DECISION

PROVISIONAL TEMPORARY FEES, COLLECTION, PAYMENT, MANAGEMENT AND USE OF FEES FOR USING SIDEWALKS, YARDS, AND WATER SURFACES FOR GOODS TEMPORARILY IMPORTED FOR RE-EXPORT, GOODS IN TRANSIT, AND GOODS TO BE SENT TO BONDED WAREHOUSES IN HAI PHONG CITY

THE PEOPLE’S COMMITTEE OF HAI PHONG CITY

Pursuant to the Law on Organization of the People’s Councils and the People’s Committees dated November 26, 2003;

Pursuant to the Law on Promulgation of legislative documents by the People’s Councils and the People’s Committees dated December 03, 2004;

Pursuant to the Ordinance on Fees and charges dated August 28, 2001;

Pursuant to the Government's Decree No. 57/2002/ND-CP dated June 03, 2002 of the Government elaborating the implementation of the Ordinance on Fees and Charges; the Government's Decree No. 24/2006/ND-CP dated March 06, 2006 of the Government on amendments to the Decree No. 57/2002/ND-CP;

Pursuant to the Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance providing guidance on the implementation of the Ordinance on Fees and Charges; the Circular No. 45/2006/TT-BTC dated May 25, 2006 of the Ministry of Finance on amendments to the Circular No. 63/2002/TT-THE MINISTRY OF FINANCE;

Pursuant to the Circular No. 97/2006/TT-BTC dated October 16, 2006 of the Ministry of Finance providing guidance on the collection of fees and charges under the management of the People’s Councils of central-affiliated cities and provinces;

For the implementation of the Prime Minister’s Directive No. 23/CT-TTg dated September 07, 2012 on enhancement of state management of goods temporarily imported for re-export, goods in transit, and goods in bonded warehouses;

In consideration of opinions of the People’s Council of Hai Phong City in the Dispatch No. 152/HDND-CTHDND dated November 08, 2013;

At the request of Service of Finance in the Report No. 87/TTr-STC dated September 18, 2013; the Report No. 1336/STC-GCS dated October 18, 2013; and opinions of the Service of Justice in the Dispatch No. 50/STP-VBPL dated October 16, 2013,

DECIDES:

Article 1. Provisional fees, collection, payment, management and use of fees for using sidewalks, yards, and water surfaces for goods temporarily imported for re-export, goods in transit, and goods to be sent to bonded warehouses

1. Fee payers:

The entities having goods temporarily imported for re-export, goods in transit, and goods to be sent to bonded warehouses using sidewalks, yards, and water surfaces under the management of Hai Phong city.

2. Fees:

3. Fee collector: The People’s Committee of Hai An district.

4. Management and use of fee:

a) The People’s Committee of Hai An district shall keep 10% of the total fee collected to serve fee collection. The remaining 90% shall be transferred to government budget.

b) The collection, payment, management and use of fees shall comply with the Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance providing guidance on legislation on fees and charge, and the Circular No. 45/2006/TT-BTC dated May 25, 2006 of the Ministry of Finance on amendments to the Circular No. 63/2002/TT-BTC.

c) Services of Finance shall provide guidance and inspect the collection, payment, management and use of fees as prescribed; send periodic reports to the People’s Committee of Hai Phong city. Then the People’s Committee shall send reports to the People’s Council of Hai Phong city as prescribed.

d) The fee collector must use receipts in accordance with the Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance.

Article 2.

1. The People’s Committee of Hai An district shall cooperate with the Customs Department, the Service of Finance, the Headquarter of the Border guard of Hai Phong city, and relevant agencies in formulating a Regulation on cooperation in collection of fees for using sidewalks, yards, and water surface for goods temporarily imported for re-export, goods in transit, and goods to be sent to bonded warehouses in Hai Phong city to facilitate fee statement and fee payment.

2. The entities that have paid this fee shall not pay the fee for using part of the road or sidewalk for other purposes than traffic according to the Decision No. 2052/QD-UBND dated November 29, 2010 of the People’s Committee of Hai Phong City.

Article 3. Chief of Office of the People’s Committee of Hai Phong city, Directors of the Service of Finance, Service of Transport, Service of Industry and Trade, Service of Planning and Investment, Customs Department, Department of Taxation, State Treasury of Hai Phong city, Commander of the Border guard of Hai Phong city, the President of the People’s Committee of Hai An district, relevant organizations and individuals are responsible for the implementation of this Decision.

This Decision takes effect on December 01, 2013./.
