CIRCULAR
ON THE LIST OF POTENTIALLY UNSAFE COMMODITIES UNDER THE MANAGEMENT OF THE MINISTRY OF TRANSPORT
Pursuant to the Law on Quality of Commodities dated 21 November 2007;
Pursuant to the Government's Decree No. 132/2008/ND-CP dated 31 December 2008 providing guidelines for certain articles of the Law on Quality of Commodities;
Pursuant to the Government’s Decree No. 107/2012/ND-CP dated 20 December 2012 on functions, missions, authority and organizational structure of the Ministry of Transport;
At the request of the Director General of Department of Science and Technology and Director General of Vietnam Register;
The Minister of Transport hereby adopts a Circular on the list of potentially unsafe commodities under the management of the Ministry of Transport.
Article 1. Scope
This Circular provides for:
1. The list of potentially unsafe commodities (below collectively referred to as “the List of category 2 commodities) under the management of the Ministry of Transport.
2. HS Code for the list of category 2 commodities.
Article 2. Regulated entities
This Circular applies to:
1. Domestic and foreign organizations and individuals related to production, business, design and construction of the category 2 commodities under the management of the Ministry of Transport.
2. Organizations and individuals related to management and assessment of the quality of category 2 commodities under the management of the Ministry of Transport.
Article 3. List of category 2 commodities under the management of the Ministry of Transport
Enclosed with this Decision, the list of category 2 commodities under the management of the Ministry of Transport consists of 02 (two) Appendices:
1. Appendix 1: List of category 2 commodities subject to declaration and certification of conformity.
2. Appendix 2: List of category 2 commodities subject to declaration of conformity.
Article 4. Effect
1. This Circular comes into force from February 01, 2017.
2. This Circular replaces the Circular No. 63/2011/TT-BGTVT dated December 22, 2011 of the Minister of Transport on the list of potentially unsafe commodities under the management of the Ministry of Transport.
Article 5. Responsibility for implementation
1. General Departments and Departments affiliated to the Ministry shall:
a) implement this Circular;
b) review the list of commodities under their management and submit it to the Ministry.
2. The Department of Science and Technology shall consolidate proposals of Departments and General Departments for amendments to the list.
3. Difficulties that arise during the implementation should be promptly reported to the Ministry of Transport.
4. If legislative documents, technical standards and regulations mentioned in this Circular are amended or replaced, the new ones shall prevail./.
