CIRCULAR
ON ISSUING THE LIST OF PLANT PROTECTION DRUG PERMITTED FOR USE, RESTRICTED FOR USE AND BANNED FROM USE IN VIETNAM
Pursuant to Decree No. 01/2008/ND-CP dated 03 May 2008 01 of the Government regulating functions, duties, powers and organizational structure of the Ministry of Agriculture and Rural Development, and Decree No. 75 / 2009/ND-CP dated September 10, 2009 by the Government on amending Article 3 of Decree No. 01/2008/ND-CP dated January 03, 2008 of the Government regulating functions, duties, power and organizational structure of Ministry of Agriculture and rural Development;
Pursuant to the Ordinance on Plant Protection and Quarantine dated July 25, 2001;
Pursuant to Circular No. 38/2010/TT-BNNPTNT dated June 20, 2010 of the Ministry of Agriculture and Rural Development regulating the management of plant protection drugs;
Ministry of Agriculture and rural Development issues the list of plant protection drugs permitted for use, restricted for use or banned from use in Vietnam.
Article 1. Issued together with this Circular:
1. List of plant protection drugs permitted for use in Vietnam, Appendix 1 attached including:
a) Drug use in Agriculture :
- Pesticides: 662 active substances with 1549 trade names
- Fungicides: 468 active substances with 1098 trade names.
- Herbicide: 195 active substances with 584 trade names.
- Mouse-killing drug: 10 active substances with 21 trade names.
- Growth regulator: 49 active substances with 133 trade names.
- Insect attractant: 8 active substances with 9 trade names.
- Anti-snail drug: 21 active substances with 120 trade names.
- Synergist: 5 active substances with 6 trade names.
b. Anti-termite drug: 12 active substances with 6 trade names.
c. Forest products preservative: 5 active substances with 7 trade names.
d. Disinfectant for storage: 5 active substances with 5 trade names.
e. Drugs used for golf courses:
- Pesticide: 1 active substance with 1 trade name
- Fungicides: 3 active substances with 3 trade names.
- Herbicide: 1 active substance with 1 trade name.
- Growth regulator: 1 active substance with 1 trade name.
2. List of plant protection drugs restricted for use in Vietnam, Appendix 2 attached including:
a. Drug used in agriculture
- Pesticide: 4 active substances with 7 trade name
- Mouse-killing drug: 1 active substance with 2 trade name
b. Anti-termite drug: 2 active substances with 2 trade names.
c. Forest products preservative: 5 active substances with 5 trade names.
d. Disinfectant for storage: 3 active substances with 9 trade names.
3. List of plant protection drugs banned from use in Vietnam, according to Appendix 3 including:
a. Pesticide and forest products preservative: 21 active substances
Fungicides: 6 active substances
b) Mouse-killing drug: 1 active substance
c) Herbicide: 1 active substance
Article 2. The export and import of plant protection drugs in this Circular shall comply with Decree No. 12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of the Commercial Law concerning the purchase and sale activities of international goods and activities of agent, purchase, sale, processing and transit of goods with foreign countries
Article 3. Plant Protection Department is responsible for guiding the use of plant protection drugs restricted from use in Vietnam.
Article 4. This Circular takes effect 45 days from the date of its signing and supersedes the Circular No. 73/2011/TT-BNNPTNT dated October 26, 2011, No. 36/2011/TT-BNNPTNT dated May 20, 2011 of Ministry of Agriculture and Rural Development.
Article 5. Director of Plant Protection Department, Chief of Office of the Ministry, heads of units of the Ministry and other organizations and individuals concerned are liable to implement this Circular.
