dd) Area of building materials and construction mechanical engineering:

- Production of conventional building materials fully meets domestic demands and part of it is for export. Quality of building materials meets national, regional and international standards. Production value and added value in the production of building materials maintains stable and sustainable growth at approximately 10% per year on average.

- Cement production reaches 115 million ton per year 15% of which is for export; brick and stone slabs approximately 570 million m2 25% of which is for export; sanitary wares app. 21 million products 16% of which is for export; building brick app. 30 billion standard pieces with unbaked materials accounting for 40%.

- Invest in the production of high-quality materials serving the construction of the works of high technical quality, reduce importation of high-quality materials from 50% - 60% to the year 2020;

- Promote development of construction mechanical engineering products, especially off-grade products; increase proportion of domestic manufacturing mechanical engineering to be proactive in operation, exploitation, repair work, replacement and supply of materials and spare parts;

- Enhance capacity of consulting, designing, manufacturing in order to produce materials, equipment and spare parts for integrated equipment lines (cement, unbaked materials, brick slabs production lines, urban solid waste treatment plants...)

e) Construction enterprises:

Complete the re-structuring of state-owned enterprises according to the approved projects; establish large enterprises with advanced management level, state-of-the-art technology and financial capacity being highly competitive in the region; medium and small enterprises shall be re-structured toward high specialization; Enterprises of the sector are capable of expanding and moving forward dominating domestic construction market.

3. Viewpoints

Firstly, re-structuring of construction sector is part of general re-structuring of national economy in accordance with national strategy and plan for socio-economic development in association with objectives and tasks of socio-economic development of the sector aimed at constantly improving qualification, efficiency and competitiveness ensuring sustainable development of the sector;

Secondly, role and function of the State and the market must be clearly defined; extreme ideas such as “State” or “marketization” in the management of investment and development must be overcome; Of which, the State plays a key role in directing and keeping pace for the market to develop, build a complete legal framework creating favorable investment environment aimed at attracting resources to the maximum for investment and development, at the same time reinforce state administration and regulation on types of markets for stabilization of the market, consider the market as the means to fulfill socialist targets and move forward serving the people, especially the poor and beneficiaries of social policies;

Thirdly, innovate ideas about management and development according to the principle that investment and development of urban, housing and real estate markets must follow the planning overcoming ineffective and spontaneous investment that may lead to “suspended’ project.

Fourthly, re-structure construction sector under an appropriate direction, prioritize areas and products of high growth and competitiveness, gradually dominate domestic markets and take the initiative in international integration;

Fifthly, make harmonious combination of urgent issues and basic, long-term issues, economic development and social security policies ensuring social progress and justice, especially in the area of housing and moving forward achieving the target of sustainable development;

Sixthly, carry out the re-structuring of construction sector in association with acceleration of administrative reform, implement appropriate decentralization ensuring uniform management and direction from central to local government, promote local creativity and initiative;

Seventhly, strongly promote active and positive roles of organizations and enterprises in the re-structuring of construction sector in general; encourage and attract the participation of people and economic sectors in the areas of production of construction projects and urban services;

II. DIRECTING THE RE-STRUCTURING OF A NUMBER OF AREAS AND KEY PRODUCTS IN CONSTRUCTION SECTOR

1. Construction consultancy

- Create a breakthrough development in the area of construction consultancy from viewpoints, manner, development model, management level, application of science and technology, knowledge of legal environment ensuring fair competition among organizations providing consultancy services including organizations at home and abroad;

- Innovate ideas and enhance quality of consultancy in construction planning; Planning project must have a long-term vision including the calculation of resources for the implementation to make the planning highly feasible and serve as foundations for investment planning, management and implementation of construction investment projects;

- Establish team of consultants qualifying for designing, supervision and management of 40+floor high-rise construction works, public works and infrastructural works of large scale and sophisticated technology; take part in the area of nuclear power, renewable energy; take part in EPC contracts for projects on traffic, power energy, irrigation and other industrial works;

- Develop professional project consultancy and management models, have project management capacity in the areas of economy, engineering, environment, society, market and legislation relating to construction investment;

- Apply and master software products, state-of-the-art technological equipment in construction survey, construction design, construction economics and management, testing and assessment of construction quality;

2. Construction and installation

- Improve qualifications for organization and management of construction and installation with high level of specialization and professionalism, master state-of-the-art construction technology to undertake construction works of large scale, sophistication and in need of advanced construction techniques such as houses and civil works over 40 floors; public works of large spans (sports centers, gymnasiums, stadiums); seaside and offshore works; tower works... Be open to technology of construction works such as nuclear power plants, linear underground urban works and other underground works to a depth of 30 meters;

- Intensify research and apply construction structures using new materials of high strength, step up industrialization in construction to improve quality of construction works, shorten schedule of construction and lower cost price;

- Intensify forces specializing in construction, EPC contractors for power, traffic and irrigation construction works;

- Improve capacity of professional management staff and technical workers; guarantee proportion of trained construction workers reach 50%; develop management staff, technical experts and skilled works qualifying for construction works of large scale and high level of sophistication;

3. Area of urban development

- Carry out appropriate arrangement and organization of national urban network under the general planning for Vietnam’s urban system development to the year 2025 and a vision to 2050, the Program for national urban development in 2012 - 2020 period including checks, updates and supplements to ensure compliance with requirements for socio-economic development in each locality and across the country in each period;

- Tightly control the process of urban investment and development under the planning and plans, especially in the development of new urban areas and urban development areas ensuring integration in technical infrastructure (traffic, water supply, water drainage, waste treatment, power supply and urban lighting...) and social infrastructure, carry out effective exploitation and thrifty use of social resources, especially land resources; harmonize relationship between economic development and national defense and security, protection of environment and national cultural identity moving forward sustainable development;

- Innovate ideas about upgrading types of urban toward discouragement of expansion but concentration on improvement of quality, competitiveness of urban areas, attach much importance to promotion of role and characteristic value of such urban areas as urban areas motivating national and regional economic development, heritage, ecological, scientific and tourism urban areas...

- Re-structure investment and development of urban technical infrastructure system (production and supply of clean water, water drainage and wastewater treatment, solid waste treatment, cemetery services and urban lighting...) in the direction of selection of technology and equipment in conformity with national and local socio-economic conditions with priority given to selection of state-of-the-art technology and equipment saving raw materials and environmentally friendly;

- Build mechanism and policies on attracting resources for investment and development of technical infrastructure, urban services, especially non-state resources; carry out effective exploitation and use of ODA and concessional loans in the area of urban development;

4. Area of housing and real estate market

- Intensify state administration and control of real estate market on the principle that the State shall carry out management of real estate market through legal means, regulate the market as a representative of land owners through control of primary land markets and promulgate policies on credits, tax and finance in a flexible way;

- Re-structure real estate goods in the direction of diversifying real estate goods, especially housing in compliance with market demand; Decide structure of house types and diversification of products right from the phase of planning and project approval, ensuring demand – supply balance and payment capacity of real estate market; Step up development of social and commercial housing of small area and low price, make appropriate adjustment to sources of supply of high-class commercial housing; step up development of houses for rent;

- Keep checking real estate business projects across the country, analyze projects ongoing, temporarily suspended or in need of adjustment to accord with market demand and plans for development of real estate types of each locality; Study and handle state of unfinished new urban areas, especially in Hanoi and Ho Chi Minh City;

- Housing development must be integrated with social infrastructure ensuring safety, convenience and satisfaction of requirements for construction quality, architecture, landscape and environment; capable of coping with climate change, natural disasters and thrifty use of energy; affordable for majority of people;

- The State should promulgate preferential policies for economic sectors that participate in social housing development for sale, lease, lease purchase aimed at improving housing for beneficiaries of incentive policies, public servants, the armed forces, people on low incomes through assistance in land, finance, tax and credits;

- Establish and create favorable conditions for non-bank financial institutions such as real estate investment trust, real estate trust funds...to develop aimed at attracting capital sources for real estate market; Adjust credit and fiscal policies to create favorable conditions in medium and long-term capital for participation of relevant entities in the market; improve policies on tax, fees and charges to encourage effective use of immovable properties, public transaction and minimization of speculation and tax evasion;

- Improve mechanism and organization, enhance qualification and professionalism of relevant entities in participating in real estate market; Expand scope of real estate business activities to attract foreign investment;

- Construct uniform and reliable systems for communicating and predicting real estate market as foundations for effective policy planning and market management; perform provision of information to ensure the market works in an open and transparent manner;

5. Area of building materials

- Development of sources of building materials must accord with the planning, ensure demand - supply balance by sticking firmly to domestic and global demands, maintain stability of markets of cement and key building materials; step up effective management, exploitation and use of mineral resources for the production of building materials;

- Adjustments to the structure of building material product as follows: Key building materials must fully meet domestic demand and partial demand for export. Such products of highly competitive advantages such as brick and stone slabs, sanitary wares, flat glass, and industrial lime must be accelerated for export. Domestic production of high-class finish materials must be intensified to gradually reduce dependence on imports; Step up development of unbaked materials; Prioritize development of local materials to take full advantage of geographical positions of localities, regions for reduction of transport cost;

- Prioritize investments in state-of-the-art technology for the production of high-quality finish materials of dominant uses, highly economic efficiency meeting domestic demand, reducing dependence on imports and gradually moving forward exportation;

- Re-structure investment in building materials production facilities toward increasing production scale according to market demand, establish raw materials processing facilities, concentrated building materials production facilities of large scale, state-of-the-art technology and high added value;

- Apply energy and raw materials loss rate, technology of new materials and nonmaterial to construction sector and treatment for environmental pollution (wastewater and solid waste treatment, waste recycling and green technology,...) as prescribed in the Prime Minister’s Decision No. 1469/QĐ-TTg dated August 22, 2014 approving general planning for building materials development in Vietnam to the year 2020 and a vision to 2030;

- Gradually modernize production technology toward being green and clean, saving fuel, raw materials, energy in combination with enhancement of quality and minimization of environment pollution; step up use of waste as raw materials for the production of building materials;

6. Area of construction mechanical engineering

- Develop the implementation of the strategy for Vietnam’s mechanical engineering development to the year 2010, a vision to 2020 as approved in the Prime Minister’s Decision No. 186/2002/QĐ-TTg dated December 12, 2002;

- Re-structure construction mechanical engineering enterprises toward enhancing technological level, equipment and personnel capacity to master engineering, fabrication and assembly of a number of machinery and equipment meeting demand for construction and installation in Vietnam; Innovate and modernize integrated equipment system for materials production lines to improve quality and lower cost price;

- Establish policies on investment to increase quality of domestic equipment production, increase import substitution industrialization for cement production equipment and a number of equipment in hydro-power and thermal-power plants; Encourage research, design and manufacture of unbaked materials production equipment, urban solid waste treatment equipment, facilities for treating and using ash, slag and plaster from industrial production for the production of building materials in the direction of clean and sustainable production;

7. Re-structuring of enterprises in construction sector (hereinafter referred to as the enterprises)

- Step up equitization of state-owned enterprises on the principle that the State shall not hold dominate shares in the enterprises as prescribed in the Prime Minister’s Decision No. 37/2014/QĐ-TTg dated April 18, 2014 promulgating criteria and list of classified state-owned enterprises; Innovate, develop and move forward applying modern management frame guaranteeing the enterprises operate under market mechanism and fair competition;

- Keep stepping up the re-structuring of the enterprises of non-state economic sectors, encourage the formation and development of non-state enterprises with strong potentiality and competitiveness in domestic and global markets;

- Establish large-scale and multidisciplinary enterprises being able to function as a general contractor for housing, commercial, industrial, traffic and irrigation projects of large scale and sophisticated technology;

- Arrange and re-structure medium and small enterprises in the direction of high specialization to enhance capacity and competitiveness; develop a network of enterprises specializing in provision of components of construction products (human resources, machinery, equipment, raw materials, technological solutions and management models...) to enhance professionalism and management efficiency;

- Study, select and apply appropriate models of the enterprises providing public services such as water supply, water drainage, solid waste treatment, cemetery services in accordance with actual conditions in Vietnam;

- Study, check and establish plans for arrangement and innovation of public service units in the area of construction (schools, institutes and centers...) in the direction of private sector involvement and gradually equitize such units in order to reduce dependence on state budget;

III. KEY SOLUTIONS

1. Innovate and improve regulations, policies and administrative procedures to meet development of construction sector; specifically:

a) Keep improving legislative document system pertaining to the areas of construction sector management in accordance with socialist-oriented market economy and the trend toward international integration;

b) Promulgate mechanism and policies on encouraging development of key products and areas of the sector of which the establishment of financial institutions is prioritized in order to attract capital sources for the market, create clear and favorable investment environment to mobilize to the maximum all resources for investment and development, and at the same time create conditions for stabilization and fair competition of the markets of construction sector;

c) Step up administrative reform, especially administrative procedures in the management of investment and construction and the areas of state administration of construction sector;

d) Study, amend, supplement and promulgate systems of standards, regulations, economic and technical norms, investment and construction management to enhance quality and fair competition, make effective use of natural resources;

dd) Step up supervision, inspection, instruction, propaganda, dissemination and legal education about construction, communicate information about the areas of state administration of the sector;

2. Improve quality of establishment and organization of construction planning, planning and strategy for development of key products and areas; Specifically:

a) Keep innovating and improving quality of construction planning ensuring the planning is one step ahead, has a long-term vision and calculation of resources for the implementation in each period;

b) Make checks, adjustments and supplements to regional planning, national general planning, push speed of zone planning, detailed planning and rural construction planning;

c) Intensify inspection of urban development under the planning and plan, make checks and adjustments to projects, re-structure products and tightly control development of new urban areas in Hanoi, Ho Chi Minh City and localities, ensure urban areas are synchronously developed with full establishment of technical and social infrastructure;

d) Check, improve and enhance quality of planning projects, ensure planning for key products and areas is established in accordance with general planning for socio-economic development, sector planning and objective demands of society and the market of which the following issues are prioritized: check and improve planning for use of social housing funds, preferential policies on housing for beneficiaries of incentive policies; plan development of key construction material production facilities, avoid dissipation in investment and development, exploit and make maximum use of capability of existing facilities; plan development of mechanical engineering and industry to support development of economic sectors;

dd) Intensify coordination and collaboration between ministries, sectors and localities in the management and implementation of planning strategy, overcoming state of suspended planning and projects;

e) Make regular checks, adjustments and supplements to strategy for development planning with respect to key areas and products of construction sector in accordance with re-structuring orientation;

g) Intensify inspection and supervision of the implementation of strategy for planning, plans ensuring public disclosure, transparency and enhancement of feasibility of strategy and planning;

3. Innovate and enhance effective management and use of public investment capital; Specifically:

a) Improve models of state administration apparatus at all levels; Innovate models of urban investment and development in the direction of professionalism through the application of professional project management board, regional project management board;

b) Step up effective management of key projects assigned by the Government, state-subsidized programs and projects with respect to key areas and products (based on approved planning, strategy and plan);

c) Enhance transparency and responsibilities for management and use of public investment capital; Put forward a specific plan in order to balance resources for investment and development in each area and product; Prioritize public investment in areas and products with low capital recovery capability or unable to mobilize other capital sources to meet pressing and essential needs ensuring social security and improve living conditions of people;

d) Enhance effective use of ODA capital and concessional loans with respect to urban development and technical infrastructure projects;

dd) Improve quality of inspection, supervision and management of interregional, interprovincial and national investment projects, projects of complicated requirements;

e) Conduct effective supervision, management and use of state capital invested in state-owned enterprises of construction sector;

4. Encourage and attract non-state investment capital; Specifically:

a) Step up private sector involvement in key areas and products of construction sector, especially Public-Private Partnership to make a breakthrough in mobilization of capital;

b) Focus on selection of areas and projects serving as models with projects on urban technical infrastructure (water supply, water drainage, solid waste treatment...) and social housing being encouraged;

c) Provide guidance to localities on construction and provision of information about the list of investment projects in the form of PPP for implementation and relevant policies;

d) Consolidate organization and management of investment in the form of PPP;

5. Speed up the process of re-structuring and equitization of state-owned enterprises in construction sector;

a) Innovate and restructure enterprises in the direction of construction of key products and services with high specialization and professionalism; Move forward enhancing competitiveness and building management enterprises to approach and integrate with the world;

b) Step up completion of the task of equitizing state-owned corporations affiliated to the Ministry of Construction according to the plan approved by the Prime Minister;

c) Check and solve difficulties, implement in an effective way preferential mechanism and policies for enterprises, especially in the area of investment and construction, social housing development; cooperate with relevant ministries, sectors in making a study and proposals on preferential mechanism and policies for production and business development, creating favorable conditions for enterprises to get access to capital sources;

d) Reinforce management, supervision and inspection of activities, financial situations, results of production and business, inventory control, and bad debt management of enterprises to meet objectives and tasks assigned;

dd) Attach importance to human resources, consolidate teams of leading personnel and improve capability of enterprise management; Keep studying and improving models of functioning as representatives of owners; reinforce leadership of the Communist Party on state-owned enterprises; Improve managerial capability of agencies as owners, professional competence of managers in state-owned enterprises;

6. Innovate training and development of human resources; Specifically:

a) Check, supplement, adjust and organize effective implementation of the planning for human resource development in 2011 – 2020 period approved in the Decision No. 838/QĐ-BXD dated September 13, 2012;

c) Concentrate on training and improving capacity of personnel, officials and civil servants in construction sector under the Decision No. 1961/QĐ-TTg dated October 25, 2010 approving the Project “Training and Enhancing managerial capability of urban leading officials at all levels in 2010 – 2015 period in urban construction and development";

c) Step up improvement, re-training and expansion of forms of high-quality human resource management in construction sector (officials, administrative officers, engineers, hi-tech workers, workers...) to meet demands for human resources for key projects with large scale, sophisticated technology (underground works, marine works, nuclear power plants...); Apply regime of public recruitment through examinations;

d) Step up investment and private sector involvement; improve preferential policies on training and development of human resources for construction sector;

dd) Build salary mechanism and referential policies for employees in construction sector in accordance with typical conditions of the sector and the market;

7. Step up application of science and technology and international cooperation; Specifically:

a) Build and promulgate policies encouraging study and application of new and state-of-the-art technology in construction and installation, construction consultancy, construction planning, building materials production to meet sustainability, aesthetics, low cost price, environmental protection, energy saving, coping with climate change and rising sea;

b) Improve applicability of science and technology activities to production and management of the sector; study and gradually master state-of-the-art technologies (technology for the construction of underground works, unbaked brick production works, solid waste treatment works, nuclear power plants and other sophisticated works...); develop, improve and modernize technologies in the areas of mechanical engineering, building materials production and traditional technologies aimed at improving labor productivity, product quality, competitiveness of construction enterprises;

c) Study and cooperate with developed countries in applying and mastering state-of-the-art technologies and techniques in construction management and economics; Apply building information models BIM and design softwares VDC (Virtual – design – construction);

d) Direct and encourage investment, innovate science and technology in construction enterprises;

dd) Intensify cooperation and international integration; prepare necessary conditions and resources for participating in international integration as directed by the Government; step up cooperation and exchange of information, share experience with foreign partners in the management and development of areas of the sector;

8. Carry out construction and management of database information system in each area and product in the direction of public disclosure and transparency;

a) Establish database information management models for the whole sector ensuring uniformity and reliability; Establish systems of information, predicting demand and supply in human resources, building materials, housing, real estate market... from central to local government as foundations for planning policies, construction market and real estate market management;

b) Establish and improve systems of criteria, codes, software applications to manage key database system of the sector in general resources, human resources, construction enterprises, products, products of science and technology, products of new technology, market price (materials, workers and machinery); housing, land, real estate market, standards, regulations and economic and technical norms...

IV. IMPLEMENTATION

1. The Ministry of Construction

a) Preside over and cooperate with Ministries, sectors and localities in the implementation of the Project; Establish sector re-structuring board headed by the Minister of Construction to direct and implement the coordination, inspection and supervision of the implementation of the Project;

b) Direct the implementation of projects on the re-structuring of areas and enterprises approved by the Prime Minister; Direct establishment, approval, inspection and supervision of the implementation of the projects on re-structuring of areas, products, corporations and state-owned enterprises established by the Ministry of Construction; Review and compile the re-structuring of enterprises across the country;

c) Cooperate with the Ministry of Planning and Investment, Ministries, sectors and localities in mobilizing resources for the implementation of the Project;

d) Annually, compile and assess the implementation, proactively study and propose amendments and supplements to mechanism and policies on key areas and products of construction sector during the implementation;

2. The Ministry of Planning and Investment

a) Preside over and cooperate with the Ministry of Construction and relevant agencies in allocation of capital to meet demands for development of key areas, products, especially capital for programs that meet pressing demands for socio-economic development such as social housing development, technical and social infrastructure in urban and rural areas, reciprocal capital for ODA projects, state capital invested in investment projects in the form of PPP;

b) Cooperate with the Ministry of Construction in improving policies on investment and construction management ensuring integration and transparency;

c) Study and make amendments and supplements to policies on attraction of investment from non-state economic sectors for the development of urban areas, water supply, water drainage, solid waste, housing, real estate markets, building materials...

3. The Ministry of Finance

a) Cooperate with the Ministry of Construction in studying and proposing the promulgation of mechanism and policies on finance serving the implementation of the Project;

b) Cooperate with the Ministry of Construction in making amendments and supplements to mechanism and policies on guarantee and insurance for construction works;

4. The State Bank

a) Direct credit institutions to provide loans to key programs and projects, social housing development project in accordance with governmental policies and decision of the Prime Minister in each period;

b) Cooperate with the Ministry of Construction and localities in checking mechanism and policies on credits assisting the implementation of the Project;

5. The Ministry of Natural Resources and Environment

a) Preside over and cooperate with the Ministry of Construction and localities in checking and inspecting use of land for urban and rural development under the approved construction planning and urban planning;

b) Cooperate with the Ministry of Construction in developing urban and rural development planning, building materials planning during the establishment of investment and construction projects;

c) Preside over and provide guidance to localities on the establishment of land development centers aimed at creating land funds for the development of urban, housing and resettlement zones;

6. The Ministry of Science and Technology

a) Preside over and cooperate with the Ministry of Construction and relevant agencies in checking and making supplements to mechanism and policies concerning reinforcement of resources for research, application and transfer of technology and technical advances, private sector involvement in provision of resources for development of science and technology, assisting the Ministry of Construction to implement the Project;

b) Cooperate with the Ministry of Construction in studying, making amendments and supplements to technical regulations and standards in the areas of construction; Assess and announce national technical standards for effective use of energy for products of construction;

c) Cooperate with the Ministry of Construction in organizing study and application of new technology and software products to management and production in construction sector;

7. The Ministry of Industry and Trade

Cooperate with the Ministry of Construction in studying and establishing strategy and policies on development of building materials branch, construction products, development of solutions to boost exportation, import management for goods as building materials and construction products;

8. The Ministry of National Defense, the Ministry of Public Security, the Ministry of Information and Communications and other relevant ministries shall be responsible for cooperating closely with the Ministry of Construction in implementing the Project within their functions, duties and authorities as prescribed.

9. People’s committees of central-affiliated cities and provinces

a) Making checks, adjustments and supplements to strategy, development planning, construction planning, urban planning, planning for key areas, products of construction sector in localities based on contents of the Project; establish plans for implementation;

b) Make a study and build mechanism and policies encouraging investment in areas and products of construction sector in conformity with potentiality, advantages and demands of localities; prioritize supports for development of urban, urban infrastructure, social housing and building materials products;

c) Manage and supervise quality and efficiency of construction investment projects in the administrative division;

Article 2. Implementary provisions

1. This Decision takes effect since the signing date;

2. Ministers, heads of ministerial-level agencies, heads of governmental agencies, the Presidents of People’s Committees of central-affiliated cities and provinces and relevant organizations and individuals shall be responsible for executing this decision./.
