DECISION

APPROVING THE ZONING PLAN FOR EXPLORATION, EXTRACTION, PROCESSING AND EXPLOITATION OF TITAN ORES BY 2020 WITH VISION TO 2030

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Law on Minerals No. 60/2010/QH12 dated November 17, 2010;

Pursuant to the Government’s Decree No. 92/2006/ND-CP dated September 7, 2006 on establishment, ratification and management of the master plan for socio-economic development and the Government’s Decree No. 04/2008/ND-CP dated January 11, 2008 on modification and supplementation of several articles of the Decree No. 92/2006/ND-CP dated September 7, 2006;

Pursuant to the Prime Minister’s Decision No. 2427/QD-TTg dated December 22, 2011 on ratification of the mineral strategy by 2020 with vision to 2030;

After considering the request of the Minister of Industry and Trade made in the report No. 2702/TTr-BCT dated March 29, 2012, and the Official Dispatch No. 6083/BCT-CNNg dated July 10, 2013,

HEREBY DECIDES

Article 1. Approving the zoning plan for exploration, extraction and exploitation of titan ores by 2020 with vision to 2030, including the main contents as follows:

1. Views of development

- The large amount of titanium ores available in our country is considered as a prerequisite and important condition for development of modern titanium extraction and processing industry which paves the way for the national socio-economic growth by implementing the industrialization, modernization and integration policy.   

- The titanium ore extraction and processing industry must be created and developed in a consistent and sustainable manner with a view to making it become modern, efficiently consuming natural resources and ensuring the economic, social and environmental effectiveness as well as good standards of social safety and order.     Products manufactured by the titanium ore extraction and processing industry must be deep-processed ones that meet domestic and export demands.

- Titanium ore extraction and processing industry must be developed with the right schedule and the proper scale in order to optimally meet requirements and objectives of the national economic development over periods of time; with the help of advanced technologies to be applied, ensure that all beneficial elements contained in a titanium ore should be recovered to the maximum and energy resources should be efficiently consumed; must be developed in consistency with infrastructure and service facilities (transportation, seaport, electricity, water supply, logistics – technology, etc.); gradually form compounds of ore – selection – deep processing technologies for titanium ores associated with industries auxiliary to the titanium extraction and processing industry, especially at titanium concentration areas within the territory of Binh Thuan and Ninh Thuan province.

- The titanium extraction and processing industry should be invested in for development purposes on the basis of mobilization of a variety of domestic and foreign resources.  The foreign cooperation mainly focuses on acquiring advanced technologies in the deep processing and access to the international market.

2. Developmental objectives

a) General objectives

- By 2020: Forming the titanium industry with titanium products which are deep-processed to produce titanium pigments and sponges; meet domestic demands for pigments; export titanium slags, sponges and zirconium oxychloride salts.

- By 2030: Developing the titanium industry in a stable and sustainable manner with the center for large-scale and hi-tech extraction and processing of titanium ores in Binh Thuan province; focus on and prioritize development of products such as pigments, titanium sponges, titanium metals and alloys that meet domestic and export demands.

b) Specific objectives

- By 2015

+ Complete the work of exploration and reserve assessment of titanium ore deposits to be extracted in the planning period with assurance that titanium ore reserve is reliable to encourage investments in titanium extraction and processing projects.

+ Maintain the proper production scale which corresponds to the actual consumption capability and concurrently rearrange manufacturing activities at existing titanium ores and titanium ore extraction facilities, and reform and upgrade technologies and improve the recovery of poor ores and selected tailings; sufficiently meet domestic demands for zirconium powders and reconstituted ilmenites; manufacture titanium slags and artificial rutiles as materials used for pigment production and export purposes.

+ Build and operate several factories to process titanium slags and artificial rutiles within 4 planned zones; research technologies for and prepare investments in projects for manufacture of titanium sponges/ titanium metals in Binh Thuan province, and pigments in Binh Dinh and Binh Thuan province; prepare investments in large-scale titanium ore extraction and processing complexes in Binh Thuan province.

+ Invest in, improve and upgrade infrastructural systems to make them consistent with the development of titanium extraction and processing projects (transportation, electricity and water supply, etc.).

By 2015, total production capacity is expected to be 60 thousand tonnes/year, 945 thousand tonnes/year, 60 thousand tonnes/year and 152 thousand tonnes/year respectively of reconstituted ilmenites, titanium slags, artificial rutiles, fine and super-fine zircons.

- For the period of 2016 - 2020

+ Form the titanium extraction and processing industry with key products such as titanium slags, pigments, sponges/ metals and several ones obtained from zircons on the basis of maintaining the manufacturing capacity and expanding extraction facilities that have been invested in and construct new deep-processing establishments to meet domestic and export demands.

+ Construct and develop Binh Thuan province to become the large-scale titanium extraction and processing center which applies advanced technologies to produce key products such as pigments, titanium sponges as well as to meet domestic and export demands.

By 2015, total processing capacity is expected to be 60 thousand tonnes/year, 989 thousand tonnes/year, 120 thousand tonnes/year and 194 thousand tonnes/year, 240 thousand tonnes/year, 20 thousand tonnes/year and 20 thousand tonnes/year respectively of reconstituted ilmenites, titanium slags, artificial rutiles, super-fine zircons, pigments, ferrotitaniums and titanium sponges.

- For the period of 2021 - 2030

+ Develop the titanium industry in a stable and sustainable manner, and reinforce our position as the provider of titanium slags, pigments and sponges to the global market; succeed in establishing a complete and consistent titanium ore extraction and processing industry.  

+ Fully meet demands for domestic consumption and expansion of export market of pigments, zirconium compounds, titanium sponges and metals.

By 2030, total processing capacity is expected to be 60 thousand tonnes/year, 1,001 thousand tonnes/year, 120 thousand tonnes/year, 208 thousand tonnes/year, 300 thousand tonnes/year, 30 thousand tonnes/year and 20 thousand tonnes/year respectively of reconstituted ilmenites, titanium slags, artificial rutiles, super-fine zircons, pigments, ferrotitaniums and titanium sponges/ metals.

3. Developmental planning

a) Titanium ore resource

Forecast titanium ore deposit and resource comprise about 650 million tonnes of heavy minerals (including about 78 million tonnes of zircons); forecast titanium ore deposit and resource within the territory of Binh Thuan province are approximately 599 million tonnes which account for 92% of total titanium ore reserve and resource in Vietnam, including:

- Mineral reserve and resource available within areas where mineral operations are prohibited and restricted is about 210 million tonnes (including about 26 million tonnes of zircons).

- Titanium ore reserve and resource which may be extracted is about 440 million tonnes (including about 52 million tonnes of zircons).

For a planned period, about 150 million tonnes of heavy minerals (including about 17 million tonnes of zircons) shall be extracted while the rest of mineral reserves and resources shall be transferred to the national resource reserve.

Details about titanium ore reserves and resources shall be displayed in the Appendix I to this Decision.

Note: The demand for ilmenite ore concentrate shall be determined in consistency with the demand for raw materials used for manufacture of titanium slags, reconstituted ilmenites and artificial rutiles. Other products (cast irons, zircons, rutiles, monazites, etc.) are those obtained from the process of titanium ore selection and titanium slag production.

c) Planned zones

4 zones for extraction of titanium ores to provide raw materials for processing establishments must be planned provided that they are proportional to the characteristics of ore technology and the level of processing capacity as follows: 

- Region I: Thai Nguyen area (original ores and mineral sands).

- Region II: Ha Tinh – Thua Thien Hue area (mineral sands contained in the gray sand layer).

- Region III: Quang Nam – Binh Dinh – Phu Yen area (mineral sands contained in the gray sand layer).

- Region IV: Ninh Thuan – Binh Thuan area (mineral sands contained in the gray and red sand layer).

d) Planned exploration

- For the period from now to 2015

+ Complete exploration of ores according to the agreed policy at areas, such as Thai Nguyen, Quang Binh, Quang Tri, Binh Dinh, Ninh Thuan and Binh Thuan, in order to prospect for the reliable ore reserve that is expected to meet demands for raw materials supplied to mineral processing factories.

+ Complete exploration of titanium ores contained in red sand layers located at Luong Son, Bac Binh Thuan to enable the large-scale extraction and processing industry.

- For the period of 2016 - 2020

In reliance upon the capability of executing mineral extraction and deep processing projects, carry out mineral prospects throughout expanded areas in the proximity of Luong Son area (Northern Binh Thuan) and those containing titanium minerals at the red sand layer within the territory of Ninh Thuan province.      

- For post-2020 period

Prospect for titanium ore deposits contained in the rest of red sand layers.

Ensure that mineral exploration projects shall be commenced provided that there are mineral extraction and deep processing projects which have been proved feasible in technical and economic aspects.

Total proposed reserve of existing titaniums and those which are currently prospected for and are going to be prospected for to be extracted in a planning period is about 150 million tonnes of heavy minerals (approximately 120 million tonnes of ilmenite concentrates).

The list of mineral exploration projects to be executed within a planning period shall be shown in the Appendix II to this Decision.

dd) Titanium ore extraction and processing plan

- The plan for extraction and selection of titanium ores

+ For the period from now to 2015: Mainly extract original titanium ores (Thai Nguyen area) and titanium minerals contained in gray sand layers (all 4 regions).  Focus on technological improvement, innovation and upgradation in order to increase the rate of recovery of useful minerals and efficient water and electric power consumption. Conduct technological researches and prepare investments in mineral extraction projects at Luong Son area (Northern Binh Thuan).

+ For the period of 2016 - 2020: Carry out the ongoing extraction of titanium minerals contained in the active mines and prospect for titanium minerals obtained from mines which have been being searched from now to 2015 in provinces such as Thai Nguyen, Ninh Thuan and Binh Thuan.  Invest in extraction and selection of titanium ores at Luong Son area (Northern Binh Thuan) carried out by applying modern technologies and on a large scale.

+ For the post-2020 period: Sustain mineral production activities at mines of which the ore reserve remains. Take into account specific conditions (including market, deep processing capability, financing capability and infrastructure, etc.) before making a decision to develop a new project.

- The technology for extraction and selection of titanium ores:

+ Original titanium ores searched for within Thai Nguyen area: Apply the following technological process to the mineral extraction, including drilling and blasting → shoveling → carting → selecting primary minerals → selecting ore concentrates (with respect to ilmenite and rutile ore concentrates).

+ Titanium ores contained in coastal mineral sands (in gray and red sand layers): Apply the following technological process to the mineral extraction, including milling and grinding → pumping and sucking → selecting primary minerals → selecting ore concentrates (with respect to ilmenite, rutile, zirconium and monazite ore concentrates).

The list of titanium extraction projects shall be shown in the Appendix III to this Decision.

- Titanium ore processing plan

Titanium product processing zones shall be planned as follows:

+ Region I: Mainly produce titanium slags.

+ Region II: Mainly produce titanium slags and super-fine zircons.

+ Region III: Produce titanium slags, reconstituted ilmenites, super-fine zirconium powders and pigments.

+ Region IV: Construct and develop this region to become the center for titanium industry, and extract and process titanium minerals on a large scale and by applying advanced technologies; aim at producing proposed products such as titanium slags, super-fine zircons, zirconium oxychloride salts, pigments, titanium sponges/ metals and titanium alloys.

New investment projects for mineral processing should adhere to the principle of mineral processing concentrated investments in order to achieve the economy of scale and facilitate application of advanced technologies and environmental treatment; a processing establishment can use raw materials obtained from titanium mines inside or outside of this region.

Titanium product processing shall be planned as follows:

+ For the period from now to 2015: Mainly produce titanium slags, reconstituted ilmenites and several zircon-derived products (super fine zirconium powders, zirconium oxychloride), artificial rutiles, welding flux, etc. which meet domestic and export demands. Conduct technological researches, prepare investments in projects for production of pigments that have the minimum capacity of 30 thousand tonnes/year per each plant, and those for production of ferrotitaniums and titanium sponges/ metals which have the capacity of up to 20 thousand tonnes/ year.

+ For the period of 2016 - 2020: Boost up the processing capacity of titanium slags for export purposes and of other products within selling capabilities. Invest in and operate 2-3 pigment plants (as planned, these plants shall be located in Binh Thuan, Binh Dinh and Ninh Thuan) and titanium sponge/metal plants (as planned, these plants shall be located in Binh Thuan), titanium alloy projects with priority given to ferrotitanium products (at titanium slag, mechanical engineering, metallurgy plants or other independent ones).   

+ For the post-2020 period: Maintain the normal operation of metallurgy of titanium sponges/ metals, titanium slags and reconstituted ilmenites. Improve the production capacity of pigments to meet domestic and export demands.  Depending on the specific conditions, the production capacity of ferrotitaniums is expected to increase by 30,000 tonnes/year by 2030.

The list of titanium processing projects to be executed within a planning period shall be shown in the Appendix IV to this Decision.

e) Conditions for titanium ore processing projects (new investment projects)

- Regulations on processing capacity and technology

+ Titanium slag:

. The minimum capacity of a processing plant is ≥ 20,000 tonnes/year.

. The minimum output of a processing furnace is ≥ 6,300 KVA, which is the same as the semi-closed furnace type or more, and has functions such as automatic adjustment in its output and dust control (with respect to a furnace improvement and expansion project which increases its minimum output by 3,200 KVA).

+ Reconstituted ilmenites: The minimum capacity of a processing plant is ≥ 20,000 tonnes/year.

+ Crushing super fine zircons:

. The minimum capacity of a grinding mill is ≥ 5,000 tonnes/year.

. With respect to a new investment project: the minimum output of super fine zircons (particle size ≤ 10 µm) must make up 50% of total output of a grinding mill. 

Artificial rutiles: The minimum output of a grinding mill is ≥ 10,000 tonnes/year.

+ Pigments: Using the chloride or sulphate technology shall be decided when an investment project is set up according to the principle which ensures efficiency and conformity to environmental standards and relevance to the characteristics of raw materials used as an input to a production process.   The minimum capacity of a processing plant is ≥ 30,000 tonnes/year.

+ Titanium sponges or metals: The minimum capacity of a processing plant is ≥ 10,000 tonnes/year.

g) Planned transportation

Since titanium ore extraction and processing activities mainly take place near the sea (except for Region I - Thai Nguyen), technical infrastructure systems currently in place within planned regions are used. As for transportation and export of titanium products within the territory of Binh Thuan province, a general seaport located in this area is planned for development and complete construction, which shall be jointly used for transportation and export of bauxite ore products and transit of coals, etc.)

4. Investment capital

Total investment capital to be estimated for the planning period which ends in 2030 shall equal about VND 43,956 billion equivalent to USD 2,144 million, including about VND 1,373 billion equivalent to USD 67 million invested in exploration projects; about VND 40,634 billion equivalent to USD 1,982 million invested in extraction and processing projects; about VND 1,948 billion equivalent to USD 95 million invested in infrastructure system projects.     

Proposed funding source:

- Financing for ore exploration activities and infrastructure system investment shall be derived from self-arranged capital of enterprises.

- Financing for extraction and processing activities shall be derived from self-arranged capital of enterprises, domestic and foreign commercial loans, capital mobilized through the securities market, issues of construction bonds and other legal funding sources.

Details about investment capital demands shall be shown in the Appendix V to this Decision.

5. Measures and legislative policies

a) Measures

- With regard to resource management

+ Set up a complete digital database system which assists in management of nationwide titanium resources.

+ Promote mineral exploration activities in order to take initiative in searching for titanium ore deposits with reliable reserves which enable extraction projects to be executed for each period with priority given to the period that ends in 2020. 

+ Conduct an auction to hold the right to extract the rest of titanium minerals, largely those contained in red sand layers.

- With regard to titanium ore extraction and processing activities

+ Only allow titanium ore extraction which serves the purpose of supplying raw materials to deep processing projects, corresponds to the processing progress and capacity as well as product selling capability. All of titanium extraction projects are required to have extraction sites backfilled to the original state.

+ With regard to overlapping areas along the coast (mainly in Ninh Thuan and Binh Thuan province), concentrate on speeding up the advance extraction of titanium ores for the purpose of site clearance for construction of industrial, tourism and civil facilities.  Other overlapping areas which do not have sufficient conditions for extraction activities shall become a part of the national resource reserves.

+ New investment projects and those for investments in expansion and improvement of extraction and selection of titanium ores, production of titanium slags and pigments must apply advanced technologies and those which help them to consume water and electric power in an efficient manner as well as ensure conformity to environmental standards.  

- With regard to science, technology and international cooperation

+ Promote the international cooperation with priority given to such sectors as research, advanced technology transfer, environmental treatment and workforce training for the purpose of titanium ore extraction and processing efforts.

+ Set up processes for operational termination and elimination of extraction and processing facilities which apply obsolete technologies, consume much energy and have the low rate of resource recovery and cause environmental pollution conditions.

+ Study and experiment on use of sea water for extraction and primary selection of titanium ores with respect to coastal titanium mines.

- With regard to infrastructure systems

Invest in consistent development of technical infrastructure systems outside of safety perimeter fences in large-scale and concentrated titanium ore extraction and deep-processing areas within the territory of Binh Dinh, Ninh Thuan and Binh Thuan.   

b) Legislative policies

- With regard to titanium ore extraction and processing activities

+ Encourage enterprises to build up cooperations in investing in construction of concentrated titanium ore extraction plants located in each region with the intention of saving investments and ensuring the economy of scale and facilitating application of advanced technologies as well as carrying out environmental treatment activities. 

+ Stimulate cooperation with leading global companies specializing in titanium ore processing and having a lot of advantages in technologies, markets and capital arranging capability for the purpose of investing in large-scale pigment, titanium metal/alloy projects.

+ Encourage the production of products manufactured from the processing of titanium ores which have high commercial value for export purposes.

- With regard to finance

+ Promptly review and adjust taxes, fees and charges which should become proper and ensure harmony of mutual benefits between the Government, enterprises and local people residing in areas where mineral resources are being extracted.  

+ Accord the Government’s support to researches and transfer of technologies for processing of titanium sponges/metals and alloys in accordance with relevant laws and regulations.

- With regard to human resource

Define training of executive officers, technical officers and experts who have expertise in titanium ore extraction and processing activities as a priority in the plan for development of human resources provided for the key economic region in the Central Coast and accord relevant special treatment, preference and advantage policies to them.

- With regard to science and technology

Promote researches and application of scientific and technological advances to the titanium deep processing sector so as to accelerate acquisition and thorough grasp of technologies and ensure that adequate human resources are autonomously provided and are eligible for work activities that are currently performed by overseas workforce.

Article 2. Implementation and enforcement

1. The Ministry of Industry and Trade

- Take charge of and cooperate with relevant Ministries and local authorities in dissemination of the plan, and provide instructions on implementation, supervision and inspection of implementation of this plan.

- Periodically carry out review and assessment of the result of implementation of this plan; update information about resources, markets and influences of projects on socio-economic development conditions within project execution areas and recommend any modification of this plan whenever necessary.

- Recommend measures to be taken to strictly control sale and consumption of ore concentrates and titanium products; cooperate with relevant Ministries, local authorities and Vietnam Titanium Association in establishment of encouragement policies on processing of pigments, titanium sponges and metals.

- Collaborate with relevant Ministries and local authorities in directing, overseeing and examining project owners during the process of executing titanium extraction and processing projects in order to ensure advanced technologies to be applied, eco-friendliness and general socio-economic effectiveness. 

2. The Ministry of Natural Resources and Environment

- Take control of activities regarding exploration and determination of titanium deposit reserves, especially for titanium minerals contained in red sand layers.   Collaborate with relevant Ministries and local authorities in localizing and requesting the Prime Minister to make a decision on mineral areas that belong to the national reserves, and are not subject to any auctions conducted to transfer the right to extract titanium minerals in accordance with laws on minerals.

- Take charge of reviewing and examining titanium extraction projects and imposing any sanction against projects which are inconsistent with the plan or fail to meet statutory technical, technological and environmental requirements.

- Take charge of and collaborate with Ministries, industry authorities and local authorities in directing use of land for titanium projects and mitigate negative impacts on agriculture, forestry, fishery and tourism within such localities.

- Take charge of and collaborate with local governments in directing and overseeing environmental measures to be taken in respect of titanium projects; give recommendations about an increase in the governmental authority over environmental issues of titanium projects.

- Take charge of setting up and update the database system of titanium resources and reserves.

3. The Ministry of Science and Technology

Take charge of and collaborate with the Ministry of Industry and Trade in directing and overseeing assessment of transfer and application of technologies for manufacture of pigments, titanium sponges/metals, alloys, and ensure advanced technologies to be applied and efficient energy consumption and eco-friendliness.

4. The Ministry of Transport

Take charge of reviewing and modifying the plan for traffic networks outside and inside seaports to meet growing demands for traffic and transportation in the titanium extraction and processing industry.

5. The Ministry of Planning and Investment

Take charge of and collaborate with relevant Ministries in mobilizing and calling for ODA funds and allocate capital for preparation for and making of investments in fundamental infrastructural systems auxiliary to the titanium industry.

6. The Ministry of Finance

Take charge of and collaborate with the Ministry of Industry and Trade in association with the Ministry of Natural Resources and Environment in revising tax and fee policies so that they become relevant over periods of time and titanium product types with a view to promoting deep-processed titanium manufacture and consumption. 

7. The Ministry of Agriculture and Rural Development

Take charge of and collaborate with relevant Ministries and local authorities in directing the plan for investment in construction of lakes and dykes for the purpose of providing adequate water for titanium extraction and processing activities, especially in Ninh Thuan and Binh Thuan, as well as for agricultural and rural development activities.

8. The People’s Committees of centrally-affiliated cities and provinces where titanium mineral operations are taking place

- Closely cooperate with Ministries in implementation and management of this Plan.

- Take charge of and collaborate with the Ministry of Natural Resources and Environment and other related Ministries in carrying out careful review of boundaries between mines proposed to be explored and from which minerals are extracted during the planning period within such territories, and recommend measures to be taken to deal with areas of which boundaries are overlapped with these of industry, tourism, agriculture- forestry projects within such territories (if applicable) immediately from the stage of inspection and grant of permits for mineral exploration operations.   Take the main responsibility for protection of titanium resources which have yet to be extracted within these territories.

- Take charge of and collaborate with project owners in providing compensation and carrying out site clearance or residential relocation for titanium extraction and processing projects.

- Provide preferential policies for project owners in selection, training and utilization of local workforce, and provide vocational training and attract high quality employees to work on projects.

- Enthusiastically carry out communication and dissemination of legislation and policies on minerals relating to implementation of this plan within such territories.

9. Vietnam Titanium Association

- Collaborate with competent authorities in implementing, researching and proposing legislative policies to facilitate implementation of this plan.

- Encourage affiliated enterprises to proactively and enthusiastically enter into cooperations and associations in terms of application of new technologies and investments in titanium ore deep processing projects on a concentration basis.

Article 3. This Decision shall enter into force from the signature date and replace the Prime Minister’s Decision No. 104/2007/QD-TTg dated July 13, 2007.

Article 4. Ministers, Heads of Ministry-level agencies, Heads of Governmental bodies, and the Presidents of the People’s Committees of centrally-affiliated cities and provinces, shall be responsible for enforcing this Decision./.

Total forecast reserve and resource is about 657 million tonnes of heavy minerals (roughly 78 million tonnes of zircons), including:

- About 08 million tonnes (approximately 1.0 million tonnes of zircons) which have been extracted.

- About 210 million tonnes (including about 26 million tonnes of zircons) of mineral reserve and resource available within areas where mineral operations are prohibited and restricted.

- About 440 million tonnes (including about 52 million tonnes of zircons) of titanium ore reserve and resource which may be extracted.

With respect to this planned project, about 150 million tonnes of heavy minerals (including about 17 million tonnes of zircons) shall be extracted while the rest of these minerals shall be transferred to the national resource reserve.
