CIRCULAR

STIPULATING CHARGES FOR REGISTRATION OF USE OF THE NATIONAL DOMAIN NAME, MAINTENANCE OF THE NATIONAL DOMAIN NAME AND INTERNET ADDRESSES OF VIETNAM, AND THE COLLECTION, REMITTANCE, MANAGEMENT AND USE OF THESE CHARGES

Pursuant to the Telecommunications Law; and the Government's Decree No. 97/2008/ND-CP of August 28, 2008. on management, provision and use of internet services and online information;
Pursuant to the Government's Decree No. 57/ 2002/ND-CP of June 3, 2002, and the Government's Decree No. 24/2006/ND-CP of March 6, 2006, detailing the Ordinance on Charges and Fees;
Pursuant to the Government's Decree No. U8/2008/ND-CP of November 27, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
After obtaining the Ministry of Information and Communications' opinions in its Official Letter No. 34I0/BTTTT-KHTC of October 12, 2010, the Ministry of Finance provides charges and fees for registration of use of the national domain name, maintenance of the national domain name, and internet addresses of Vietnam, and the collection, remittance and management of these charges and fees as follows:

Article 1. To promulgate together with this Circular the Table of fees for registration of use of the national domain name and charges for maintenance of the national domain name and internet addresses of Vietnam.

Article 2. Payers of the charges and fees specified in Article 1 of this Circular are domestic and foreign organizations and individuals that register and use the national domain name of Vietnam ".vn"; domestic organizations that are granted, manage and use internet addresses in Vietnam provided in the Law on Information Technology and the Government's Decree No. 97/2008/ND-CP of August 28, 2008, on management, provision and use of internet services and online information.

Article 3. Agencies assigned by the Ministry of Information and Communications to perform the state management of interne! in Vietnam shall collect, remit, manage and use charges and fees under this Circular (below referred to as collecting agencies). Charges and fees for use registration and maintenance of the domain name ".vn" and charges for internet addresses of Vietnam shall be managed and used as follows:

1. Collecting agencies may deduct 90% (ninety per cent) of the collected charges and fees before remitting into the state budget to cover the grant of registrations, management, maintenance and development of domain names and internet addresses of Vietnam; the collection of charges and fees under Circular No. 63/200 2/TT-BTC of July 24, 2002, Circular No. 45/2006/TT-BTC of May 25, 2006, and other current financial regulations of the Ministry of Finance, guiding the law on charges and fees; and the following expenses:

a/ Payment of yearly dues to regional and international organizations in charge of domain names and internet addresses and code numbers of which Vietnam is a member;

b/ Self financing of Vietnamese participants in internet-related meetings, seminars and training held by international organizations;

c/ Payment of commissions (if any) to organizations and individuals engaged in or being agents for the grant of registrations of use and maintenance of domain names and grant of internet addresses in Vietnam.

2. Collecting agencies shall declare, remit and settle 10% (ten per cent) of the collected charges and fees into the state budget according to the current state budget index and the Finance Ministry's Circular No. 63/2002/TT-BTC of July 24, 2002, and Circular No. 45/2006/TT-BTC of May 25, 2006.

Article 4. This Circular takes effect on January 10, 2011, and replaces the Finance Minister's Decision No. 28/2006/QD-BTC of May 5, 2006, and Decision No. 28/2005/QD-BTC of May 13, 2005, promulgating the Table of charges and fees for licensing and management of domain names and internet addresses of Vietnam.

Other matters related to the collection, remittance, management, use and publicity of charge and fee collection regulations not provided in this Circular comply with the Finance Ministry's Circular No. 63/2002/TT-BTC of July 24, 2002, guiding the law on charges and fees, and Circular No. 45/2006/TT-BTC of May 25, 2006, amending and supplementing Circular No. 63/2002/TT-BTC of July 24, 2002; and the Finance Ministry's Circular No. 60/2007/TT-BTC of June 14, 2007, guiding a number of articles of the Tax Administration Law and the Government's Decree No. 85/2007/ND-CP of May 25, 2007, detailing a number of articles of the Tax Administration Law, and Circular No. 157/2009/TT-BTC of August 6, 2009, amending and supplementing Circular No. 60/2007/TT-BTC of June 14, 2007.

Article 5. Charge and fee payers, agencies assigned by the Ministry of Information and Communications to perform the state management of internet in Vietnam and responsible for collecting fees for use registration and charges for maintenance of the domain name ".vn" and internet addresses of Vietnam, and concerned agencies shall implement this Circular.

Any problems arising in the course of implementation should be promptly reported to the Ministry of Finance for study and additional guidance.-
