DECISION

DEFINING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF VIETNAM GOVERNMENT WEB PORTAL

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the Governments Decree No. 33/2008/ND-CP of March 19, 2008, defining the functions, tasks, powers and organizational structure of the Government Office;
At the proposal of the Minister-Director of the Government Office,

DECIDES:

Article 1. Position and functions

1. Vietnam Government Web Portal is a government integrated information portal and multimedia e-news agency under the Government Office and subject to the direct and overall management of the Minister-Director of the Government Office (below referred to as the Minister-Director).

2. Vietnam Government Web Portal functions to organize, manage and announce the Governments official information on the Internet; acts as the focal point for linking the Governments e-administrative information network on the Internet with ministries, ministerial-level agencies, government-attached agencies and Peoples Councils and Peoples Committees of provinces and centrally run cities (below referred to as ministries, branches and localities) and concerned organizations and agencies; and integrates information on the Governments public services on the Internet.

Its international transaction name is Vietnam Government Web Portal (abbreviated to VGP).

3. Vietnam Government Web Portal is a non-business unit, has the legal person status and its own seal, and may open accounts at the State Treasury; is financed by the state budget for its operation; is organized and operates as a press information and communication agency; and is subject to the Ministry of Information and Communications state management of information and communication according to law.

Article 2. Tasks and powers

Vietnam Government Web Portal shall assist the Minister-Director in performing the following specific tasks and powers:

1. To assume the prime responsibility for, and coordinate with concerned ministries and branches in, submitting to the Minister-Director for approval according to his/her competence or for submission to the Prime Minister for approval, its strategies, plans and other important schemes and projects; to coordinate with concerned agencies in organizing the implementation thereof after they are approved by competent authorities.

2. To coordinate with ministries, branches and localities and concerned agencies and organizations in professional operations of linking and synchronizing database (excluding state secrets) to be updated on Vietnam Government Web Portal; to standardize software to use and exploit national information resources for linking websites or web portals into a uniform web system on the Internet; to fully and promptly exploit, receive, integrate and update different kinds of information (excluding state secrets); to ensure the compatibility and uninterrupted connection throughout the course of sharing and exchanging information in line with the administrative reform program of the Government and the Prime Minister and the roadmap for building an e-government.

3. To assume the prime responsibility for, and coordinate with ministries, branches and localities and concerned agencies and organizations in, integrating information on the Governments public services on the Internet.

4. To coordinate with units under the Government Office in fully exploiting and receiving different kinds of information; to promptly process and update such information (excluding state secrets) in order to perform its assigned functions, tasks and powers according to law.

5. By applying information technology, to organize online exchanges, meetings and dialogues and other forms of communication between the Government, the Prime Minister, ministries, branches and localities and concerned agencies and organizations, and the people.

6. To receive complaints, denunciations, comments and proposals sent via the Internet by organizations and individuals to the Government, the Prime Minister or the Government Office and forward them to competent agencies for settlement and reply according to law.

7. To technologically, technically and artistically design Vietnam Government Web Portal and its databases storing capacity; to develop and diversify contents, forms of operation, applications and multimedia products in order to raise the capacity of disseminating and propagating the Partys guidelines and policies and the States laws; information on the national socio-economic situation and current domestic and international affairs; to effectively serve the direction and administration of the Government and the Prime Minister.

8. To coordinate with websites or web portals of ministries, branches and localities and concerned agencies and organizations in professional operations.

9. To coordinate with concerned units in placing the e-Cong Bao (Official Journal) of the Socialist Republic of Vietnam on Vietnam Government Web Portal.

10. To manage the Governments Internet database center, technological infrastructure and special-use equipment.

11. To manage and implement investment and construction projects assigned to it according to law; to participate, upon request, in advising on, designing and appraising schemes and projects related to professional operations of the system of websites or web portals of ministries, branches and localities and concerned agencies and organizations; to participate in conducting professional appraisal of other important projects as assigned by the Minister-Director.

12. To organize professional retraining related to the operation of the Web Portal according to law.

13. To study and apply scientific and technical advances to improve the operation efficiency of the Web Portal.

14. To carry out international cooperation on the Web Portals operations according to law.

15. To assume the prime responsibility for, and coordinate with units under the Government Office and concerned agencies in, ensuring network safety, system security and internal security.

16. To provide value-added services according to law and the Ministry of Finances guidance in order to effectively use and re-invest in its existing material foundations without affecting its assigned political tasks.

17. To manage its organizational apparatus and payroll; implement the wage regime and policies and regimes on treatment, reward and disciplining towards its cadres, public employees and servants, laborers and collaborators according to law.

18. To manage and use its assigned assets, allocated funds and other financial sources according to law.

19. To perform other tasks and exercise other powers as assigned by the Prime Minister or the Minister-Director.

Article 3. Organizational structure and payroll

1. Vietnam Government Web Portal has its editor-in-chief and no more than 3 deputy editors-in-chief.

The editor-in-chief of Vietnam Government Web Portal (below referred to as the editor-in-chief) is appointed, relieved from office, and dismissed by the Minister-Director; and shall take responsibility before law and the Minister-Director for the entire operation of Vietnam Government Web Portal.

Deputy editors-in-chief are appointed, relieved from office, and dismissed by the Minister-Director according to law; and shall take responsibility before the Minister-Director and the editor-in-chief for their assigned tasks.

2. Organizational structure

a/ The Secretariat-General Affairs Department;

b/ The Professional Operations Department;

c/ The Technology-Technique Department;

d/ The Planning-Finance Department;

e/ The International Cooperation Department;

f/ The Office;

g/ The Research and Development Center.

3. The domestic representative agencies in Ho Chi Minh City, Da Nang City and Can Tho City.

4. Overseas representative agencies shall be decided on by the Minister-Director after obtaining the Prime Ministers permission.

5. Depending on development requirements of Vietnam Government Web Portal, the Minister-Director may propose the Prime Minister to establish new units or merge, dissolve or rename units specified in Clauses 2, 3 and 4 of this Article.

6. The Minister-Director may appoint, relieve from office and dismiss heads and deputy heads of units specified in Clauses 2, 3 and 4 of this Article.

7. The editor-in-chief shall define the functions, tasks and powers of units of Vietnam Government Web Portal. When necessary, the editor-in-chief may propose the Minister-Director to establish a number of sections under units specified in Clauses 2, 3 and 4 of this Article.

8. The Minister-Director shall decide on the payroll of Vietnam Government Web Portal according to law.

Article 4. Implementation effect

1. This Decision takes effect 15 days after its publication in "CONG BAO"; and replaces the Prime Ministers Decision No. 229/2003/QD-TTg of November 7, 2003, establishing the website of the Government of the Socialist Republic of Vietnam; and Decision No. 250/2005/QD-TTg of October 10, 2005, on the organization and operation of the website of the Government of the Socialist Republic of Vietnam.

2. To annul all previous provisions which are contrary to this Decision.

Article 5. Implementation responsibilities

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairmen of Peoples Councils and presidents of Peoples Committees of provinces and centrally run cities, the editor-in-chief of Vietnam Government Web Portal, and concerned agencies and organizations shall implement this Decision.
