CIRCULAR
ON THE PROMULGATION OF THE LIST OF ACCEPTABLE, RESTRICTED AND BANNED AGROCHEMICALS, AND THE ADDITIONAL LISTS OF PLANT VARIETIES ALLOWED TO BE PRODUCED AND TRADED IN VIETNAM
Pursuant to the Government's Decree No. 01/2008/NĐ-CP on January 03, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural development, and the Government's Decree No. 75/2009/NĐ-CP dated September 10, 2009, amending Article 3 of the Government's Decree No. 01/2008/NĐ-CP dated January 03, 2008;
Pursuant to the Ordinance on Plant protection and quarantine dated July 25, 2001;
Pursuant to the Ordinance on Plant varieties March 24, 2004;
At the request of the Director of the Legal Department, the Director of Plant Protection Department and the Director of the Department of Crop production;
The Minister of Agriculture and Rural development promulgates the list of acceptable, restricted and banned agrochemicals, and the additional lists of plant varieties allowed to be produced and traded in Vietnam
Article 1. Promulgating together with this Circular:
1. The list of acceptable agrochemicals in Vietnam in Appendix 1 to this Circular, including:
a) Chemicals used for agriculture:
- Insecticides: 745 substances with 1662 trade names.
- Fungicides: 552 substances with 1229 trade names.
- Herbicides: 217 substances with 664 trade names.
- Rodenticides: 10 substances with 22 trade names.
- Plant-growth regulators: 52 substances with 139 trade names.
- Insect baits: 8 substances with 9 trade names.
- Snailicides: 25 substances with 134 trade names.
- Supporting chemicals: 5 substances with 6 trade names.
b) Termiticides: 13 substances with 19 trade names.
c) Timber preservatives: 6 substances with 8 trade names.
d) Disinfectants: 3 substances with 3 trade names.
dd) Chemicals used for golf courses:
- Insecticides: 1 substances with 1 trade names.
- Fungicides: 3 substances with 3 trade names.
- Herbicides: 1 substances with 1 trade names.
- Plant-growth regulators: 1 substances with 1 trade names.
e) Chemicals for seed treatment.
- Insecticides: 1 substances with 1 trade names.
2. The list of restricted agrochemicals in Vietnam in Appendix 2 to this Circular, including:
a) Chemicals used for agriculture:
- Insecticides: 2 substances with 4 trade names.
- Rodenticides: 1 substances with 2 trade names.
b) Termiticides: 2 substances with 2 trade names.
c) Timber preservatives: 5 substances with 5 trade names.
d) Disinfectants for warehouses: 3 substances with 9 trade names.
3. The list of banned agrochemicals in Vietnam in Appendix 3 to this Circular, including:
a) Insecticides and timber preservatives: 21 substances.
b) Fungicides: 6 substances.
c) Rodenticide: 1 substance.
d) Herbicide: 1 substance.
4. The additional lists of plant varieties allowed to be produced and traded in Vietnam in Appendix 4 to this Circular, including 05 varieties of paddy and 03 varieties of mushrooms
Article 2. Vimoca 20EC; Suprathion 40EC; Hostathion 40EC; Agrosan 40EC, 50EC; Edisan 30EC; Kuang Hwa San 50EC; Vihino 40EC in the list of acceptable agrochemicals in Vietnam may be traded and used until August 25, 2013.
Kosfuran 3GR; Vifuran 3GR; DuPontTM Lannate® 40SP, Supermor 24SL in the list of restricted agrochemicals in Vietnam may be traded and used until August 25, 2013.
Article 3. Effect
1. This Circular takes effect on June 01, 2013.
2. This Circular supersedes:
a. The Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 of the Ministry of Agriculture and Rural Development on the promulgation of the list of acceptable, restricted and banned agrochemicals in Vietnam;
b) The Circular No. 19/2012/TT-BNNPTNT dated May 02, 2012 of the Ministry of Agriculture and Rural Development on the amendments to the Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 of the Ministry of Agriculture and Rural Development on the promulgation of the list of acceptable, restricted and banned agrochemicals in Vietnam;
c) The Circular No. 22/2012/TT-BNNPTNT dated June 05, 2012 of the Ministry of Agriculture and Rural Development on the amendments to the Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 of the Ministry of Agriculture and Rural Development on the promulgation of the list of acceptable, restricted and banned agrochemicals in Vietnam;
d) The Circular No. 54/2012/TT-BNNPTNT dated October 30, 2012 of the Ministry of Agriculture and Rural Development on the amendments to the Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 and the Circular No. 22/2012/TT-BNNPTNT dated June 05, 2012 of the Ministry of Agriculture and Rural Development on the amendments to the Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012;
Article 4. Responsibility for the implementation
1. Plant Protection Department shall provide guidance on the use of agrochemicals restricted in Vietnam.
2. The Chief of the Ministry Office, the Director of the Legal Department, the Director of Plant Protection Department, the Director of the Department of Crop production, heads of Ministerial units, organizations and individuals involved are responsible for the implementation of this Circular./.
